JUSTIFICATION FOR SOLE SOURCE or BRAND NAME SPECIFIED (Simplified Acquisitions <$150K)

In accordance with FAR 13.106-1(b), the Contracting Officer determines if the circumstances of the contract action deem only one source reasonably available or a portion of the purchase specifies a particular brand-name item. This determination must be supported with full justification for Sole Source or Brand Name from the Technical/Requirements personnel. When the Technical/Requirements personnel describe an item with a purchase description which limits the competition, the justification must explain why the item is the only one that will meet the Government’s requirement. The Technical/Requirements personnel shall provide the following information:

1. Organization/Line Office:

National Oceanic and Atmospheric Administration Office of Marine and Aviation Operations Marine Engineering Division, Atlantic

2. Procurement Request Number: NMAN7200-16-01123

3. Description of Action being Approved:

Purchase of eighteen (18) each pumps with electrical motors.

4. Description of item or services required to meet the Agency’s needs (including estimated value):

Items being purchased are pumps with electrical motors. These pump/motor sets come as a unit read to install.

5. List the proposed contractor (name and address) or brand name and describe the unique characteristics that limit availability to only one source (explain why the suggested source is the only source which can provide the supplies or services):

The proposed brand name is Aurora. These new pump sets are to be an exact replacement unit for existing pump sets on board the ship that have been in service since 1997. Exact replacement units are required for the following reasons:

1. To match the existing pump foundations and mounting configurations. Many of these pumps are mounted to vibration isolation mounts as well.

2. To match the existing piping arrangement and fit up.

3. To match the existing power requirements and length of power cord that is already installed.

4. The space envelope for many of these units in the various machinery spaces is restricted.

5. Modifications of the above items would incur substantial additional costs to Government as well as add considerable time for the installation of these units.

6. The ship currently has a large inventory of parts for these pumps. If a different manufactuer or brand were to be utilized, the Government would incur an additional cost for spares, as well as administrative costs of removing existing inventory and storing new inventory, and updating the ship’s inventory control program. It is estimated that the ship has $20,000 of spares currently in inventory for these pumps.

6. Describe how the Government will determine the cost to be fair and reasonable:

The Government will be able to determine that the cost will be fair and reasonable through competition. This brand of pump can be provided by numerous vendors that can bid on this order competitively.

7. Description of market research conducted:

Market research was conducted online. There are no pumps that have the exact footprint and piping connection dimensions to these pumps.

8. Statement of actions, if any, to remove barriers to competition in the future:

No statement of actions can be thought of that would make it less expensive to switch to another brand versus the cost of modification as detailed in paragraph 5.
