LIMITED SOURCE JUSTIFICATION

J&A Number: Not Applicable (N/A)

Upon the basis of the following justification, I, as the Contracting Officer, hereby approve this limited source justification in accordance with FAR 8.405-6(a)(1)(i)(B). The acquisition referenced herein is conducted under the authority of the MAS Program.

JUSTIFICATION

1. REQUIRING AGENCY AND CONTRACTING OFFICE:

Requesting Agency:

USAF ACC/A51

402 Helms Avenue Langley Air Force Base, Virginia 23665

Contracting Activity:

DISA/Defense Information Technology Contracting Organization (DITCO)/PL8222 2300 East Drive, Building 3600 Scott Air Force Base, Illinois 62225

2. NATURE/DESCRIPTION OF ACTION(S):

The nature of this action is to issue a Firm Fixed Price (FFP) modification to extend existing services on task order HC1013-11-F-0392 (Tracking Number: CTC0086) with Artel, LLC for a 2-month extension. The current period of performance (POP) ends on September 29, 2016; this modification will include a POP of September 30, 2016 through November 29, 2016. The modification is required to avoid disruption of services while transitioning from the existing task order to the follow-on task order.

The total estimated cost of this extension is . Fiscal year (FY) 2016 operations and maintenance funding will be provided using a military interdepartmental purchase request for the extension. The applicable North American Industry Classification Code is 517410, Satellite Telecommunications.

3. DESCRIPTION OF SUPPLIES/SERVICES:

The current task order, HC1013-11-F-0392, provides the USAF ACC with commercial Ku-band satellite bandwidth to support GH UAV operations and training. This action will be a continuation of services to support ACC’s GH and UAV mission while the recompete action is completed. USAF ACC’s overarching mission is to provide vital support for USNORTHCOM.

USNORTHCOM is a Unified Combatant Command of the US military tasked with providing military support for civil authorities in the US and protecting the territory and national interests of the US' air, land and sea approaches, encompassing the Continental US, Alaska, Canada, Mexico, and the surrounding water out to approximately 500 nautical miles. The USNORTHCOM Commander is responsible for theater security cooperation with Canada, Mexico, and The Bahamas. USNORTHCOM is the US military command which, if applicable, would be the primary defender against a US mainland invasion. The USNORTHCOM partners with US North American Aerospace Defense Command, to conduct Homeland Defense and Civil Support operations within the assigned AOR, to defend, protect, and secure the US and its interests.

The following table illustrates the anticipated period of performance and estimated costs:

Period of Performance Cost 2-Month Extension Period Sep 30, 2016 - Nov 29, 2016

4. IDENTIFICATION OF LIMITED SOURCE AUTHORITY AND DEMONSTRATION

OF CONTRACTOR’S UNIQUE QUALIFICATIONS:

(a) Circumstances Justifying Limiting the Source. FAR 8.405-6(a)(1)(i)(B), only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.

(b) Description of the Justification: The USAF ACC mission depends on the COMSATCOM services currently rendered by the incumbent contractor, Artel, LLC. Due to delays encountered with the recompete acquisition (CTC0246), an extension of the current task order is required for continuity of this critical service. A lapse in service would be detrimental to USAF ACC’s mission. This prompted the POP for CTC0246 to be revised to a November 30, 2016 start date in order to complete the evaluation process and award the task order.

Therefore, a Limited Source J&A is required to exercise the Government’s

Page 3 of 5 Pages

As such, USAF ACC will require a 2-month extension to ensure continued critical support and services.

(c) Justification.

(1) Minimum Government requirements. USAF ACC’s minimum requirements include commercial Ku-band satellite bandwidth to support GH UAV operations and training.

(2) Proposed sole source contractor. The proposed sole source contractor is the incumbent, Artel, LLC.

(3) Discussion regarding cause of the limited source situation. Due to delays encountered with the recompete acquisition (CTC0246), an extension of the current task order is required for continuity of this critical service. This prompted the POP for CTC0246 to be revised to a November 30, 2016 start date in order to complete the evaluation process and award the task order.

(4) Demonstration of limited source. The current contractor, Artel LLC, is the only source that can fulfill the extension due to USAF ACC being in the middle of a critical mission requirement.

(5) Procurement discussion. The recompete of the current task order is currently ongoing and award is expected . Continuity of satellite services would be put at risk if the 2-month extension is not exercised.

(6) Impact. GH training significantly supports GH operators’ ability to provide a critical intelligence, surveillance and reconnaissance (ISR) capability for United States Pacific Command, United States European Command, United States Africa Command and United States Central Command. If there is a loss of service because the present CTC0086 commercial Ku band satellite lease is not extended until replacement by CTC0246, then the USAF’s ACC GH United States Northern Command critical training and ISR operations support mission will not be accomplished, as specified above.

5. BEST VALUE DETERMINATION:

GSA has already determined that prices of supplies, fixed price services, and rates for services offered at hourly rates are fair and reasonable for the purpose of establishing the schedule contract. However, the Contracting Officer is still required to make a determination of fair and reasonable pricing for individual orders using the proposal analysis techniques at FAR 15.404-1.

Based on historical data, it is anticipated that the cost to the Government for this extension will be equal to or less than current commercial pricing. Similar task orders utilizing this particular satellite, , and the Government Independent Government Cost Estimate will be used in the Contracting Officer’s fair and reasonable analysis.

The Contracting Officer will determine a fair and reasonable price prior to the award of this extension.

6. MARKET RESEARCH:

This is an extension to the existing task order to ensure continued support until the recompete

Page 4 of 5 Pages task order is awarded.

nly the aforementioned satellite, currently provided by Artel, LLC, can fully support the Government’s need. Adequate market research was conducted for the follow-on task order within the last 12 months. The market research identified potential sources which enabled the recompete task order to be conducted as a total small business set-aside.

7. ANY OTHER SUPPORTING FACTS:

N/A

8. ACTIONS THE AGENCY MAY TAKE TO REMOVE BARRIERS THAT LED TO

THE RESTRICTED CONSIDERATION:

(a) Procurement History.

(1) Task Order Number: HC1013-11-F-0293 awarded September 30, 2011

(2) Competitive Status: Full and open competition

(3) Type of set aside: None

(b) The Government anticipates that no additional sole-source actions will follow this extension as the Government is currently completing the recompete acquisition. The recompete acquisition was set aside for small business concerns under GSA’s COMSATCOM Transponded Capacity Schedule 70 SIN 132-54 contract vehicle for the follow-on task order.

9. REFERENCE TO THE APPROVED ACQUISITION PLAN (AP):

In accordance with the exceptions under DISA Acquisition Regulations Supplement 7.103 (S- 91)(1)(viii), an AP is not required.
