# SECTION SECTION NUMBER QUESTIONS ANSWERS

1 General What is the historical annual turnover rate for the Districts in Circuits 1, 5 & 8? Approximately 8% turnover rate.

2 General Can the Government provide a list of how many, if any, vacant positions there are in each district and their locations?

Subject to change, cannot provide. See answer to question 1.

3 General Is guard mount included in the 1910 post hours?

As per Section C.3.1.1, "The COR will provide the contractor with post orders for each post assignment."

CSO labor hours are provided for the staffing of all posts as required. The contractor must staff all posts within the allotted hours. In consultation with the COR, the contractor may adjust schedules to ensure full coverage. The standards by which positions are allocated take into consideration the need for relief and breaks.

4 General If guard mount is NOT included in the 1910 post hours, are these costly staffing considerations to be worked into our rate build up?

See answer to question 3.

5 General Please clarify if drug testing is required and the frequency for this testing.

Drug screening is not one of the medical requirements in the CSO SOW. See contract clause FAR 52.223-6

Drug Free Workplace. Under this clause, the cost of compliance is the contractor's responsibility. Also, note that CSOs must comply with Sections C.14.2.3, C.14.2.4, C.14.2.31, and, C14.2.32 (performance standards regarding the use of controlled substances, including prescription medications, and, alcohol.)

6 General Are gun safes government provided? Yes.

7 General Are clearing barrels Government provided or are they required to be provided by the contractor?

These are provided by the Government.

H

B.7 CLIN #2

H.13

Section B.7 identifies CLIN 2 Start Up Cost as a Firm-fixed Price. However, Section H.13 indicates that "The Government will only be liable for start-up costs incurred by the Contractor." Will the Government please confirm whether start-up costs are a fixed price or if the Government is only reimbursing actual start-up costs?

CLIN #2 Start-Up rate is Firm Fixed-Price per CSO and is broken down by element. See section G.7(g) CSO

Start-Up Cost; each element of start-up shall be invoiced separately. See section H.13 Liability for Start-Up

Costs, the government will only be liable for start-up costs incurred by the Contractor. If Start-Up Costs are incurred by the contractor and the element supply/service was received and accepted by the Government, the Government is liable for the Start-Up element's fixed price.

9 B B.7 B.7 states that CLIN 2 is a firm fixed rate. Will CLIN 2 be a firm fixed per person rate or will it be reimbursed at actual start-up costs?

See answer to question 8.

10 B B.7

Please clarify how CLIN 2 be invoiced: If one site has range fees of $50 per person and another has $10, and the Offeror therefore bids an average of $30 per person, will the Contractor bill $30 per person no matter what the cost or will the offeror bid actual costs for each officer?

See answer to question 8.

11 B B.7

Please clarify how CLIN 2 be invoiced: If one site has range fees of $50 per person and another has no cost, and the Offeror therefore bids an average of

$25 per person, will the Contractor bill $25 per person no matter what the cost or will the offeror bid actual costs for each officer? Would the Contractor be limited to $25 per person at the first site even though the costs are $50 since they only bid $25?

See answer to question 8.

12 B B.7

Please clarify how CLIN 2 be invoiced: As an example, assume that startup training costs include no cost for range fees but include a cost of $25 for instructors and $10 for mileage reimbursement so the Offeror bids $35 per person. Will the Contractor be able to bill $35 for the CSO training even if there are no range fees since the government does not ask for a separate price for range fees vs other training expenses?

See answer to question 8.

# SECTION SECTION NUMBER QUESTIONS ANSWERS

13 B B.7

If CLIN 2 is not a fixed price CLIN but will be reimbursed at actual cost, what backup information will be required for each line item, including training components such as range fees, instructor and travel costs? If reimbursed at actual costs with receipts for each item, can Offerors include a handling fee or

G&A/profit in their cost to cover the considerable cost of providing this documentation?

See answer to question 8; elements of Start-up are fixed price. As per section G.7(g.2), CSO Start-Up Costs, Payment will only be made after receipt of a proper invoice submitted with a copy of the MAR report certifying the invoiced supply or service has been received and accepted in the same month for which the invoice is being submitted.

14 B B.7

If CLIN 2 is a reimbursable at actual cost, would the government consider making this a NTE CLIN with Offerors providing their markup only? No.

B

J

B.7 CLIN #4 ;

Attach J-1(D)

Attach J-1(E)

Attach J-1(F)

Attach J-1(G)

Section B.7, CLIN #4 provides for CSO Reimbursable Travel. In reviewing

Attachments J-1(D), J-1(E), J-1(F), and J-1(G) regarding pricing, there does not appear to be a place to propose travel.

1. Will the Government be providing a NTE value for CSO Reimbursable Travel?

2. If a NTE Value for CSO Reimbursable Travel will not be provided, will the

Government please provide work load indicators in regards to the amount of travel required and provide guidance as to where the travel costs should be captured on the price attachments?

There is not a NTE threshold for travel. Travel is reimbursable, see section G.7(d), Invoicing for CSO Travel.

CSO Travel should not be captured in the price attachments.

16 B B.7 CLIN #6

CLIN #6 under Section B.7 of the solicitation is for SSO Uniforms; however, it appears that the CSOs and DSs are not authorized to wear those uniforms.

Should CLIN #6 be removed from this effort?

At this time there is no Special Security Officer requirement; however, this language will remain.

17 C C.3.2.3

Relevant section language provides, "The Contractor shall provide an LCSO at each court facility stated in Section B of this contract. For facilities designated to operate on a "24-hour" basis, the Contractor shall provide at least three (3)

LCSO's, one per shift." Question: Is the requirement to staff a LCSO 24 hours, 7 days a week? Or is the requirement to staff a LCSO 24 hours a day, 5 days a week (Monday-Friday)?

See section C.3.2, Lead Court Security Officers (LCSOs), at a facility designed to operate on a "24-hour" basis, an LCSO is required for each shift (day, 2nd, and night) defined as not to exceed the allocated hours on task order (typically 40 hours a week.) The specific days the LCSO is scheduled is at the discretion of the contractor and in consultation with the COR; however, LCSO hours shall not exceed the allocated hours.

C

J

C.3.3

Attach J.1(D)

Attach J.1(E)

Section C.3.3 discusses Lead Special Security Officers and Special Security

Officers. In reviewing the price spreadsheets it does not appear that there is a requirement for these services.

Will the Government confirm that the Lead Special Security Officers and the

Special Security Officers are not required for this effort?

At this time there is no Special Security Officer requirement; however, this language will remain.

19 C C.3.4 Are all of the District Supervisors presently provided office space within a courthouse?

If the Government requires a DS to keep an office at a specific facility on a regular basis, space will be provided.

20 C C.3.4 Are all of the Contract Managers presently provided office space within a courthouse?

No.

C

J

C.3.5

Attach J.1(D)

Attach J.1(E)

Attach J.1(F)

Attach J.1(G)

Section C.3.5 of the SOW provides the requirements for a Contract Manager.

The requirements state that each Circuit specified under the contract shall have a fully dedicated Contract Manager. In reviewing Attachments J-1(D), J-1(E), J-

1(F), and J-1(G) regarding pricing, there does not appear to be a place to include the price for the Contract Manager.

Will the Government clarify where offerors should include the cost of the

Contract Manager in their proposed pricing?

See section L.5.3.1(1.iv) Pricing Instructions, Hourly Rate Computation, the cost of the Contract Manager is considered an Other Direct Cost (ODC.) Refer to FAR Clause 52.222-43 for allowable costs.

22 C C.9.3 How many CSOs are not working under the current contract pending additional medical review by FOH?

Subject to change, cannot provide.

# SECTION SECTION NUMBER QUESTIONS ANSWERS

23 C C.9.3.1

Relevant section language provides, "The Completed CSO-229, including all supporting medical information, should be included in the Applicant package and sent to the USMS Occupational Health Nurse…" Question: Are SSO assigned to programs covered by Inter-Agency Agreements, such as USAO, applications and CSO-229 forms sent to the USMS Occupational Health Nurse or to another organization?

At this time there is no Special Security Officer requirement; however, this language will remain.

C

J

C.9.4.1

Attach J.2(B)

Relevant section language provides, "After the CSO successfully completes the initial examination and qualification process, the Contractor shall require the

CSO to complete and pass a biennial medical examination…" However, Attachment 2(B), CSO Form -004 , 3rd Paragraph, provides in relevant part, "....These qualifications include successful completion of an initial and yearly medical examination;...." Please clarify which contract section is correct and if the CSO Form 004 will be updated.

A revised CSO Form-004, Attachment 2(B), reflecting biennial medical examination will be provided to the winning contractor(s) at post-award.

C

J

C.9.4.1

Attach J.1(F)

C.9.4.1 states "CSOs with an even birth year are to complete and pass medical examination during even contract performance years. CSOs with an odd birth year are to complete and pass medical examination during odd contract performance years.” Question/Request for Clarification: Please provide guidance on how this should be priced on Section J Attachment 1(F) Start-Up

Cost as Attachment 1(F) requires a per person price.

Offeror shall submit a proposed Fixed-Price for CSO medical exam, which is an element of CLIN #2, Start-

up. CLIN #2 Start-Up rate is Firm Fixed-Price per CSO and is broken down by element. See section G.7(g)

CSO Start-Up Cost; each element of start-up shall be invoiced separately. See section H.13 Liability for

Start-Up Costs, the government will only be liable for start-up costs incurred by the Contractor. If Start-Up

Costs are incurred by the contractor and the element supply/service was received and accepted by the

Government, the Government is liable for the Start-Up element's fixed price.

26 C C.12.1.2

As clarification, regarding weapons qualifications for applicants. The sentence

"Contractor shall re-qualify the individual annually." Does this mean 12 months or less from the initial date of requalification or within the annual training year?

Annual Weapons qualification will occur within 12 months of initial qualification or most recent qualification. All forms shall be submitted to the COR no later than December 31 of each calendar year of the contract period, see Section J, Attachment 2(I), Form CSO-014.

C

J

C.12.1.2

Attach J.2(I)

Relevant section language provides, "…After an individual has successfully completed initial qualification (weapon); the Contractor shall requalify the individual annually." However, Attachment 2(I), CSO Form-014, provides in relevant part, "…Form CSO-014 should be completed by the contractor's authorized district contacting officer's representative by December 31 of each contact period, or as required for new hires." Question: By reading the CSO

Form-014 language, it appears the Government is requiring each CSO to qualify annually between the start of the contract period (i.e. October 1 each year) and

December 31 each year. Is this this intent by the Government? Or, is the intent to have each CSO qualify annually within 12 months of the last successfully qualification?

See answer to question 26.

28 C C.12.2.1

Relevant section language provides, "The U.S. Marshal may authorize CSOs assigned to their District to carry Oleoresin Capsicum Aerosol (OC Spray) device…The training is provided by the USMS and is generally an eight (8) hour course, although there may be some variations by District." Questions: Which

Districts within the 1st, 5th, and 8th Judiciary Circuits are authorized by the U.S.

Marshal to carry OC Spray devices? Is the training associated with the OC Spray devices billable to the Government?

Districts RI, ME, S/IA are authorized to carry OC Spray. The OC Spray training will be provided by the government and the training itself is not billable; however, as per section B.7 CLIN #1, all training hours are billable at the Basic Rate.

# SECTION SECTION NUMBER QUESTIONS ANSWERS

29 C C.12.5.2

C.12.5.2 provides, "Annual Training does not have to be completed in a continuous 16 hour period." Questions: If the Contractor elects to provide the annual training throughout the year, which date should recorded on the MAR for the Annual Training? Should the Annual Training Examination date serve as the official training date and be recorded on the MAR? Will the Government allow the hours to be billed for annual training as they are incurred (Example: 4 hours given to all CSOs in January. Will the Contractor be able to invoice those 4 billable hours on the January services invoice)?

The date all requirements of Annual Training are certified as complete will be recorded on the MAR.

30 C C.16.2 Are Lead Court Security Officers and Rovers able to provide break relief, as part of their normal duties?

As per Section C.3.2, Lead Court Security Officers (LCSO), LCSOs are full-time working CSOs and can stand any post at any time during their shift. As per Section C.3.1.1, "The COR will provide the contractor with post orders for each post assignment." A rover (See C.3.1.1.1 Roving Patrol) is a post and therefore should not be used as relief for other posts as part of their regular duties.

31 C C.16.2 If relief is NOT included in the 1910 post hours, are these costly staffing considerations to be worked into our rate build up?

CSO labor hours are provided for the staffing of all posts as required. As per Section C.16.1.1-C.16.1.2, the contractor must staff all posts within the allotted hours. In consultation with the COR, the contractor may adjust schedules to ensure full coverage. The standards by which positions are allocated take into consideration the need for relief and breaks.

32 C C.16.2.1

Section C.16.2.1 states, "The Contractor shall provide adequate relief and continuous coverage for all post assignments as determined by the individual task order(s)." Question/Request for Clarification: Is relief included in the 1910 post hours? If not, how is the Contractor to provide relief personnel?

See answer to question 31.

33 C C.19

Section C.2 provides, "The Contractor shall provide all necessary personnel…, materials, supplies.. and clothing provided by the Government (see Section C.19

Government Furnished Property)." Section C.19 provides a table listing GFP items. Section C.19.7 provides that the Government will issue firearms. Section

C.19.8 provides that the Government will issue OC Spray. Section C.19.9 states that the Contractor shall provide Soft Body Armor Kits. The RFP is thus not clear as to which GFP the Contractor is responsible for purchasing. Question A:

Please specifically provide which GFP items the Contractor is responsible for purchasing. Question B: Please clarify by GFP item, which items should be incorporated in the Basic Hourly Rates under CLIN # 1 and which items should be incorporated in the Startup price under CLIN #2.

CSO Uniforms and Soft Body Armor are reimbursed by the Government under contract CLIN #2 and CLIN

#5; as such they become Government Furnished Property (GFP.) The contractor shall incorporate CSO

Uniforms as an element of CLIN #2 (Start-Up) and incorporate Soft Body Armor under CLIN #5. The

Government will reimburse the contractor under respective CLINs. See sections B.7, Contract Line Item

Numbers, and L.5.3.1, Pricing Instructions. All GFP transitions from the incumbent to the successor contractor. All other GFP listed in C.19 is purchased by the Government and provided to the Contractor.

34 C C.19.1

Section C.19.1 states the Government will provide Soft Body Armor Kits and

Standard Uniform Clothing; however, there are separate pricing sheets for the

Contractor to propose these items.

Will the Government confirm if offerors should include the price for the Soft

Body Armor Kits and the Standard Uniforms in their proposed price?

The offeror shall provide Standard Uniform pricing using attachment J.1(F), Table for Start Up Costs; and

Soft Body Armor Kit pricing using attachment J.1(G), Table for Soft Body Armor Kits.

# SECTION SECTION NUMBER QUESTIONS ANSWERS

35 C C.25.4

Section C.25.4 of the SOW states that records shall be maintained at the

Contractor’s Headquarters Office.

Will the Government clarify if records should be maintained as hard copies or electronic files?

It is at the discretion of the contractor to make the determination to maintain records at the headquarters in hard or soft copy form; however, as per Section C.13.6.1 CSO Records, the records must be readily available and efficiently provided when requested by the Government. The Government sets out requirements regarding electronic record keeping in FAR Subpart 4.700 Contractor Records Retention and

FAR Clause 52.224-1 Privacy Act Notification and 52.224-2 Privacy Act.

36 G G.7(d)

District Supervisors are not authorized reimbursable travel under CLIN #4, CSO

Reimbursable Travel. Is DS site visit travel billable under any other CLIN? No.

37 J J.1(A) General

In regards to Collective Bargaining Agreements that do not expire until several years into the period of performance for the upcoming contract, for pricing purposes shall the hourly rates of CBA staff reflect only the initial period of performance of this contract?

For pricing purposes, use the CBA hourly rate for the initial year and then use the applicable CBA rates for the applicable option years. Upon award, the terms and conditions of the CBA will be in effect until the date of expiration.

38 J J.1(A) General

Most of the CBAs provide a premium for CSOs when they are acting in an instructor capacity. Question/Request for Clarification: a) How many General

Training Instructors and Weapons Qualification Instructors are there within the guard force at each site? b) If unknown, are there instructors in the guard force at each of the sites?

The number and location of instructors is at the discretion of the contractor and is unknown to the

Government. If a CSO is acting in the capacity of an instructor, this is not considered billable under the contract CLINS.

39 J J.1(A) 1st Circuit Can you please identify the locations/buildings and number of post that would require the CSOs to work the control room for pricing purposes.

As per section B.7, the proposed CLIN #1, Basic Rate, for CSO labor hours is fixed regardless of post. See answer to question 56 for clarification on Puerto Rico control rooms.

40 J J.1(A) 1st Circuit (D69

Puerto Rico)

CBA last dated 10/1/2009. Question/Request for Clarification: Is this the most current CBA?

Yes.

41 J J.1(A) 1st Circuit (D69

Puerto Rico)

In the Puerto Rico CBA there are numerous references to a Lead CSO. There are

7 LCSOs. We cannot find any kind of premium in the CBA for LCSOs.

Question/Request for Clarification: Is this correct?

Yes.

42 J J.1(A) 5th Circuit

After review of the CBAs for the 5th Circuit, it appears that all CBAs with the exception of SMS Jackson expire prior to the start date of this effort.

Will the Government confirm that each CBA will be in full force and effect on the new effort?

For price evaluation purposes, use the provided CBAs rate for the initial period of performance for the base and option year pricing. Upon award, the terms and conditions of the CBAs will be in effect until the date of expiration. Upon expiration the successful offeror will negotiate CBAs with the appropriate parties.

43 J J.1(A) 5th Circuit

The cover letter provided with select CBAs states that negotiations are still on-going between Akal and the union. It further states that if an agreement is not reached, the applicable SCA wage determinations will be in effect on 10/1/15.

The CBAs in question are NMS Oxford Independent, SMS Hattiesburg and

Natchez, WTX Midland, and WTX Pecos.

1. Will the Government provide clarification as to whether or not CBAs between

Akal and the unions have been ratified?

2. If no CBAs have been ratified between Akal and the Union, should offerors propose wages and benefits in accordance with the applicable wage determinations?

3. If SCA Wage determinations are to be used, will the Government incorporate the applicable WDs into the solicitation?

At present the attached CBAs are the most recent. For price evaluation purposes, use the provided CBAs rate for the initial period of performance for the base and option year pricing . See answer to question 42.

# SECTION SECTION NUMBER QUESTIONS ANSWERS

44 J J.1(A) 5th Circuit (D42

Northern Mississippi)

It appears that 2 CBAs were provided that both cover the Northern Mississippi area. They are NMS CSOs of NMS (between Akal and Court Security Officers of

Northern Mississippi) and NMS Oxford Independent (between Inter-Con

Security Systems and Court Security Officers of the District of N. Mississippi).

1. Will the Government clarify if the Akal CBA (NMS CSOs of NMS) should replace the Inter-Con Security Systems CBA (NMS Oxford Independent)?

2. If the Inter-Con Security Systems CBA (NMS Oxford Independent) is no longer applicable, will the Government remove it from the solicitation?

Both individual CBAs are presently applicable to sites within N/MS. CBA "05 NMS (CSOs of NMS) CBA

FY2015" is applicable for the Greenville site C and the Aberdeen sites D and G. CBA "05 NMS Oxford

Independent CBA FY2015" is applicable for the Oxford site A.

45 J J.1(A) 5th Circuit (D42

Northern Mississippi)

It appears that 2 copies of the NMS Oxford Independent CBA were included with the solicitation.

Will the Government confirm that a second copy was included in error and remove it from the attachment?

See answer to question 44.

46 J J.1(A) 5th Circuit (D80

Western Texas)

It appears that 2 CBAs were included for West Texas that are duplicates of each other. They are WTX Midland and WTX Pecos.

1. Will the Government confirm that the WTX Midland and WTX Pecos CBAs are duplicates?

2. If the WTX Midland and WTX Pecos CBAs are duplicates will the Government remove one from the solicitation?

The two CBAs are intended to be two distinct agreements applicable to the individual site. CBA "05 WTX

Midland Independent Union CBA FY2015" is applicable for the Midland site E. CBA "05 WTX Pescos

Independent Union CBA FY2015" is applicable for the Pecos site AC. CBA "05 WTX UGSOA 85 CBA FY2015" is applicable for the remaining sites for W/TX (San Antonio site A, Waco site G, San Antonio site I, Austin site L, Del Rio site V, Alpine site AO, El Paso site AR, and Austin AV.)

47 J J.1(A) 5th Circuit (D80

Western Texas)

It appears that a number of the locations covered by the WTX Midland and WTX

Pecos CBAs are also covered in the WTX CBA between Akal and the UGSOA.

Will the Government confirm that the WTX CBA between Akal and the UGSOA supersedes the WTX Midland and WTX Pecos CBAs for the Alpine, Austin, Del

Rio, El Paso, San Antonio and Waco, TX areas?

See answer to question 46.

48 J J.1(A) 8th Circuit (D10

Western Arkansas)

Within the CBA for D10-W.AR – Western Arkansas, there is a job site in

Texarkana but the town is not listed in the CBA. Question/Request for

Clarification: Is the D10 CBA to be used for Texarkana or are we to use the

Federal Wage Determination?

The CBA for W/AR applies to all sites within the District.

49 J J.1(A) 8th Circuit (D10

Western Arkansas)

None of the CBAs provided reference Texarkana. Please provide a copy of the

CBA that covers Texarkana if missing, or provide an explanation (e.g. has

Texarkana been incorporated into another CBA, and if so, which one?).

See answer to question 48.

50 J J.1(A) 8th Circuit (D30

Southern Iowa)

The PDF title of the CBA is: “08 SIA Davenport UGSOA 152 CBA FY2015.” The title implies the CBA only covers Davenport, IA but in Section 1.2-Bargaining Unit the

CBA language is generic and does not specific cities covered by this CBA. Are both Davenport and Des Moines, IA covered by this CBA or some other CBA or

Association Agreement?

"08 SIA Davenport UGSOA 152 CBA FY2015" only applies to Site C Davenport. The CBA for Des Moines sites

A and E was omitted in error from the original solicitation and has been included in A001 titled "08 SIA Des

Moines UGSOA 161 FY2015".
