SECTION C – PERFORMANCE WORK STATEMENT
Office of Wage Determinations Survey and Data Analytics Support Department of Labor (DOL) Wage Hour Division (WHD)
Performance Work Statement (PWS)
C.1 INTRODUCTION
The Department of Labor (DOL) Wage and Hour Division (the Division) directs and coordinates the determination of prevailing wage rates under the Davis-Bacon and related Acts and the Service Contract Act. This mandate involves a nationwide program of data collection, analysis, and research related to wage determination activities. Through its National and Regional Office network, and various contracts with agencies such as the Bureau of Labor Statistics and the U. S. Census Bureau, the Division develops data on prevailing wage rates for occupations in the construction and service industries for local areas across the country. In addition, the Division is responsible for administering some of the Nation’s most comprehensive labor laws, including the minimum wage, overtime, and child labor provisions of the Fair Labor Standards Act; the Family and Medical Leave Act; the Migrant and Seasonal Agricultural Worker Protection Act;
and worker protections provided in several Temporary visa programs.
C.2 OBJECTIVE:
The purpose of this Performance Work Statement (PWS) is to seek support in collecting reviewing, and initial analysis of data submitted in response to a Davis-Bacon (DB) construction wage rate data gathering effort.
C.3 SCOPE:
The Contractor shall review the electronic transferred construction project information from F.W. Dodge and make appropriate edits to the listed projects and contractors to conform to standard DB survey procedures. The contractor will also determine if additional clarification is needed on the submitted information and make those needed clarification contacts with contractors in accordance with DB requirements and survey procedures, The Contractor will also review submitted certified payrolls and determine peak week for every classification listed on the certified payroll, clarify any questionable data regarding the classification, work performed, or rate/fringe benefit, and then transfer this data into the Automated Survey Data System (ASDS). It is anticipated that the work involved with the wage data review will increase in conjunction with an increase in the annual number of State-wide Davis-Bacon wage rate surveys. To perform this work it will require the contractor to be able to understand and apply the requirements of Davis-Bacon Act to the survey. In addition this will require the contractor to have a strong working knowledge of the construction industry, i.e. types of construction; construction classifications and the work performed by those classifications; and methods of pay, rates of pay, and fringe benefits commonly paid in the construction industry.
C.4. PERFORMANCE WORK STATEMENT (PWS)
Under this PWS the Contractor will be expected to accomplish the needs of the WHD. Specific Contractor tasks are listed in Section IV.
C.5. PERFORMANCE WORK STATEMENT TASKS
javascript:__doPostBack('ctl00$ctl00$body$homebody$RecentDocuments$C$RecentDocumentsControl$RecentDocumentResults$ctl07$DocumentNumberLink','')
C.5.1 Task 1: Support the Wage and Hour Division’s Regional Office(s) when prevailing wage surveys are conducted.
1. In order to identify the universes of active construction projects for wage surveys, the Contractor shall develop and maintain a Master electronic repository or “Master Project File” (MPF), containing all F.W. Dodge construction project initiations which are estimated by the Contractor to be active each month during the past three years through the current month. The Contractor must be able to extract and analyze data from this repository of all construction projects (of a specified end-use type in a specified state or part thereof) estimated to be active during any monthly reference period during the past three years. The record for each project in this repository shall contain the DCP data for each project in addition to the estimated completion date.
2. The Contractor shall take steps to ensure that construction project and DB wage survey payment data contained in the ASDS are in accordance with DOL publications entitled Davis-Bacon Construction Wage Determinations Manual of Operations, Conducting Surveys for Davis-Bacon Construction Wage Determinations: Resource Book, as well as all other written procedures provided by the Government to the Contractor. The wage survey activities will involve clarifying wage payment and employment data submitted by construction contractors and interested parties. This clarification will require in depth knowledge of the construction industry, the different types of construction, construction classifications and the work performed by those classifications, and rates and benefits commonly paid by that industry. The Contractor shall perform these ASDS data correcting and clarifying activities for the geographic areas and for the types of construction specified by the Government. The Contractor shall perform these ASDS data clarifying activities in accordance with the Government’s priorities.
3. The Contractor shall conduct review of highway construction certified payrolls from State Department of Transportation for each project and each contractor. All data should be reviewed and entered into ASDS. Once complete, the contractor will review and alert the region that the data is available.
4. The Contractor shall also determine from information supplied by the Regional Office(s) which contractors should be selected for onsite visits by a CPA firm in accordance with established guidelines and modify the selection criteria as required by the Government.
C.5.2 Task 2: Facilitate Identification of Sample Survey and Wage Survey Universes
1. Facilitate, analyze, identify and generate sample survey and wage survey universes of active construction projects.
Generate the universe of active construction projects in the Master Project File (MPF) specified by the Wage-Hour Regional Offices (ROs). RO’s will furnish the Contractor with the following information with respect to the wage surveys that the ROs will conduct: The geographical area(s), the construction types, and the probable reference periods.
2. Facilitate the ordering of Dodge Reports for the area to be surveyed from F.W. Dodge. Coordinate the requests for and delivery of Dodge Reports and maintain a log to record all requests to F.W. Dodge. The number of Dodge Reports to be ordered by the Contractor will vary between 25,000 and 50,000 depending upon the size and number of surveys conducted.
C.5.3 Task 3: Develop Regional Survey Planning Reports (RSPR) Including Specialized Reports
1. The Contractor shall develop, provide and maintain a comprehensive reporting package that identifies and targets construction industry trends, rates, and locations of all existing and future construction activity.
javascript:__doPostBack('ctl00$ctl00$body$homebody$RecentDocuments$C$RecentDocumentsControl$RecentDocumentResults$ctl07$DocumentNumberLink','')
a. Develop and maintain a comprehensive “Regional Survey Planning Reports” (RSPR) packet. This packet should be created by using a range of analytical practices and should include geostatistical and quantitative data measurements to understand, predict, inform, and enhance the survey process and aid in the targeting of construction activity.
C.5.4 Task 4: Conduct self-directed Construction Industry Research and Economic Analysis
1. The contractor shall conduct self-directed construction industry and economic research, developing and anticipating construction trends to support and advise WHD with information on construction activity nationwide.
a. Provide expert level guidance and analysis of construction industry by conducting, developing and testing different survey strategies in an effort to maximize survey participation, and locate more precisely where construction occurs and/or will take place in the future.
C.5.5 Task 5: Conduct Sample Surveys to Determine Need for Comprehensive Surveys
1. Following sound statistical procedures, the Contractor shall conduct proportional stratified sample surveys in counties assigned by the Government and compute estimates of the ratio of collective bargaining agreement construction activity to total construction activity, at the 90% and 95% confidence intervals of the estimates. These Special Assessment (SA) surveys shall be conducted by telephone with intensive follow-up effort when necessary.
The SA surveys shall involve contacts with construction contractors or owners and obtaining information about coverage of onsite employees by collective bargaining agreements.
C.5.6 Task 6: Provide Copies of All Computer Programs Developed or Modified Under This Contract
1. The Contractor shall furnish the COTR with copies of all computer programs, and data collections created, developed or modified under this contract.
