Scope of Work
1. PURPOSE
1.1 The Contractor shall provide Kaibab Deer Check Station Services at agreed-upon dates at $60 per hour for the Arizona Game and Fish Department (AZGFD) in accordance with this agreement.
2. SCOPE OF WORK - CONTRACTOR RESPONSIBILITIES
2.1 HOURS OF OPERATION
Contractor shall staff the check station during the specified days and hours of operation. The check station will open each day that a Unit 12A General or a Youth mule deer hunt is scheduled, from 8:00 a.m. to 8:00 p.m. and until noon the day following each hunt.
If a hunter arrives at the check station after hours to check-out a deer, the Contractor is under no obligation to check-out the animal.
The Contractor will commit to manning and operating the check station at a minimum for the entirety of the late general hunt, and coordinate with the AZGFD on the contractor scheduling of the early general hunt and any juniors’ hunts. Beyond the late general hunt, contractor assistance for the check station operations is optional, but preferred by the AZGFD. At least 30 days advanced coordination is required for any changes to the scheduling of contractor services beyond the late hunt.
2.2 GREETING HUNTERS
Contractor shall greet hunters and ask them about their hunt. Contractor shall be friendly and courteous throughout the check-out process and will finish the process in as timely a manner as possible. Contractor shall complete the check-out by thanking the hunter for stopping at the check station.
2.3 CHECK STATION DATA
2.3.1 Completing Check-Out Application (app)
Contractor shall ensure that all information requested on the check-out app is fully completed.
2.3.1.1 Hunter Data
Contractor shall record the hunter’s hunting license number, name, hunt number, and permit number.
Purchasing Office
2.3.1.2 Harvest Data
Contractor shall record the date of kill, the sex of the animal and the number of antler points on the left and right side of the rack, excluding brow tines. Contractor shall use a ruler to measure the maximum outside antler spread (perpendicular to the head).
Contractor shall take a picture of each buck with an antler spread of >25 inches using the digital camera. Pictures will not be posted, but hunters are free to look at the digital photos.
Contractor shall record field-age based on wear and replacement of teeth (review jaw board and instructions for aging). Ages are categorized as follows: F = fawn, 1 = yearling or 1.5 years of age, 2 = 2-year old, 3-5 = 3-5 years old, 6-8, 9+. If it is difficult to see the molars, Contractor shall ask the hunter if it is acceptable to cut from a corner of the mouth along the jaw to age the animal. (If a hunter plans to mount the animal, they may not want the hide to be cut.).
To determine age distribution, a tooth will be collected from bucks 2 years and older.
Contractor shall ask the hunter if it is acceptable to remove one of the two middle incisor teeth from their deer. If permission is obtained, Contractor shall pull a tooth using a knife to loosen the tooth and a screwdriver and/or pliers to remove the tooth. The tooth shall be placed in a tooth envelope. On the tooth envelope, Contractor shall record the hunter’s name, hunt number, permit number, date, and sex of deer. The tooth shall be stored in a plastic bag in the chest freezer on the west side of the check station. Teeth from the same hunt shall be placed in a plastic bag with the hunt number marked on it.
Only hunters with permits for Units 12A East and 12A West are required to stop at the check station. However, if 12B, 13A, and 13B hunters stop, Contractor shall request permission to pull a tooth from their bucks. Ages from these deer are important for determining whether the AZGFD is meeting Alternative Management Guidelines.
Contractor shall use the hoist and a scale to weigh all intact field-dressed yearling bucks to the nearest pound. Yearling bucks should not be weighed if the hide has been removed or the animal has been quartered.
2.3.1.3 Elk/Bison Data
Contractor shall record the number and location of male, female, and calf elk or bison seen by the hunter. If none were seen, a large “0” shall be written in each category.
For harvested elk and bison, Contractor shall complete the appropriate elk check-out form and complete the bison harvest app.

2.3.1.4 Condor Lead Data
Contractor shall ask the hunter if they used non-lead ammunition. If not, Contractor shall ask the hunters if they took other lead reduction actions. If yes, Contractor shall mark whether they removed the gut pile, covered the gut pile, or shot the animal in the neck. If the hunter did not take lead reduction action, as a friendly reminder, Contractor shall describe lead reduction efforts that benefit California Condors.
If the hunter used lead ammunition and brought in a gut pile, Contractor shall enter their name into the gut pile raffle book. In the gut pile book, Contractor shall record the hunter’s name, address, and phone number. The gut pile shall be placed in a plastic bag in the freezer. Contractor shall contact the AZGFD Condor Coordinator if the freezer reaches its capacity
2.3.1.5 Check-Out Data
Contractor shall record the AZGFD radio number, date of check-out, and the time (military).
When check-out is completed, Contractor shall punch the tag with a paper punch.
2.3.1.6 Chronic Wasting Disease
Contractor shall assist with the collection of CWD samples (see detailed protocol for collecting CWD samples).
Contractor shall ask hunters if a CWD sample can be taken from their deer by making an incision in the upper neck next to the jaw. If no, Contractor will not be able to collect a sample for CWD. If yes, Contractor will collect the sample. The preferred sample is the medial retropharyngeal lymph node. If this sample is not attainable, collect the tonsil, or parotid lymph node, or submandibular lymph node in this order of preference [Note:
all lymph nodes come in pairs so collect both.].
Once the sample has been collected, Contractor shall place it in the whirl pak accompanying the data form and ensure the ID number on the pack matches that on the form. Contractor shall complete the data app in its entirety. Most of the information needed to fill out the form can be obtained from the hunter’s license; however, Contractor will need to get the hunt # and permit # from the tag attached to the deer.
Contractor will ask the hunter for their phone number and explain that this will only be used should the deer return positive for CWD. Contractor shall place whirl pak with sample into the outside chest freezer in a zip-lock bag and place completed card in the plastic container.
Purchasing Office
2.3.1.7 Form Completion

2.5 CARE OF STATION
The Contractor shall keep the check station clean. At the end of each hunt and before leaving the check station, Contractor shall wash the dishes, clean the bathrooms, remove all garbage and clean the floors.

It is the responsibility of the contractor to report any item that breaks, and any lack of supplies or other item(s) necessary to successfully operate the check station to the AZGFD contact. The contractor has no obligation to repair anything at the check station.
Dogs and cats are not allowed in the check station.
The contractor is responsible for the safe operation of the check station. The contractor will remediate any hazard that comes up to the best of their ability. At the end of the check station season, Contractor shall remove all food from the refrigerator, turn the building furnace down to 50o F, turn the hot water heater to “vacation” mode and cover the hoist.
Contractor shall move all signs and cones to the covered area at the west end of the check station.

This indemnity shall not apply if the Contractor or Subcontractor(s) is/are an agency, board, commission or university of the State of Arizona.
6.2.2. Public Agency Language Only. Each party (as ‘indemnitor’) agrees to indemnify, defend, and hold harmless the other party (as ‘indemnitee’) from and against any and all claims, losses, liability, costs, or expenses (including reasonable attorney's fees) (hereinafter collectively referred to as 'claims') arising out of bodily injury of any person (including death) or property damage but only to the extent that such claims which result in vicarious/derivative liability to the indemnitee, are caused by the act, omission, Purchasing Office negligence, misconduct, or other fault of the indemnitor, its officers, officials, agents, employees, or volunteers.
6.3. Indemnification - Patent and Copyright. The Contractor shall indemnify and hold harmless the State against any liability, including costs and expenses, for infringement of any patent, trademark or copyright arising out of Contract performance or use by the State of Materials furnished or work performed under this Contract. The State shall reasonably notify the Contractor of any claim for which it may be liable under this paragraph. If the Contractor is insured pursuant to A.R.S. § 41-621 and § 35-154, this paragraph shall not apply.
6.4. Force Majeure.
6.4.1. Except for payment of sums due, neither the Contractor nor State shall be liable to the other nor deemed in default under this Contract if and to the extent that such party’s performance of this Contract is prevented by reason of force majeure. The term “force majeure” means an occurrence that is beyond the control of the party affected and occurs without its fault or negligence. Without limiting the foregoing, force majeure includes: acts of God, acts of the public enemy, war, riots, strikes, mobilization, labor disputes, civil disorders, fire, flood, lockouts, injunctions-intervention-acts, failures or refusals to act by government authority, and other similar occurrences beyond the control of the party declaring force majeure which such party is unable to prevent by exercising reasonable diligence.

6.4.2.3. Inability of either the Contractor or any Subcontractor to acquire or maintain any required insurance, bonds, licenses or permits.
6.4.3. If either the Contractor or State is delayed at any time in the progress of the work by force majeure, the delayed party shall notify the other party in writing of such delay, as soon as is practicable and no later than the following working day, of the commencement thereof and shall specify the causes of such delay in such notice. Such notice shall be delivered or mailed certified-return receipt and shall make a specific reference to this article, thereby invoking its provisions. The delayed party shall cause such delay
Purchasing Office to cease as soon as practicable and shall notify the other party in writing when it has done so. The time of completion shall be extended by Contract Amendment for a period of time equal to the time that results or effects of such delay prevent the delayed party from performing in accordance with this Contract.
6.4.4. Any delay or failure in performance by either party hereto shall not constitute default hereunder or give rise to any claim for damages or loss of anticipated profits if, and to the extent that such delay or failure is caused by force majeure.
6.5. Third Party Antitrust Violations. The Contractor assigns to the State any claim for overcharges resulting from antitrust violations to the extent that those violations concern Materials or Services supplied by third parties to the Contractor, toward fulfillment of this Contract.

7.3.1.3. Conform to or perform in a manner consistent with current industry standards; and
7.3.1.4. Be fit for the intended purpose or use described in the Contract.
7.3.2. Mere delivery or performance does not substitute for express acceptance by the State.

7.4. Inspection/Testing. The warranties set forth in this Section 7 [Warranties] are not affected by inspection or testing of or payment for the Materials or Services by the State.
7.5. Contractor Personnel. 7.10.3. A request from the State related to this paragraph 7.10 does not necessarily indicate that there has been an occurrence of force majeure, and the Contractor will not be entitled to any additional compensation or extension of time by virtue of having to implement a plan.
7.10.4. Failure to have or implement an appropriate plan will be a material breach of contract.
