JUSTIFICATION AND APPROVAL (J&A)

JUSTIFICATION AND APPROVAL FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Contracting Activity: Naval Medical Logistics Command (NMLC), Acquisition and Analytics Directorate, Code 05, 693 Neiman Street, Fort Detrick, MD 21702, acquiring on behalf of the requesting agency, Naval Ophthalmic Support and Training Activity (NOSTRA).

2. Description of the Action Being Approved. The proposed action is the award of a contract on a sole source basis to provide for services to provide virtualization of the Defense Optical Fabrication Enterprise Management System (DOFEMS). System. The Government intends on awarding a Firm, Fixed-Price (FFP) contract to Optical Lab Software Solutions, Inc. (OLSS) 13511 N Stemmons Freeway Dallas TX, 75234.

3. Description of Supplies/Services.

Current configuration of the system is two physical servers, one primary production and one Continuity of Operations (COOP) with two additional copies of those servers mirrored and maintained on Government Furnished Equipment (GFE) virtual machine servers in the Infrastructure Test Center (ITC) at Joint Base San Antonio, TX, acting as test servers for pre-production maintenance of the overall system functionality and cyber security requirements. This requirement requires services to design and build new virtual servers as identified below.

The Defense Health Agency (DHA) oversees and manages all Datacenter hosting facilities for the Military Health System (MHS). Overarching plans by DHA to migrate all MHS systems to the MilCloud will drive the re-architecture of DOFEMS to a virtual design as to standardize with all systems maintained on MilCloud. Any continuance in its current configuration would be short lived due to forecasted downsizing and closure of much of DHA’s current enclave infrastructure in favor of MilCloud usage. DHA has directed this new configuration be completed and deployed by end of calendar year 2021.

Virtualization of the DOFEMS system requires architecture and development services to separatethe logical components of the system into pieces that can be built and scaled independently as needs change over time and maintained in a standardized format to meet DHA sustainment requirements mandated for hosting in MilCloud 2.0.

Secondarily these logical components will be duplicated at the COOP location to provide failover redundancy to the Production environment and again in the datacenter test environment for pre-production testing prior to upgrading the Production environment and test modeling of SRTS upgrades and communications. A total of 6 virtual machine (VM) requirements are needed to be configured. Configuration of the system is as follows: 6 VM’s to accommodate out year sustainment in the DHA MilCloud Data Centers, 2 production VM’s, 2 COOP VM’s, and 2 Production Test VM’s.

4. Statutory Authority Permitting Other Than Full and Open Competition.

The statutory exception permitting other than full and open competition for this acquisition is 41 U.S.C. 1901. See also FAR 13.501(a) Sole source (including brand name) acquisitions.

5. Rationale Justifying Use of Cited Statutory Authority.

Thorough market research was conducted by technical experts in June-July 2021 and it was found that OLSS was the only source identified that could provide the required upgrades to the existing DOFEMS system. Search engines utilized included Google, Federal Business Opportunities (FBO), General Services Administration (GSA) Advantage, and Federal Procurement Data System (FPDS-NG). There were other companies that provide optical fabrication however, there are no distributers of the DOFEMS system. It would not be in the Government’s best

J&A#: 21-00034 interest to re-procure the system competitively when the current system is brand new. The system has received Authority to Operate (ATO) on DoD Networks by completing Risk Management Framework (RMF) and being fully deployed. The ATO for DOFEMS was renewed on 23 June 2021 and it included the virtual environment. Their ATO now supports this configuration. A replacement for the current system would entail contracting for a new system, completing the RMF process again for the new system and eventually achieving an ATO for the new system at an exceptional cost of time and monies (if funding was available) as well as the possibility of mission degradation to this Readiness function to DoD while replacing the system and maintaining an ATO.

Given the proprietary nature of the software and the operating system, OLSS is the only vendor with rights to change the software code and the necessary knowledge, experience and staff to maintain the current system. No sources other than the manufacturer can satisfy this need given the proprietary nature of the system and the transition period that would be required to implement the new system while also training new users.

which may cause potential unnecessary delays providing patient care and negatively impact the Navy’s mission readiness. Based on historical knowledge of the RMF process no other contractor is capable of completing this process and obtaining approval sooner than

OLSS.

OLSS is the only source capable of providing the necessary system design changes in the timeframe required.

For the reasons noted above, NMLC intends to issue a sole source award to OLSS to ensure that NOSTRA is able to maintain its mission. This action will result in one Firm-Fixed Price (FFP) contract to design and change from physical servers to

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

Market research was performed, the results of which are in paragraph 5. A notice of intent was posted to Sam.gov on 07 July 2021, with a response date of 22 July 2021. No responses or potential interest was received by the due date. The combined synopsis/solicitation will be posted to Sam.gov in accordance with FAR 5.202.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

Future requirements will be synopsized in accordance with FAR 5.203. For the reasons set forth in Paragraph 5, Naval Medical Logistics Command has no plans at this time to compete future contacts for the types of supplies/services covered by this document. If another potential source emerges, NMLC will assess whether competition for future requirements is feasible.
