Ref Item 10.e.(1): Sensitive Compartmented Information (SCI). Air Force contracts that include requirements for access to SCI typically “carve out” the Defense Security Service and/or Air Force Information Protection Offices from oversight of the information as well as spaces where SCI is stored. The Defense Security Service will continue to serve as the Cognizant Security Office for the Facility Clearance and for on base performance, the servicing Information Protection Office will provide oversight of any collateral performance outside an SCI Facility but will provide no oversight of the space where SCI is stored to include any non-SCI material stored in the space (e.g. collateral classified material, CUI, etc.). Responsibility for oversight of SCI material and spaces resides with the cognizant Special Security Officer.
1. Requirements for access to SCI:
a) No public release of information authorized, public disclosure or confirmation of any subject related to the support contract is not authorized without first obtaining written approval from the CO.
b) Prior approval of contracting activity is required for subcontracting.
c) Access to Intelligence information requires SCI indoctrination and a final Top Secret U.S. Government clearance.
d) All SCI will be handled in accordance with special security requirements which will be furnished by the designated responsible special security office (SSO). Security Classification Guides or extracts are attached or will be provided under separate cover.
e) SCI will not be released to contractor employees without specific release approval of the originator of the material as outlined in governing directives; based on prior approval and certification of "need-to-know" by the designated contractor.
f) Contractors will not release this information to any activity or person not directly engaged in providing services under the contract or to another contractor (including subcontractors), government agency, private individual, or organization without written prior approval.
g) Intelligence material will not be released to foreign nationals or immigrant aliens who may be employed by the contractor, regardless of the level of their security clearance or access authorization, except with specific written permission.
2. The contractor will submit the request for SCI visit certifications .through the CM for approval of the visit. The certification request must arrive at the Contractor Support Element at least ten (10) working days prior to the visit. Visit certification requests will be processed through JCAVS.
a) Upon receipt of written approval from the CM, the company security officer will submit request(s) for special background investigations in accordance with the NISPOM, to the Intelligence Support Office. The entire personnel security questionnaire package should not be forwarded to the Intelligence Support Office. The Contractor Special Security Officer (CSSO) must follow the instructions provided by the Intelligence Support Office to the CSSO.
(1) Contractors will maintain records which will permit them to furnish, on demand, the names of individuals who have access to intelligence material in their custody.
(2) Names of contractor personnel requiring access to SCI will be submitted to the contract monitor (CM) for approval.
b) Inquiries pertaining to classification guidance on SCI will be directed through the CSSO to the responsible CM.
3. SCI furnished in support of this contract remains the property of the Department of Defense (DoD) department, agency, or command originator. Intelligence information does not become the property of the contractor and may be withdrawn at any time. Upon completion or cancellation of the contract, SCI furnished will be returned to the direct custody of the supporting SSO, or destroyed IAW instructions outlined by the CM.
a) SCI will be stored and maintained only in properly accredited facilities at the contractor location.
b) All intelligence material will bear a prohibition against reproduction while in the custody of the contractor.
c) Any reproduction and destruction of this material, regardless of the classification, is prohibited without written approval of the CM.
4. All DD Forms 254 prepared for subcontracts involving access to SCI under this contract must be forwarded to the CM for approval and then to HQ AF SSO, for review and concurrence prior to award of the subcontract.
5. The contract monitor (CM) will:
a) Review the SCI product for contract applicability and determine that the product is required by the contractor to complete contractual obligations. After the CM has reviewed the SCI product(s) for contract applicability and determined that the product is required by the contractor to complete obligations, the CM must request release from the originator through the Intelligence Division. Originator release authority is required on the product types below:
(1) Documents bearing the control markings of ORCON, PROPIN.
(2) GAMMA controlled documents.
(3) Any NSA/SPECIAL marked product.
(4) All categories as listed in USAF Intel 201-1.
b) Prepare or review contractor billet/access requests to insure satisfactory justification (need-to-know) and completeness of required information.
c) Approve and coordinate visits by contractor employees when such visits are conducted as part of the contract effort.
d) Maintain records of all SCI material provided to the contractor in support of the contract effort. By 15 January (annually), provide the contractor, for inventory purposes, with a complete list of all documents transferred by contract number, organizational control number, copy number, and document title.
e) Determine dissemination of SCI studies or materials originated or developed by the contractor.
f) Within 30 days after completion of the contract, provide written disposition instructions for all SCI material furnished to, or generated by, the contractor with an information copy to the supporting SSO.
g) Review and forward all contractor requests to process SCI electronically to the accrediting SSO for coordination through appropriate SCI channels.
6. Request for release of intelligence material to a contractor must be prepared by the contract monitor (CM) and submitted to the Intelligence Support Office. This should be accomplished as soon as possible after the contract has been awarded. The request will be prepared and accompanied with a letter explaining the requirement and copies of the DD Form 254 and Statement of Work.
Ref Item 10.e.(2):
1. Special Requirements of Intelligence Information: The contractor will require access to, and receipt, of classified intelligence documents in the performance of this contract. In addition to the requirements and controls for classified material in DoD 5220.22-M, National Industrial Security Program Operating Manual (NISPOM), the contractor shall adhere to the following requirements and controls of intelligence, per AFI 14-303 and applicable supplements.
2. Contact 844 CG Security Assistants, 1558 Alabama Avenue, Room 36, JB Andrews MD 20762, for permission to make extra copies of intelligence data required by the contractor if approval has not previously been stipulated above, or been stipulated in the release letter. The Contract Monitor (CM) then maintains accountability of copies and ensures all information is returned to the Air Force upon contract termination/expiration.
3. Maintain a record of all intelligence materials released to the contractor, and ensure all data is returned to the CM within two years after final delivery of goods and services or after completion or termination of the classified contract, whichever comes first. If retention is required beyond the two-year period, the contractor must request and receive written authority from the CM.
4. The contractor shall maintain accountability for all intelligence released in his/her custody. Contractors must agree that all intelligence data released to them, all reproductions, and all other material generated (including authorized reproductions) is the property of the US Government and will be returned upon request of the sponsoring agency or expiration date of the contract, whichever comes first.
5. Contractor shall not reproduce intelligence data without permission from the 844 CG Security Assistants through the CM. If approved, the contractor must control each copy in the same manner as the original.
6. Contractor shall not reproduce intelligence data without advance approval from the CM, except for working papers and derivative material produced in the publication process. Working papers and derivative material produced in the publication process do not need destruction approval.
7. Contractor shall restrict access to those individuals with a valid need-to-know who are actually providing services under the contract. Further dissemination to other contractors, subcontractors, other Government agencies, private individuals or other organizations is prohibited unless authorized in writing by the CM with prior approval of the 844 CG Security Assistants and Contracting Activity.
8. Contractor shall not release intelligence data to foreign nationals or immigrant aliens regardless of their security clearance or contract status without advance written permission from the CM, 844 CG Security Assistants, Foreign Disclosure Policy Office, and 316 WG/IP.
9. Contractor shall ensure that each employee having access to intelligence material is fully aware of the special security requirements for this material and maintain records in a manner that permits the contractor to furnish on demand the names of individuals who have access to the material in their custody.
Ref Item 10.f.: Ref Item 10.f.: 1. Special Access Information: Special Access Programs (SAP) imposes security requirements on the contractor that exceed the NISPOM. When SAP information is involved, the cognizant SAP security office is responsible for providing the contractor with the additional security requirements needed to ensure adequate protection of SAP information.
2. Discussion, storage, or processing of SAP information associated with this contract will be conducted in facilities specifically accredited by SAF/AAZ. SAP activities are governed by Revision 1 Department of Defense Overprint to the National Industrial Security Program Operating Manual Supplement, 1 APR 04, and applicable program security classification and procedures guides. Component-managed SAPFs and SAP Temporary Secure Working Areas (TSWA) are governed by ICD 705. Access to SAP information requires employees undergo additional personnel security screening and meet the SAP access standards delineated in the applicable DoD directives and policies. SAP inspections and security oversight while in component facilities are under the cognizance of SAF/AAZ, as appropriate. Additional SAP security requirements may apply at alternate locations/facilities based on service/component Command requirements. The CO for these locations/facilities will provide specific guidance as required. SAP inspections conducted at contractor facilities are under the security oversight of the Defense Security Service (DSS) unless officially relieved of their oversight responsibilities.
Ref Item 10.g.: Access to NATO information requires a final U.S. government clearance at the appropriate level and a NATO access briefing/debriefing.
Ref Item 10.j.: CUI The GCA is responsible for providing the contractor with the guidance necessary for the protection of the information. Refer to DoDI 5200.48, DAFI 16-1403, Controlled Unclassified Information.
Ref 10k. OTHER: NC2-ESI CAT "B" and "C" MOA between Secretary of the Air Force and Joint Staff on National Military Command Center Support & Responsibilities Air Force Executive Agent duties require the Air Force, 844CS as Execution Arm, to provide support for the NMCC in accordance with all referenced publications in the context of the NMCC's roles supporting the CJCS Nuclear Command and Control (NC2), the CJCS National and Nuclear Command, Control, and Communications (N2C3) mission and the National Military Command System (within the NMCC). The access is in connection with their duties supporting the NMCC, it is necessary they be given access to NC2-ESI category "B" and "C". Their duties require being in an area where NC2-ESI material is in use or being discussed. Physical access to the material is required.
Ref Item 11.j.: OPSEC All contractors, subcontractors, their employees, associates, and consultants who have access to critical information must comply with the Air Force-sponsored Operations Security (OPSEC) program.
OPSEC is a systematic means of identifying and protecting information which an adversary could use to their advantage or to our disadvantage. Critical Information (CI) is generally unclassified but sensitive information which has been identified by the OPSEC program as requiring protection.
OPSEC Measures (OM) are control standards with which all personnel must comply in order to protect critical information.
Responsibilities:
1. The 844 CG Security Assistants and/or OPSEC Coordinator must provide/approve OPSEC training curriculum for use by the contractor. Training must provide listings of critical information that must be protected by all personnel, listings of OPSEC measures, which must be used by all personnel to protect critical information, and current foreign intelligence and industrial espionage threats. The contractor must ensure all personnel working on the contract or having access to critical information attend initial and annually recurring refresher training and that the approved curriculum is presented. Training must be provided before personnel are allowed access to critical information. All personnel must comply with OPSEC standards and practices as trained. Additional training may be required based on updates to critical information, OPSEC measures, intelligence threat, or other fundamental changes to the OPSEC program.
2. The contractor must track OPSEC training statistics to include the personnel working on the contract, when each individual received the required OPSEC training, and when refresher training is due. Training statistics must be forwarded to 844 CG Security Assistants or OPSEC Coordinator at the end of each calendar quarter and upon request.
3. Prior to seeking approval through AFDW Public Affairs, any information to be released outside of official U.S. Government channels, via any media, must be approved through an OPSEC review by 844 CG OPSEC COORDINATOR Coordinator. All personnel must promptly report OPSEC related incidents, issues, and concerns to 844 CG Security Assistants and OPSEC Coordinator.
Ref Item 11.l.: CUI Protection - Refer to DoDM 5200.01, Volume 4 when considering specific requirements to be imposed on the contractor for the protection of CUI.
Ref Item 12.: Contractor is to submit requests through the Contracting Officer for OPSEC Program Manager review and public release authorization. The Contracting Officer will provide contractor with written approval/disapproval.
