About this file
This limited source justification document describes a blanket purchase agreement awarded by the General Services Administration to Atlantic Diving Supply, Inc. for hybrid enhanced ballistic protection system components in support of the CH-47 Chinook helicopter program. The requiring agency is the U.S. Army Program Executive Office-Aviation Cargo Program Management Office. The supplies required include 114 line items of ballistic armor panels, brackets, and hardware manufactured by The Protective Group as the original equipment manufacturer. Justification is provided that only Atlantic Diving Supply, as the authorized distributor, can meet the requirements for technical and logistical reasons. The award against GSA Schedule 84 is valued at $50 million over three years. Market research found no other suppliers that can meet the total ballistic solution, and the justification describes ongoing actions to overcome barriers to competition when possible.

LIMITED SOURCE JUSTIFICATION (LSJ)
IDENTIFICATION OF THE AGENCY AND THE CONTRACTING ACTIVITY
The requiring agency is U.S. Army Program Executive Office – Aviation (PEO Aviation) Cargo Program Management Office (PMO) CH-47 Chinook Helicopter at Redstone Arsenal, AL. The contracting activity is the General Services Administration, Global Supply, Southwest Supply Acquisition Center, 819 Taylor St. (13A33), Fort Worth, TX 76102.
DESCRIPTION OF THE ACTION BEING TAKEN
This action is to justify the award of a Limited-Source, Firm-Fixed Price Blanket Purchase Agreement (BPA) for the supply of replacement Hybrid Enhanced Ballistic Protection System (HEBPS) components in support of the CH-47 Chinook Helicopter Project Management Office (PMO). This Limited Source Justification (LSJ) serves to support the procurement as a one-source award for these components distributed by Atlantic Diving Supply, Inc. (ADS). HEBPS systems are installed on Chinook helicopters to protect pilots and soldiers from small arms fire during air combat missions. The manufacturer of the HEBPS components is The Protective Group (TPG); however, TPG confirmed ADS is their sole authorized distributor for these items. Additionally, TPG has confirmed that they do not provide these items directly to the Government. As a result, this procurement was conducted as a one-source award.
This BPA was awarded against GSA Schedule 84 with a procurement value of $50,000,000.00 (Not to Exceed).
DESCRIPTION OF SUPPLIES REQUIRED
PEO Aviation has a requirement for numerous Hybrid Enhanced Ballistic Protection System (HEBPS) replacement parts in order to bring existing HEBPS kits back into condition "A" for deployable units. Condition Code A is defined as, “…a serviceable/excellent new, used, repaired or reconditioned material which is serviceable and issuable to all customers without limitation or restrictions.” PEO Aviation is responsible for repairing CH-47 Chinook Helicopters required for deployment to varying combat theaters of operation.
PEO Aviation requires numerous replacement components of the HEBPS system when a component is no longer reparable or functional (i.e. it does not afford the required ballistic protection) once it has been damaged. This procurement is to provide replacement components to bring the HEBPS sets back to 100% deployable condition, as known as Condition Code “A”.
The following one hundred fourteen (114) line items (all manufactured by TPG) represent the necessary components for the HEBPS systems required to protect the CH-47 Chinook Helicopter:

IDENTIFICATION OF STATUTORY AUTHORITY
This acquisition is conducted under the authority of the Multiple Award Schedule (MAS) program. The primary statutory authorities for MAS are Title III of the Federal Property and Administrative Services Act of 1949 (41 USC 251 ET SEQ), and Title 40 U.S.C. 501, Services for Executive Agencies. The circumstances and rationale for limiting consideration to select schedule contractors for award follows:
The circumstances and rationale for limiting consideration to ADS for award in accordance with FAR 8.405-6(a)(1)(i)(B) – Only one source is capable of providing the supplies or services required at the level of quality required because the supplier or services are unique or highly specialized. As such, ADS is the sole authorized distributor of the deliverables manufactured by the only known company that is specifically qualified to provide the required components, TPG.
This LSJ will be posted to FedBizOpps within fourteen (14) days of award in accordance with FAR 8.405-6(a)(2)(i).
DEMONSTRATION OF THE PROPOSED MANUFACTURER'S UNIQUE
QUALIFICATIONS TO PROVIDE THE REQUIRED SUPPLY
The Pentagon (Department of Defense Message ALARACT 120/2012, DTG: P 262255Z APR 12) has stipulated that aircraft in Theater of Operations shall have an Airship Mission Equipment Package (MEP) in order to operate for Operation Freedom Sentinel, Operation Inherent Resolve or any overseas contingency operations. One of the requirements listed in the MEP is for a fully functional HEBPS system to be installed on every CH-47 Chinook Helicopter that is deployed for overseas contingency operations. The customer requires the supply of repair parts for current HEBPS systems in order to properly service CH-47 Chinook Helicopters and return them to deployable condition.
The Protective Group, Inc. (TPG) is the original equipment manufacturer (OEM) of the HEBPS components listed in “Description of Supplies Required” section above. PMO Cargo has identified the HEBPS system as the only ballistic system available to meet the requirement stated in the All Army Activity memo. Army Combat Aviation Brigades need these CH-47 Chinook Helicopters for deployment and the turn-around for the required parts have become crucial for the Commanders in Combat. PMO Cargo also manages the Foreign Military Sales (FMS) program for the CH-47 Chinook Helicopters. As a result, the CH-47 Chinook helicopters maintained under the FMS program are pure-fleeted with the HEBPS system, and therefore, require only HEBPS components for maintenance and repair.
To introduce a different manufacturer’s product at this time would compromise the Army’s directive to maintain a fully functional HEBPS on the helicopters. Proper equipment testing necessitated by a new source would jeopardize the Army’s current ability to maintain a system capable of contingency aircraft maintenance operations thereby compromising their ability to successfully meet mission needs. Additionally, the Government’s cost of ownership would significantly as it would force the Army to provide for multiple hardware solutions in the interest of maintenance and repair as well as replacing entire ballistic systems. This would not only be cost prohibitive, but would negatively affect PMO Cargo’s ability to quickly and efficiently send replacement components to end users.
DETERMINATION THAT THE ANTICIPATED AWARD WILL BE THE BEST
VALUE
All pricing was found fair and reasonable prior to awarding the BPA. The Contracting Officer sought price reductions from ADS and pricing was reviewed to ensure that pricing and terms were in accordance with ADS’ Multiple Award Schedule (MAS) contract, GS-
07F-5965P.
The Contracting Officer anticipated using a variety of price analysis techniques in order to substantiate the price reasonableness of the items requested in the award decision document.
These techniques included, but were not limited to the following:
- requesting recent commercial and Government sales history
- making indirect pricing comparisons to:
o the same or similar items in the marketplace, o competitive published price lists, and o Independent Government Estimates
DESCRIPTION OF THE MARKET RESEARCH CONDUCTED
Market research was conducted in accordance with FAR Part 10 to determine the availability of products capable of meeting the Government’s requirement. The results of the market research determined that while other companies were capable of providing parts of a ballistic component system, only ADS would be able to meet the Government’s requirement of providing the total ballistic solution as required by PMO Cargo.
TPG is an other than small business that has historically acted as a supplier for another company in support of a requirement rather than contracting with the government directly. The Contracting Officer contacted TPG to determine if other authorized distributors were available for the required HEBPS components. A representative of TPG confirmed via email that ADS is currently their only authorized distributor for the products discussed above.
Finally, a special notice was posted to FedBizOpps in advance of the BPA’s award to alert industry of the Contracting Officer’s intent to negotiate with a single source for the required HEBPS components against GSA schedules in the spirit of maximum transparency. A vendor inquiry was received via telephone relating to CLIN 33, P/N 3082-180-4000-00 Transparent Armor Kit. The Contracting Officer advised the vendor to submit any questions formally in writing by close of business Monday, December 3, 2018 to be addressed as a procurement action had not been taken at that time. No written inquiry was received.
At this time, no other known products the requirements of PMO Cargo.
OTHER FACTS SUPPORTING THE USE OF THE OTHER THAN FULL AND
OPEN COMPETITION
All factors are described under section IDENTIFICATION OF STATUTORY AUTHORITY and DEMONSTRATION OF THE PROPOSED MANUFACTURER’S UNIQUE QUALIFICATIONS TO PROVIDE THE REQUIRED SUPPLY above.
STATEMENTS OF ACTION TO OVERCOME BARRIERS TO COMPETITION
ADS is currently the only source capable of meeting the Government’s needs. Until it is determined that the HEBPS components manufactured by TPG can be sourced elsewhere, they will be procured from ADS. In order to continue the process of overcoming barriers to competition, PMO Cargo will continue to evaluate the capabilities of other vendors through continuing market research and the changing needs of Army PEO Aviation.
Additionally, the Contracting Officer will determine at the time of the BPA’s option exercise if a need for the components BPA still exists and if the BPA for these items is still considered to be the best value to the Government. If a bona fide need no longer exists or if the awarded BPA prices are no longer the best value, the BPA will be allowed to expire and the requirement shall be re-procured. Furthermore, a BPA allows for the Government to cancel the agreement for convenience as needed. If another vendor is able to provide documentation to the Contracting Officer that they have the ability to provide the required HEBPS components, and are able to provide them in a timely manner, then the Government will be able to conduct a new procurement under competitive procedures and cancel the existing BPA when convenient.
