The Cognizant Senior Intelligence Officer (SIO) has exclusive security responsibility for all Sensitive Compartmented Information (SCI) classified material released to or developed under the contract and held within the Contractor’s SCI Facility (SCIF). Access to SCI Intelligence material requires adherence to the requirements set forth in the following: Department of Defense (DoD) Manual

(DoDM) 5105.21, Volume 1, SCI Administrative Security Manual: Administration of Information and Information Systems Security; DoDM 5105.21, Volume 2, SCI Administrative Security Manual:

Administration of Physical Security, Visitor Control, and Technical Security; DoDM 5105.21, Volume 3, SCI Administrative Security Manual: Administration of Personnel Security, Industrial Security, and Special Activities; ICD 403, Foreign Disclosure and Release of Classified National Intelligence; ICD 703, Protection of Classified National Intelligence Including Sensitive Compartmented Information; ICD 703-02, Reporting Requirements for Individuals with Access to Sensitive Compartmented Information;

ICD 703-03, Protection of Classified National Intelligence Including SCI Shared with Entities Outside the Intelligence Community; ICD 703-04, Foreign Ownership, Control, or Influence (FOCI); ICD 710, Classification Management and Control Markings Systems; ICPG 710.1, Application of Dissemination Controls: Originator Control (ORCON); DoD 5220.22-M, Change 2, National Industrial Security Program Operating Manual (NISPOM); and DoD 5220.22-R, DoD Industrial Security Program.

Contractor’s will comply with all regulations/manuals/directives stated therein which provide the necessary security and classification guidance for personnel, information, physical, automated information security (AIS), and technical security measures and is a part of the SCI security specifications for the contract. Inquiries pertaining to SCI classification guidance or interpretations shall be directed to the Contracting Officer Representative (COR).

1. Requirements for access to SCI:

a. All SCI will be handled in accordance with special security requirements, which will be furnished by the Command Special Security Officer (SSO).

b. SCI will not be released to contractor employees without specific release approval of the originator of the material as outlined in governing directives; based on prior approval and certification of "need-to-know" by the designated COR.

c. The contractor must restrict access to only those individuals who possess the necessary security clearance and who are actually providing services under the contract with a valid need to know. Further dissemination to other contractors, subcontractors, other government agencies, private individuals or organizations is prohibited unless authorized in writing by the originating agency through the COR.

d. Names of contractor personnel requiring access to SCI will be submitted to the COR for approval. Upon receipt of written approval from the COR, the company security officer will submit request(s) for special background investigations, in accordance with the NISPOM, to the Defense Security Service (DSS).

e. SCI material must not be released to foreign nationals or immigrant aliens whether they are consultants, U.S. contractors, or employees of the contractor and regardless of the level of their security clearance, except with advance written permission from the originator. Requests for release to foreign nationals shall be initially forwarded to the COR and shall include:

i. A copy of the proposed disclosure.

ii. Full justification reflecting the benefits to U.S. interests.

iii. Name, nationality, particulars of clearance, and current access authorization of each proposed foreign national recipient.

f. Contractor personnel must maintain accountability for all intelligence materials released to their custody.

g. SCI material will not be reproduced without prior approval of the originator of the material. All SCI material shall bear a prohibition against reproduction while in the contractor’s custody.

h. Inquiries pertaining to classification guidance on SCI will be directed through the Command SSO to the responsible COR as indicated on the DD Form 254.

i. SCI released to cleared-DoD Contractors, all reproductions thereof, and all other information generated based on, or incorporating data from, in support of this contract, remains the property of the U.S. Government. Upon completion or cancellation of the contract, all SCI material furnished will be returned to the direct custody of the supporting SSO, or destroyed IAW instructions outlined by the COR.

j. SCI will be stored and maintained only in properly accredited facilities meeting the physical security requirements in ICD 705, SCI Facilities and ICS 705, Technical Specifications for Construction and Management of SCI Facilities

k. The MCIA SSO will recognize the above noted estimated completion date (ECD) as the completion date for the contract. The SSO will initiate action to debrief contractor personnel with access to this contract unless extensions or modifications to the contract are received by the SSO office no later than 30 days after the established completion date.

l. The contractor is governed by ICD 704, ‘Personnel Security Standards and Procedures Governing

Eligibility for Access to Sensitive Compartmented Information (SCI) And Other Controlled Access Program Information’ and may be supplemented by additional SSO Navy guidance.

Contractor personnel that are eligible for access to SCI or currently possess an SCI personnel security clearance with another non-DoD agency must have their SCI eligibility accepted and entered into JPAS by the DoD Consolidated Adjudications Facility (CAF) prior to having access to SCI information retained MCIA, unescorted access to MCIA spaces, and receipt of an MCIA issued contractor badge. The Facility Security Officer (FSO) will identify, in writing, contractor

Navy DD Form 254 SCI Addendum August 18, 2017 personnel assigned to this contract by NAME, SSN, Date and Place of Birth, and provide this documentation to the COR identified. The COR will identify the SCI caveats for the contract and forward a copy of this documentation to the SSO for processing. This documentation will be marked and protected under the Privacy Act of 1974.

m. Electronic processing of SCI must be accomplished on equipment accredited in accordance with DoDM 5105.21 Volumes 1- 3, ICD 503, Information Technology System Security Risk Management, Certification and Accreditation, and the DoDIIS Joint Security Implementation Guide (DJSIG), Appendix D.

n. SCI security management issues shall be directed to the MCIA SSO at (703) 784-6242, sso@mcia.osis.gov.

o. In accordance with Director of National Intelligence Memorandum 5 May 2017, Access to North Atlantic Treaty Organization (NATO) Information by Intelligence Community (IC) Personnel and Naval Intelligence Security Policy Directive 17-008 Revision, Mandate for North Atlantic Treaty Organization (NATO) Information by Intelligence Community (IC) Personnel, all DoN Contractors with SCI access and access to JWICS or SIPRNet must be briefed into NATO Secret Information.

text: The purpose of this DD Form 254 is to provide security requirements for a future effort between Marine Corps Warfighting Laboratory and a contractor To Be Determined. This effort is still pending IRCCO review and is NOT VALID FOR ACTUAL CONTRACT PERFORMANCE.

a. The Special Security Office (SSO) MCIA is the Cognizant Security Authority (CSA) for this level of effort within the contract. The Contractor is responsible for implementing the provisions of the DoDM 5105.21, and its Navy Supplement, in support of this effort. Failure of the contractor to maintain and administer a security program, fully compliant with these added security requirements, constitutes grounds for termination for default. If, subsequent to the date of this contract, the security requirements under this contract are changed by the Government, as provided in this clause, and the security costs or time required for delivery under this contract are thereby increased or decreased, the contract price, delivery schedule, or both, and any other provision of this contract which may be affected, shall be subject to an equitable adjustment. Any equitable adjustment required by virtue of this clause shall be accomplished in the same manner as equitable adjustments negotiated under the Changes clause of this contract.

b. Whenever the contractor, in performance of the work under this contract, finds that the requirements of any of the clauses of the contract are in conflict with security instructions issued to the contractor, the contractor shall notify the Contracting Officer or his duly authorized representative for security matters. The Contracting Officer shall: (1) Modify or rescind such security requirements, or (2) issue to the contractor written instructions concerning compliance with the requirements of the clauses or provisions conflicting with such security requirements. Any waiver of compliance with the clauses or provisions of the contract issued by the Contracting Officer shall be in writing and approved by SSO MCIA in advance. In the event a conflict occurs between the various security manuals, the contractor will utilize the most restrictive guidance and immediately refer the matter to SSO MCIA.

Item 7. The Contractor must coordinate with the COR/COTR prior to subcontracting any portion of the classified effort involved in this contract. A separate DD Form 254 for the Subcontractor shall be prepared by the Prime Contractor and approved by the COR/COTR, Contracting Officer (initialing by block 7), and MCIA SSO (signing in block 13) prior to the Subcontractor performing classified work under this contract. The Contractor is expressly prohibited from representing Subcontract employees as Prime Contract employees for the purpose of obtaining security clearances and/or access to classified materials for these individuals.

Item 8. All classified work accomplished on this contract will be done so within accredited facilities as validated by the on-site Security Manager/FSO, SSO/CSSO.

Work up to the Secret level can be performed at the following locations:

Building 3255 Meyers Avenue, Quantico, VA 22134 TBD (Contractor Facility)

Work up to TS/SCI may be performed at the following accredited locations:

MCIA; 2033 Barnett Avenue, Quantico, VA 22134 MCCDC; MCIA Suite 124; 3300 Russell Road; Quantico, VA 22134

All Special Access Program Control Officer (SAPCO) work accomplished on this contract will be done so within accredited SAP facilities as validated by the on-site SAPCO Manager.

Item 10a. The Marine Corps Technical Point of Contact (TPOC) to the Contracting Officers Representative (COR) is responsible for identifying and designating the number of personnel requiring COMSEC access. The number will be limited to the minimum number necessary in the performance of this contract, and will be on a strict need-to-know basis.

Item 10e(1)

a. In the performance of this contract, access to Top Secret/Sensitive Compartmented Information (TS/SCI) material may be required. Access to TS/SCI material is strictly controlled. Contractors must be nominated, screened, hold the appropriate clearance eligibility, and be approved by the local Senior Intelligence Officer before being indoctrinated and granted access to SCI. Upon approval for access, each Contractor will receive an indoctrination briefing, complete a series of required training courses, and are responsible for reporting personal status changes and/or security incidents to the MCIA SSO.

b. Contractors cleared on an interim basis (eligibility) will not be eligible for access to SCI under this contract. Contractors specifically identified to perform duties requiring access to SCI must be eligible under the provisions of ICD 704 without exception, waiver or deviation, and adjudicated by the DoD Consolidated Adjudications Facility (DoD CAF).

c. Requests for SCI billets will originate from the contract program manager, routed through the government project officer, to the MCIA SSO (the format for such requests is provided under separate cover). Contractor personnel supporting this effort who require SCI access will be briefed by, and their personnel security records managed by the MCIA SSO. Individuals briefed by the SSO are required to report changes in personal status, as defined by DoDM 5105.21 to SSO MCIA as well as the Contractor SSO (CSSO).

d. All SCI will be handled in accordance with DoDM 5105.21 and in designated Government approved and certified SCI Facilities (SCIFs).

e. SCI will not be released to contractor employees without specific release approval of the originator of the material as outlined in governing directives; based on prior approval and certification of "need-to-know" by the designated Contractor.

f. In performance of this contract, the Contractor may require access to JWICS at the locations listed in item 8.

Item 10e(2). Contractor may require access to the Secret Internet Protocol Router Network (SIPRNet) (at the government activity). Although intelligence data is available on SIPRNet, and could be inadvertently accessed, there is no valid requirement for intelligence data at this time. Therefore, Contractors shall not intentionally access or download intelligence data from the SIPRNET. In the event, intelligence data is required, the COR or Project Lead/Officer will modify this requirement for submission to the MCIA SSO. A final U.S. Government clearance, at the appropriate level, is required prior to access to Intelligence information.

Item 10f. To execute this contract, additional security requirements in addition to DoD 5220.22-M will be required. The Contractor shall comply with the security provisions of these programs. Marking and/or classification guidance for material originated or generated under this contract will be provided through the Government Special Access Program Control Officer (SAPCO) under separate cover. Any material generated by the Contractor (including correspondence, drawings, models, mockups, photographs, schematics, progress, special and inspection reports, engineering notes, computations and training aids) shall be classified according to content. Guidance for classification shall be derived from the applicable Security Classification Guides, Government furnished equipment or data, or special instructions. Such material shall not contain Contractor logos or similar identifiers which identify the specific contractor or team members.

Item 10g. There is no valid requirement for access; however, inadvertent access may occur because NATO information is available on SIPRNet and JWICS. A final U.S. Government clearance, at the appropriate level, is required for access to NATO information.

Item 10j. This item refers to unclassified information that is exempt from automatic release under the Freedom of Information Act (FOIA). Such is formation shall be identified as “For Official Use Only” (FOUO) and will be handled in accordance with DoD 5200.01. Contractors handling unclassified but sensitive information will review, process, produce, and protect, destroy and store this information in accordance to applicable DoD/DoN and USMC instructions, regulations, policies and procedures.

Item 10k. SIPRNet and JWICS access is required. While accessing SIPRNet and JWICS, the Contractor is limited to information for which there is a need-to-know, and shall not access, download or, further disseminate any special access data (i.e. intelligence, NATO, COMSEC, etc.) outside the execution of the defined contract requirements and/or without the guidance and written permission of the COR. In the event that any special access is required, the COR must modify the contract requirements for issuance of a new modified DD Form 254. A final U.S. Secret clearance and access is the minimum level where access to the SIPRNet is required by a contract employee. A final U.S. Top Secret/SCI clearance and access is the minimum level where access to the JWICS is required by a contract employee. A NATO awareness brief is also required for all contractor employees where NATO access is not present in JPAS. SIPRNet/JWICS Request Forms and training requirements must also be met prior to gaining a SIPRNet/JWICS account. The Contractor’s Facility Security Officer is responsible for ensuring (as a requirement) that all JPAS visit requests are submitted to each organization where classified information will be discussed or accessed.

Item 11c. The Contractor requires access to classified source data up to and including the classification levels identified in item 1 in support of this work effort. Any extracts or use of such data requires the Contractor to apply derivative classification. Trained derivative classifiers will certify all classified documentation and attach an appropriate derivative classifier declaration to all finished documents in accordance with Executive Order 13526. Classifiers shall be trained and recertified every two years. Documentation generated as a result of this contract will be classified in accordance with source material provided by the user and will carry the most restrictive downgrading and/or declassification instructions, warning notices and control markings applicable. A listing of source material is to be included as a part of the document prepared by the contractor.

Item 11j. Operations Security (OPSEC) protection is required for classified and sensitive unclassified information (as defined in Public Law 100-236, 9 January 1988) developed or used in the performance of this contract. While performing aboard Navy/USMC installations, the Contractor shall comply with the provisions of OPNAVINST 3432.1 and the local Command 3070 instruction series for Operations Security; at all other sites the Contractor shall comply with local command and/or program OPSEC plans. OPSEC requirements are contained in National Security Decision Directive 298 dated 23 January 1988, DoD 5205.2 and OPNAVINST 3432.1.

Item 11l. In the performance of this contract, the Contractor may have a requirement to receive, store, and/or generate Controlled Unclassified Information (CUI). Such information will be handled and protected in accordance with DoDM 5200.01-V4 and may include application of access vetting, distribution controls, and protective measures. Contractors are prohibited from releasing CUI to the public without approval of the contracting activity. Identification of CUI may be accomplished through applicable Security Classification Guides, Critical Information Lists (CIL), or identified directly by the Government. It is the responsibility of the contractor to afford such information the proper protection.

Item 12. Regardless of classification level, the Government considers the existence of the access approval to be sensitive. Contractor personnel should discuss or disclose information regarding the contract only to individuals with need to know. It is a material condition of this contract that the contractor shall not use, or allow to be used, any aspect of this contact for publicity, advertisement, reference or any other public purposes without specific approval. This includes statements of "SCI work” in corporate marketing tools or personal resume's. The Contractor agrees not to use or allow to be used any aspect of this contract for publicity, advertisement, references or any other public purposes. It is further understood that this obligation shall not expire upon completion of this contract, but will continue until rescinded by the U.S. Government. The Contractor may request a waiver or release from the foregoing but shall not deviate there/from unless authorized to do so in writing by the Contracting Officer or CSA. Unless otherwise stated in this contract, the Contractor is not prohibited from identifying the existence of a Government contract pursuant to federal statute or regulations, e.g., Securities Exchange Commission filings, if consistent with security requirements. A copy of all such filings or disclosures shall be promptly forwarded to the Contracting Officer.

Item 13.

a. In the performance of this contract, access to Top Secret/Sensitive Compartmented Information (TS/SCI) material may be required. Access to TS/SCI material is strictly controlled. Contractors must be nominated, screened, hold the appropriate clearance eligibility, and be approved by the local Senior Intelligence Officer before being indoctrinated and granted access to SCI. Upon approval for access, each Contractor will receive an indoctrination briefing, complete a series of required training courses, and are responsible for reporting personal status changes and/or security incidents to the MCIA SSO.

b. Contractors cleared on an interim basis (eligibility) will not be eligible for access to SCI under this contract. Contractors specifically identified to perform duties requiring access to SCI must be eligible under the provisions of ICD 704 without exception, waiver or deviation, and adjudicated by the DoD Consolidated Adjudications Facility (DoD CAF).

c. The Contractor will notify the MCIA SSO when detection of possible or actual compromise of government related data occurs.

d. All Contractor personnel assigned to this contract shall possess security clearances issued by the DoD Consolidated Adjudication Facility (DoD CAF) commensurate with the level of required access to classified information that is directly in support of this contract. Contractors must be nominated, screened, hold the appropriate clearance eligibility, and approved by the local Senior Intelligence Officer before being granted access to classified material. Contractors granted access to classified information are required to comply with the "Personal Status Change" reporting criteria identified in the ICD 704, and report any personal status changes to the MCIA SSO.

e. MCIA SSO restricts access to only those individuals who possess the necessary security clearance and to those who are actually providing services under this contract. Further dissemination to other contractors, sub contractors, other government agencies, private individuals or organizations is prohibited unless authorized in writing by the releasing agency.

f. The Contractor will establish and maintain an access list of those employees working on this contract. A copy of this list will be furnished to the COR/COTR and MCIA SSO on a quarterly basis. The Contractor will advise the MCIA SSO through the COR/COTR immediately upon reassignment of personnel to other duties not associated with this contract.

g. Classified material will not be released to Contractor employees without a need-to-know identified in the performance work established in this contract. Release of classified information, documentation or other material concerning this contract will not be discussed with or released to any individual, subcontractor, agency (including Federal Government agencies and employees), and contractor employees not working on the contract without prior written approval from the COR/COTR. Further, classified material will not be released to foreign nationals or immigrant aliens, who may be employed by the contractor, regardless of the level of their security clearance or access authorization, except with the specific permission of the MCIA SSO.

h. All classified information developed under this contract, to include working papers, presentations, final reports, and other classified documents extracted from information provided to the Contractor, will be properly classified, controlled, protected, transmitted and accounted for in accordance with the provisions listed in item 14. Any classified information generated under this contract classified using derivative source material will retain the same classification and handling caveats as originally source information. Inquiries pertaining to classification guidance will be directed to the local Special Security Officer.

i. All classified material received, generated, fabricated, or modified by this contract remains the property of the U.S. Government agency or component originator. Upon completion or cancellation of the contract, all material will be returned to the direct custody of the supporting SSO, or destroyed in accordance with instructions outlined by this office.
