OPOAM 3016.505-90(a)(2)(i) Justification for Exception to Fair Opportunity

Exceeding the micro-purchase threshold and up to the SAT pursuant to FAR 16.505(b)(2)(ii)(A)

JEFO No.: FY19-0160

Date: 03.21.2019

PR Number: DMD190021

Nature and/or description of the item/service being procured and anticipated cost:

The Department of Homeland Security (DHS), Office of Procurement Operations (0P0), U.S. Citizenship and Immigration Services (USCIS), Document Management Division (DMD) is proposing to procure a one (1) month extension to the Card Production Services (COPS) task order - HSSCCG-14+00097, on a noncompetitive basis. The specific FAR Subpart supporting this justification is FAR 16.505(b)(2)(C)1 Logical Follow-On.

The extension of services for one (1) month is needed in order to ensure continuity of operation at Card Production Facilities nationwide while the re-compete is ongoing. The IGCE for this effort is .

Period POP Unit CLIN Item Description Month! Rate

Extension 1 MO #001AA Polycarb Cards - Option IV $

Extension 1 MO #002A8 Travel Docs - 80,001 to 170,000 Cumulative TDs $

Extension 1 MO #003AC ELIS Notices Printing & Mailing Extension 1 MO #OO4AA PM -12 mos

The period of performance for this extension is 04.01.2019 - 04.30.2019.

The figures in the IGCE above were calculated by utilizing the last month of the last option period. The rates were previously established as fair and reasonable at time of award.

Statutory Exception and rationale for its use:

X FAR 16.505(b)(2)(i)(C). The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.

This justification is based upon logical follow-on; the initial task order was subject to fair opportunity and was competed amongst EAGLE II, Functional Category 1 contract holders. The COPS task order did not evaluate or include FAR clause 52.217-8, Option to Extend Services, in the task order or solicitation; therefore this option was not evaluated at time of award. An extension of services for one (1) month is needed in order to ensure continuity of operation at Card Production Facilities nationwide. The COPS re-compete, Document Production Services (DPS), procurement is ongoing. The initial proposals have been received and evaluated by both the Technical Evaluation Committee (TEC) and the Business Evaluation Committee (BEC), and discussions are scheduled for offeror's in the competitive range. Offerors within the competitive range will have the opportunity to submit a final revised proposal at the conclusion of discussions, and the anticipated date of award is 04.23.2019, inclusive of a five (5) day congressional notification period.
