SIMPLIFIED ACQUISITION PROCEDURES (SAP)

Determination Memorandum for Sole Source Acquisitions Over $10,000 but not Exceeding $250,000 SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER DETERMINES THAT ONLY ONE SOURCE IS REASONABLY AVAILABLE. WHEN THE CUSTOMER DESCRIBES AN ITEM OR SERVICE, WHICH LIMITS THE AVAILABILITY TO ONE SOURCE, THE DETERMINATION MUST EXPLAIN WHY THE ITEM OR SERVICE PROVIDER IS THE ONLY ONE THAT WILL MEET THE GOVERNMENT'S REQUIREMENT. STATEMENTS SUCH AS "ONLY KNOWN SOURCE" OR "ONLY SOURCE WHICH CAN MEET THE REQUIRED DELIVERY DATE" ARE INADEQUATE TO SUPPORT A SOLE SOURCE PURCHASE. THIS FORM MAY BE USED IN LIEU OF THE DETERMINATION DESCRIBED IN FAR 13.106. THE CUSTOMER SHALL PROVIDE THE FOLLOWING INFORMATION:

NAWCTSD 4200/6 (REV 6/29/2018)

PRnumber: TBD
ProjectTaskNumber: TBD
EstimatedAmount: 44000.00000000
Description: Custom hardware is being procured for use within DRMS equipment. The items requested are custom length and threaded screws (Shoulder

Screw), CNC legs (1" OD x 2" Long Feet) and holes milled in metal plates (PS Base).

These items are custom made screws, feet and holes milled that were uniquely designed by the government. The government will provide the metal plates, engineering drawings and instructions on how to build these unique products (via CAD/ Solidworks files) and the vendor will use special equipment and SME knowledge to build the items in the required timeline. The government will then combine these products to produce DRMS consoles that the fleet currently uses for secure communications.

UniqueCharacteristics: NAWCTSD has a requirement for a very short turnaround for these custom items. These are not COTS products. The government has performed market research in the form of going to machine shops and looking for the machinery required to make such precise items. Any slight deviation in the specification would make the product incompatible with current and older hardware that's currently approved by the government.

These custom parts require specific SME knowledge and a Nexturn SA32E machine with specs such as water cooling, RPM rate, and sensors for tolerances no greater than 0.005" on steel alloy. Market research and site visits to machinist shops has shown that Sohacki Industries, Inc (Sohacki) is the only vendor with access to the required tool and capable of meeting the specifications. Using other vendors who do not have the SME knowledge and specialized tools to create these customized parts would create a high risk for compatibility.

Explain: The government is unable to provide a purchase description to solicit more than one source, due to the unique custom build of the products. In order to produce the custom items the vendor must have the unique SME experience and specialized tooling required to follow specific engineering drawings and aggressive timeline. The government has performed market research and Sohacki was the only one identified as having the SME knowledge, specialized tools, and skillsets required to create these unique items in the timeline required by the government.

From the vendors researched, this vendor was better capable of providing the products giving a short turnaround (weeks not months) and had all the specialized tools and SME knowledge required. Using this vendor assures compatibility with already produced and fielded equipment.

Therefore, a sole-source contract is contemplated for Sohacki, which presents the greatest benefit to the Government, all factors considered.

StatementOfActions: No actions can be identified at this time. The Government team will continuously research and monitor the market to determine whether other brand name devices have been developed to meet this type of requirements. Additionally, the Government will monitor the marketplace for other vendors who have access to the required tool for future requirements. Currently, due to the product's unique build, replacing this product with another manufacturer and/or model would present additional compatibility challenges and unacceptable technical issues. Removing barriers for competition will necessitate a complete change of all equipments, which is technically unacceptable at this time. Consideration of any alternative vendors would require an unacceptable delay and additional cost due. Under FAR 6.302-1(c), only a sole source contract to Sohacki will fulfill the agency's needs. Future procurement of this item may result in different conclusions depending on the combination of requirements and availability at that time. Should the funds become available and/or requirements change, the Government will reevaluate the market.
