Attorney working for contractors do not work for the USDA, so how is this flowed down to the Private Company Attorney for authority to operate. | See DRFP Attachment 06, Attorney Approval Request Template. Pursuant to 42 USC 1480(d), as implemented by 7 CFR 2.49(a)(6), prior to any Private Attorney representing the Secretary in litigation, they will need to demonstrate that they “will provide competent and cost effective representation for the Rural Housing Service”. The information provided will be submitted to the USDA General Counsel as the bases for its determination that the attorney will provide competent and cost-effective representation, and that such representation is consistent with 42 U.S.C. 1480(d). The General Counsel will determine the sufficiency of the request and provide its concurrence or a notice of insufficiency.

Can USDA provide rationale behind this change? | Thank you for the question. USDA will provide a response when the Questions and Answers are posted to SAM.gov. |
Quality standard listed for legal timelines is 95% - how will USDA handle cases where there are delays outside the control of the vendor - such as court delays or Covid lock-downs that prevent access to title records? | USDA will assess normal delays on a case-by-case basis.
What changes are anticipated in the RFP Process that will allow the contract(s) to be awarded this time? | Thank you for the question. USDA will provide a response when the Questions and Answers are posted to SAM.gov.
Within the draft RFP (seciton 6.3.1 Uncontested Foreclosure Services), there is an expectation that the contractor will attend the foreclosure sale (when required), can USDA provide more clarification to this expectation and purpose to attend the sale? | Yes, the Contractor will be required to attend sales.
