About this file
This is a Request for Proposal (RFP) issued by the Arizona Department of Transportation (ADOT) Procurement for a Disadvantaged Business Enterprise (DBE) Availability Study and Overconcentration Analysis. The contract is solicited under Arizona Procurement Code and will be funded by federal financial assistance from the U.S. Department of Transportation, specifically the Federal Highway Administration (FHWA), Federal Transit Administration (FTA), and Federal Aviation Administration (FAA). The solicitation is open to qualified contractors who can conduct a comprehensive study examining DBE participation in Arizona's transportation contracting landscape.
The study aims to determine the proportion of DBEs available to work on federally-funded transportation contracts in Arizona, analyze potential overconcentration in specific work areas, and calculate the Department's overall DBE goals for the next three years. The contractor will be required to perform a legally defensible analysis covering the period from the Department's last DBE study through state fiscal year 2020, with specific deliverables including a draft report by May 1, 2023, calculation of triennial DBE goals, and a final report by July 15, 2023. The study must examine DBE availability across highways, public transit, and airport-related contracts, utilizing the Department's existing electronic databases and incorporating both electronic and non-electronic contract and payment data from prime contractors, subcontractors, and grantees.

SCOPE OF WORK
1. Statement of Need
1.1. Pursuant to the Arizona Procurement Code, A.R.S. §41-2501 et seq., the State of Arizona Department of Transportation (Department), has a requirement for a Disadvantaged Business Enterprise (DBE) Availability Study and Over Concentration Analysis.
1.2. The purpose of the Study is to determine the proportion of DBEs available to work on federally-funded contracts in Arizona’s transportation industry, to determine if DBEs are having a disproportional impact on any area of the market, to calculate the Department’s overall DBE goals.
2. Introduction and Background
2.1. The Department’s Infrastructure Delivery and Operation Division (IDO) is responsible for overseeing the project development, letting, bidding, and award of highway, bridge and related infrastructure funded by the Federal Highway Administration (FHWA) for the Department and its Subrecipients. The Department’s Multimodal Planning Division (MPD) is responsible for overseeing transportation, transit, and aeronautics planning and project programming funded by FHWA, Federal Transit Administration (FTA) and Federal Aviation Administration (FAA). The Department is headquartered in Phoenix, AZ with District Offices in Flagstaff, Globe, Holbrook, Kingman, Phoenix, Prescott, Stafford, Tucson and Yuma, Arizona.
2.2. The Department’s Business Engagement & Compliance Office (BECO), located in Phoenix, AZ is responsible for the implementation of the DBE program. The program is operated under approved DBE program plans with three United States Department of Transportation (USDOT) modal agencies (FHWA, FTA and FAA) as required by Federal laws and regulations, 49 CFR Parts 23 and 26. The Department’s BECO establishes the triennial DBE goals for each Federal program and serves as the lead agency in Arizona’s Unified Certification Program with the cities of Phoenix and Tucson, performs statewide DBE goal-setting, monitors DBE participation and utilization for all federally-assisted projects and provides DBE supportive services in the form of training, technical assistance and outreach to DBEs and small businesses.
2.3. Currently, the Department is conducting a combined race-conscious and race and gender-neutral DBE program. The Department’s current overall DBE goal for FHWA funded contracts is 12.89% (of which 8.17% is race-conscious and 4.72% is race-neutral); FTA funded contracts is 14.64% (all race-neutral) and 10.69% (all race-neutral) for FAA contracts.
2.4. The Department assesses all federally-assisted Department and Subrecipient contracts for DBE opportunity. Most federally-assisted contracts are advertised with DBE goals, while a smaller number are advertised as race-neutral. Types of contracts with DBE goals include planning, architectural and engineering (professional services), construction, procurements for goods and services, etc. The Department also implements some contracts with 100% State funding. The state-funded contracts are not assessed for DBE goals.
2.5. At any given time, the Department and its Subrecipients are implementing approximately 500+ federally-assisted contracts that may or may not include DBE goals. DBE utilization on most of these contracts is tracked electronically in one main online diversity management system fed from several other internal “home-grown” contract management systems, which will all be available for data extraction by the Contractor. Most of the Department and Subrecipient contract data for Prime Consultants and Contractors is also available electronically but some of this data may have to be reconstructed from hard copy files. Some data, particularly Subrecipient data, will need to be checked for accuracy.
2.6. The Department is required to resubmit new triennial DBE goals to USDOT in August 2023 for FHWA-funded contracts and August 2024 for FTA and FAA contracts and desires to submit these triennial DBE goals based on data obtained through this study.
2.7. The Department is required to evaluate whether there is DBE overconcentration in specified work categories and to implement remedies to mitigate the impact of any overconcentration on non-DBE firms.
2.8. The Department is required to examine overall trends of race and gender ownership of DBE firms receiving ADOT work during the 2019 and 2020 State fiscal years.
3. General Requirements
3.1. Definitions The following definitions apply to the contract:
3.1.1. Project Manager: The Departments representative delegated the responsibility to oversee and manage work performance and outcomes.
3.1.2. Contractor: The Firm and/or individual that will perform the required work.
3.1.3. Ethnicity: An ethnic group or a social group that shares a common and distinctive culture, religion, language, or the like.
3.1.4. Principal Investigator: The Contractor’s Project Manager/lead person directly in charge of the contract and authorized to direct, oversee, or perform work operations and having authority to make day-to-day decisions concerning the work operations and to accept and route correspondence from the Department’s representative.
3.1.5. Disadvantaged Business Enterprise (DBE) Program: A United States Department of
Transportation (USDOT) program designed to ensure nondiscrimination in the award and administration of DOT-assisted contracts in the USDOT’s highway, transit, and airport financial assistance programs. The purpose of the program is to help create a level playing field on which DBE firms can compete fairly for contracting opportunities on federally assisted contracts.
3.1.6. Federally-Assisted Contracts: Contracts funded to any degree with federal funds. Contractors should refer to 49 CFR Part 26 for other DBE related definitions. Unless context indicates otherwise, the definitions found in 49 CFR Part 26 apply to this contract.
3.1.7. Race-conscious goals: Goals placed on federally-assisted contracts as a condition of award. At the time that the presumed successful proposer is identified, the proposer must submit documented evidence that it will be able to achieve the predetermined percentage of participation on that contract or that it made good faith efforts to meet the goal.
3.1.8. Race-neutral goals: This type of DBE participation in contracting opportunities is obtained without placing a required DBE goal on a project or contract. This percentage represents the amount of DBE participation the Department expects to obtain through neutral measures, e.g., unbundling of contracts, bonding and lending assistance, or DBE participation in the DBE Supportive Services Program.
3.1.9. Recipient: An organization receiving financial assistance directly from a Federal awarding agency(ies) to carry out a project or program.
3.1.10. Small Business Concern (SBC): A component of the Department’s DBE program designed to encourage voluntary small business utilization on federally-assisted contracts and to foster race-neutral DBE participation, which is within the scope of this study.
3.1.11. Small Business Enterprise Program (SBE): City of Phoenix and City of Tucson small business utilization program funded by local city funds, which is outside the scope of this study.
3.1.12. State Fiscal Year: The period of time from July 1 through June 30 of the following year.
3.1.13. Subrecipient: any legal entity to which a sub-award of federal financial assistance is made and which is accountable to the recipient for the use of the funds provided.
3.2. Conduct a DBE Availability Study and Over Concentration Analysis to:
3.2.1. Determine the availability of DBE and potential DBEs in the Department and its Subrecipients’ marketplace;
3.2.2. Examine overall trends of race and gender ownership of DBE firms receiving the Department’s work during the 2019 and 2020 State fiscal years;
3.2.3. Calculate the Department’s triennial DBE goal for FHWA, FTA and FAA contracts and;
3.2.4. Evaluate whether there is DBE overconcentration in specified work categories.
3.3. The study is limited to projects in which the Department directly participates or serves as a conduit to Subrecipient for federal-aid transportation funds.
3.4. Minimum Qualifications. The Contractor and/or its principal shall have a minimum of three (3) years of experience in conducting DBE Availability Analysis and Disparity Studies for state Departments of Transportation and/or local governments and must have successfully performed at least three (3) such legally defensible Analysis and Studies within the past five (5) years.
3.5. Arizona and DBE program Demographics.
3.5.1. The Department and its Subrecipients have approximately 500+ federally-assisted contracts open at any given time. The Contractor shall utilize data from the Department’s 2017 DBE Availability & 2020 Disparity Study, if feasible, to supplement data and help reduce project costs.
