5. Determination that proposed Contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:

The facility in Manchester, NH currently houses 15 male and female federal offenders. The current contract will expire September 30, 2019.

The replacement solicitation, Request for Proposals (RFP) 15BRRC18R00000123 located within the city limits of Manchester, NH, was issued on January 19, 2018. The solicitation required services in accordance with the Residential Reentry Center Statement of Work (SOW) dated April 2019.

This need for services is a direct result of the length of time required to complete evaluations of the proposals and the time allowed after the estimated date of award (120 days) for the contractor to ensure its’ proposed facility is fully operational.

This contract will allow for continuity of services while a replacement contract is awarded, which is currently in the evaluation phase, and the contractor prepares the facility for operational availability. The current solicitation is in the final proposal stage and this time period will allow for the award of a new contract and provide flexibility on these dates to account for any unforeseen delays in award.

From a technical standpoint, Community Resources for Justice, Inc., is currently providing the services required by the Bureau.

The closest facility with a contract with the Bureau will not have available bed space. The Residential Reentry Manager’s office and RRMB have determined that Community Resources for Justice can provide the required services at the required quantity within Manchester, NH, by the performance start date of April 1, 2020.

The Contracting Officer has reviewed all of the documentation and agrees. Community Resources for Justice is able to continue providing services without risk to the community and to the Bureau by April 1, 2020.

The services required are of an unusual and compelling urgency due to the Bureau’s essential need. There is only one contract for RRC/HC services for federal offenders located within Manchester, NH. If services cannot be provided at this location, the Bureau has two options: transfer offenders to another RRC/HC to continue receiving services or return the offenders to a secure institution.

The closest facilities under contract with the Bureau are Portland, ME; Boston, MA; Waterbury, CT; Wilmington, DE. Those facilities will not have available bed space to house the projected number of 15 additional offenders.

The mission of the reentry program is to assist federal offenders
