About this file

This document is a Competition Impractical Authorization form from the Arizona Department of Transportation (ADOT), specifically from the ASD/Procurement Division. The document involves Quail Construction (Supplier ID IV0000058878) and pertains to a contract for Temporary Concrete Barriers (TCB) for the I-10 Project between SR 202L and Gila River Bridge.

The contract (CTR077924) is for an initial 24-month term with an estimated cost of $350,000, covering Temporary Concrete Barriers with the commodity code 46161515. The pricing structure includes rates for crash cushion installation/removal ($3,000 each), crash cushion in use ($50/day), temporary concrete barrier installation/removal ($28/linear foot), barrier relocation ($7/linear foot), and barrier in use ($0.15/day). The justification for direct award is based on project continuity, as the current barriers are already installed and removing them would cause unnecessary disruption. The contract is set to run from 9/4/25 to 9/3/26, with potential for a subsequent 12-month extension, and the pricing has been determined fair and reasonable based on historical contract data.

46161515 – Crash Cushion

Rationale: Compliance with A.R.S. § 41-2533, 41-2534, 41-2538 or 41-2578 is: Impracticable

Provide justification details:

A contract for Temporary Concrete Barriers (TCB) was solicited and awarded on December 2, 2024 for the rental of TCBs required for the I-10 Project, from SR 202L to Gila River Bridge. However, due to unforeseen project delays, the construction will not be completed by the contract’s expiration date September 3, 2025. The barriers are already installed at an active construction site. Requiring the removal and replacement of barriers for the purpose of re-competing the contract would result in unnecessary disruption and would not serve the state's best interests.

Construction on the Gila River Project is now projected to continue for at least another year and nine months beyond the current contract term, resulting in an extended need for TCB services. No statewide contract exists for Temporary Concrete Barriers, and these materials are not available through the Central District Traffic Control contract. Awarding a direct contract to Quail Construction is essential to ensure public safety, maintain business continuity, and avoid project delays or additional costs. Retaining the current supplier at previously competed rates fulfills the Department’s requirements in a fair, reasonable, and transparent manner. The pricing has been determined to be fair and reasonable, supported by relevant historical pricing from the previous competitive award.

Fair and reasonable price determined pursuant to A.A.C. R2-7-702:

It has been determined that the price is fair and reasonable as supported by the relevant historical pricing data below:

Hi Barry, You probably noticed we haven't sent the new version of the contract yet for you to sign. After a bit of internal discussion, we decided that we need this service to be under a 12 month contract, with the option to extend for an additional 12 months. Please confirm that you are okay with the pricing being active from 9/4/25 - 9/3/26, and then have the possibility of a price increase for the optional extension beyond that.

Thanks, Sage Brenner

I would appreciate having pricing by COB Thursday. The contract period will be for 6 months, but renewable for an additional 3 months at the same rate. The contract would take effect 9/4/25.
