** INCOMPLETE QUOTES WILL BE DEEMED “NON-RESPONSIVE” AND WILL NOT BE EVALUATED. **
Award will be made to responsible contractor who presents the best value quote. PHMSA will use tradeoff analysis when making the best value determination and award based on the following factors to evaluate offers:
Evaluation Factor 1: Technical Capability
Under this factor, PHMSA will evaluate the offeror’s ability to meet PHMSA’s technical standards for uniforms, windbreaker jackets and logos including the written quote and submitted samples. PHMSA will evaluate whether the offeror demonstrates an understanding of the specifications and the samples submitted by the offeror demonstrate compliance with the specifications detailed in the SOW. Sample uniforms and windbreakers will be tested for the following characteristics:
Uniforms and windbreakers must meet all visual and text criteria as provided in Government provided specifications;
Fabric for uniforms and windbreakers must conform to the requirement listed in the SOW; (for shirts- anti-static, 100% pre-shrunk cotton (NO ANY OTHER MATERIAL TO BE USED) and for windbreaker-(100% polyester);
Seams on uniforms and windbreaker must not contain any loose stitching or untrimmed or pulled threads;
All uniforms and windbreakers must contain a printed label identifying size, fabric content, and laundering instructions;
Labels on each uniform and windbreaker must be located so that they are completely visible on each uniform and windbreaker when each uniform is folded or packaged so that it may not cause damage to the uniform and windbreaker;
Sample logos will be tested for the following characteristics:
Logos must meet all visual and text criteria as provided in Government provided specifications;
Logos must conform to requirement listed in the SOW;
Logos must not contain any loose stitching or untrimmed or pulled threads and be neatly prepared;
In addition, under these factors, PHMSA will evaluate the terms of the Warranty extended by the offeror, maximum time of normal delivery of shipment after receipt of order confirmation from Government.
Evaluation Factor 2: Past Performance
Under this factor, PHMSA will evaluate the Offeror’s ability to provide the type of supplies required under this solicitation based on the vendor’s past performance references.
Evaluation Factor 3: Price
Under this factor, PHMSA will evaluate the price reasonableness of proposed rates, and the price reasonableness of total price.
***Evaluation Factor 1 (Technical Capability) is more important than Evaluation Factor 2 (Past Performance). Evaluation Factors 1 and 2, when combined, are significantly more important than
Evaluation Factor 3 (Price).***
Technical evaluations must utilize the ratings listed in Table 1.
Table 1. Technical Ratings:
Rating Description
Exceptional Quoter demonstrated exceptional understanding of the requirements under the solicitation. Quoter’s quote and samples demonstrates outstanding expertise in the required industry to be able to successfully provide items for the requirement detailed in the SOW. The quoter’s quote included outstanding features that meet or exceed on multiple dimensions the expectations of the Government. The risk of poor performance is very low.
Acceptable Quoter demonstrated acceptable understanding of the requirements under the solicitation. Quoter’s quote and samples meets government expectation in terms of expertise required in the industry to be able to successfully provide items for the requirement detailed in the SOW. The quoter’s quote included features that meet or exceed the expectations of the Government. The risk of poor performance is low.
Unacceptable Quoter does not fully understand the requirement under the solicitation. Quoter’s quote and samples do not meet government expectation in terms of expertise required in the industry to be able to successfully provide items for the requirement detailed in the SOW. The could not satisfy the sample requirements; major weaknesses or deficiencies were noted. The risk of poor performance is high.
Past Performance evaluations must utilize the ratings listed in Table 2.
Table 2. Past Performance Relevancy Rating
Rating Definition
Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note below.)
Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.
Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305
(a)(2)(iv)). Therefore, the offeror must be determined to have unknown past performance. In the context of acceptability/unacceptability, "unknown" must be considered "acceptable."
PHMSA intends to evaluate quotes and award a Firm Fixed Price Delivery Order without any discussion or negotiation. Accordingly, the offeror’s quote should contain the offeror’s best terms from a cost or price and technical standpoint. However, PHMSA reserves the right to negotiate additional discounts if the Contracting Officer later determines them to be necessary.
4. CONTRACTOR RESPONSIBILITY DETERMINATION
To be eligible for award, the Contracting Officer must determine that the Contractor is responsible according to the standards of FAR 9.1, “Responsible Prospective Contractors.”
PHMSA will use past performance information obtained through PPIRS and other government data sources to aid in making a determination of contractor responsibility. Additionally, PHMSA will review FAPIIS information to ensure that the prospective awardee is not excluded from federal procurement and is current on all federal taxes. PHMSA will also consider a Contractor’s termination history when determining contractor responsibility.
