About this file
This is a Drug-Free Workplace Act Certification Form issued by the South Carolina Department of Disabilities and Special Needs (SCDDSN) as a requirement for state contracts. The certification applies to domestic contracts for the procurement of goods, construction, or services valued at fifty thousand dollars or more. Contractors must select the appropriate certification statement based on whether they are certifying as a business entity or as an individual, sign the form, and submit it to the using agency. The form establishes baseline compliance requirements that must be met prior to contract execution.
For business entities, the certification requires implementation of a comprehensive drug-free workplace program that includes publishing a workplace drug prohibition statement, establishing a drug-free awareness program, distributing the policy to all employees performing contract work, obtaining employee acknowledgment of the policy and conviction notification requirements, and notifying SCDDSN within ten days of receiving notice of any employee drug-related convictions. Entities must take appropriate personnel action, up to and including termination, or require satisfactory participation in an approved drug abuse rehabilitation program within thirty days of receiving notice of conviction. For individuals, the certification requires a simple statement that they will not engage in unlawful manufacture, distribution, dispensation, possession, or use of controlled substances in contract performance. Compliance with these requirements is mandatory under S.C. Code Ann. 44-107-30 and 44-107-40.
