Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID: 36C250-21-AP-0218
1. Contracting Activity:
Network Contracting Office (NCO) 10 260 East University Avenue Cincinnati, Ohio 45219-2637 513-559-3705 Station Code: 36C250 Purchase Request: 552-21-1-422-0001
2. Brief Description of Supplies/ Services required and the intended use/Estimated
Amount:
Covid-19 Pandemic caused a severe service interruption in access to sleep apnea testing on site at the Dayton VAMC. As a result, a new short-term requirement utilizing portable sleep studies via WatchPat One devices was procured on 6/30/2020 under contract 36C25020P1413. However, the current contract has no funding remaining, additionally COVID-19 continues to be a Universal Health Pandemic not allowing for onsite testing to resume. As this pandemic continues to heighten there is an immediate continued need for portable sleep studies. Due to the rapid changes and surge of COVID-19 there has been no capability to plan for a streamlined procurement/acquisition. Therefore, an emergency contract will be put in place to align with providing portable/remote services to allow sleep apnea testing to continue. This contract will allow for up to 1200 studies/testing. The ordering period will begin on 12/15/2020 through 12/15/2021.
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
These services will be procured utilizing the authority of unusual and compelling urgency, located at 41 U.S. Code § 3304 (a) (2) and referenced at FAR 6.302-2.
This requirement will utilize the same WatchPAT Devices utilized on the previous contract.
These devices are provided by ITAMAR Medical, Inc. have three points of contact with the patient and measures up to seven channels PAT signal, heart rate, oximetry, actigraphy, body position, snoring, and chest motion). to decrease any gaps in service. As a different device may require additional training and testing prior to providing the service to the patients currently in need.
The WatchPAT devices for quick downloading of raw data, within one-minute of post study and is auto scored. The WatchPAT is highly reliable and reproducible medical device that requires very little training. Due to this requirement being an emergency as a result of the COVID-19, it is most advantageous of the government to remain utilizing the WatchPAT devices to prevent unnecessary gaps in service to the patients currently in need.
4. Description of market research conducted and results or statement why it was not conducted:
A review of the market illustrated that competing this requirement would cause an additional delay in resuming testing. Although a query on VetBiz utilizing the NAICS code 541990 (Used for previous acquisition) and key word “sleep study” yielded 9 potential sources (8 SDVOSB and 1 VOSB) soliciting this requirement and receiving a different device would require additional training and testing prior to the service being available for use to the patients. Therefore, due to the unusual and urgent compelling need of this emergency requirement, it will be sole sourced to ITAMAR Medical, Inc.
