DNR EXTERNAL REPRESENTATIVE
A. ABW agrees and understands that DNR will provide an independent contractor to oversee this project. The independent contractor dedicated to oversight will participate in the following:
1. Initial site visit and a kickoff meeting.
2. Routine site visits, minimum of at least five, during the project.
3. General consulting throughout the process.
4. A two-day site visit for sea trials and stability test.
5. Have open communication with ABW staff (including attendance at virtual monthly status meetings with ABW).
B. The independent contractor will be a Principal Engineer (P.E.) or Naval Architect with intimate knowledge of the design and its rationale. DNR will require and confirm that this party will carry the required Marine Engineers Professional Liability coverage.
C. ABW will not be responsible to carry Marine Engineer Professional Liability.
SITE VISITS, MEETINGS AND COMMUNICATION
A. ABW has stated that they have an open-door policy for on-site visits during the building process.
B. ABW agrees to schedule monthly update meetings (phone or virtual conference) for DNR.
C. ABW agrees to mandatory site visits at 50% and 90% of the build.
D. ABW has provided the following detailed plan for communicating process updates & changes to the Agency. Building a custom research vessel requires constant dialogue with not only the crew but the biologists to ensure proper ergonomics for a variety of data gathering operations done in a compromising marine environment. As an observer on completed vessels there is often a mismatch between biologists’ needs and assumptions during the building process. Constant and open communication is of paramount importance.
DOCUMENTATION AND WARRANTY
A. ABW will provide DNR with the tonnage certificate, certificate of documentation, warranties, and equipment manuals in accordance with the “Specifications for 55-foot Aluminum Fisheries Research Vessel” document number 080. In addition, ABW will provide the National Vessel Documentation Center with the following:
1. CG-1258 Application for initial issue (including coastwise endorsement)
2. CG-1261 Builders Certificate
3. CG-5397 Application for Admeasurement
4. CG-1340 Bill of Sale
B. Upon delivery of the vessel, ABW will provide DNR with all manuals in an agreed upon manner.
MUTUALLY AGREED UPON CLARIFICATIONS CONT’
SEA TRIALS AND TESTING
DNR and ABW have agreed on the provided detailed plan on how ABW will conduct testing, sea trials, including DNR participation. When the vessel is launched system commissioning begins when cooling water is available. Main propulsion is commissioned by the manufacturer’s rep. and sea trials are conducted under their direction and control. After propulsion is signed off and hydraulics are available the other systems will be commissioned. It is of course imperative that the DNR crew is available with whatever agreed fishing gear can be deployed to evaluate equipment.
DELIVERY AND ACCEPTANCE
DNR has accepted and understands that a detailed delivery and acceptance plan is not available until the vessel is fully commissioned, weather criteria evaluated, ports of call and refuge established. In addition, it is agreed that the research vessel delivery will be on her own bottom with ABW crew. ABW recommends that DNR personnel be in attendance to familiarize themselves with the operation and provide any critique. DNR crew may join the vessel at any time. At a minimum the DNR crew should make the last leg of the voyage. DNR may adjust the delivery schedule due to the length of the negotiations process.
