Amendment A0002

DTRT57-12-R-20010

October 18, 2012

Question #1: We intend to submit a proposal from a subcontractor whose rates are established and have been determined as reasonable under their GSA Schedule. This subcontractor does not have DCAA approved rates and we intend to award them a T&M subcontract. Is a cost realism analysis required for them?

Answer #1: A cost realism analysis is not required for a T&M subcontract. You should follow the instructions under Section L.4.C, paragraph 10, Subcontracts, paragraph three, which describes the basis and documentation required for acceptance of T&M billing rates. Offerors should determine fair and reasonableness of all subcontractor rates and provide documentation in its proposal.

Question #2: Are we able to award a FFP contract?

Answer #2: If this refers to the award of a FFP subcontract, yes. If proposing a FFP subcontract your proposal should include proper documentation to support the subcontractor’s proposal along with the prime contractor’s analysis of fair and reasonable price. This includes labor Build-Up of proposed billing rates and support for each cost element, or, evidence of commerciality of the proposed billing rates. The Government anticipates that subcontracts will be predominantly cost-plus-fix-fee except for consultants that will be either time-and-material or labor hour.

Question #3: Are you able to provide insight regarding the difference between the labor categories listed on the LOE table (RFP p.52) and the resume table (p.55)? Are we required to submit this table with the proposal and if so, where?

Answer #3: Page 52 constitutes the Total Level of Effort (Labor Hours) for this procurement over 5 years. This Prime offerors must allocate hours by Prime and Sub in accordance with the labor categories in this LOE table and insert into Schedule 5 and Schedule 7. The Resume Table on Page 55 is not required as a submittal. On Page 59, Checklist for Schedules, “Exhibit A: Resume Checklist” is NOT required and has been deleted. Offerors should identify the company affiliation of each resumed person in Schedule 6 alongside the labor category. See pages 4-6 for an updated Exhibit A and Schedule 6.

Question #4: Please confirm the NAICS code and size standard for this solicitation.

Answer #4: The NAICS code for this solicitation is 541330 (Marine Engineering / Naval Architecture) with a small business annual size standard of $35.5 Million

Question #5: On the Schedule 5 (Calculation of Direct Labor) – at the bottom it says Extended Labor Cost – Contract Year. Is this supposed to be the unburdened or fully-burdened amount?

Answer #5: Offerors should include unburdened labor rates in Schedule 5 “Calculation of Direct Labor.” In accordance with Exhibit A: “Checklist for Schedules”, Schedule 5 is not needed for T&M subcontractor proposed rates.

Question #6a: On the Schedule 6 – (Labor Cost Realism) – If the prime contractor is proposing a rate to the Government based upon a buildup of actual salaries of employees and applicable burdens (which are

October 18, 2012 disclosed to the Government on another RFP Schedule), is this form required?

Answer #6a: Yes, in accordance with Exhibit A: “Checklist for Schedules”, all Prime offerors must fill out and submit Schedule 6 with proposal. Prime offeror’s are also directed to Section L.4.D 13 regarding Cost Accounting Systems.

Question #6b: In the case of the subcontractor – if the subcontractor is providing GSA Schedule rates – based upon approved rates determined by GSA – is this form required?

Answer #6b: In accordance with Exhibit A, if a subcontractor is proposed as T&M/FFP Schedule 6 is not required. Prime offerors must provide support of the subcontractors’ T&M/FFP proposed billing rate in the form of labor build up (evidence of each cost element) or, evidence of commerciality of the proposed billing rate (e.g. GSA, commercial sales, etc.) Also see question #2.

In accordance with Exhibit A, if a subcontractor is proposed as Cost-type Schedule 6 must be filled out.

In any event the Prime contractor must submit a completed Schedule 6 with its proposal.

ALL OTHER TERMS AND CONDITIONS REMAIN UNCHANGED.

October 18, 2012

If the Offeror’s accounting system has been audited and not accepted, provide details such as date of audit, deficiencies identified, corrective steps taken since disapproval, and reasons why approval of the accounting system is now assured.
