About this file

The document is a Competition Impracticable Procurement Authorization form from the Arizona Department of Administration's State Procurement Office, specifically involving the Arizona Game and Fish Department. The procurement request is for a contract with Mercer D. Lawing, an individual contractor with extensive experience in wildlife capture and tracking.

The contract is for bobcat capture and release services, including attaching and/or removing wildlife tracking collars, with a three-year term expiring on 9/26/2028. The estimated annual cost is $45,000, totaling $135,000 for the full contract period. The procurement is justified by Lawing's extensive 30-year experience trapping bobcats, previous work with the Arizona Game and Fish Department, familiarity with local trapping areas, and certification in wildlife handling techniques. The contract was determined to be competition impracticable due to Lawing's unique qualifications and proven track record, with pricing deemed fair and reasonable based on comparable past projects.

ARIZONA GAME AND FISH DEPARTMENT

INTER-OFFICE MEMO

TO: Kristen Micurescu, Procurement Branch Chief

FROM: April Howard, Predator, Furbearer and Large Carnivore Biologist

SUBJECT: Competition Impracticable contract for Bobcat Capture

Mercer Lawing

DATE: September 24, 2025

We have determined that Mercer Lawing best meets all of the requirements for this contract. Mr.

Lawing has trapped bobcats for over 30 years. More specifically, he has trapped and collared bobcats in Arizona under previous contracts with the Arizona Game and Fish Department for the past 5 years. He has also trapped coyotes under previous contracts with the Arizona Game and Fish Department. He is very familiar with accessible trapping areas in the game management units in which we will be working and has good working relationships with the local landowners. Mr.

Lawing is an effective and competent trapper with a proven track record in past contracts with the Department. He is familiar with wildlife capture and handling techniques, and has been trained and certified by the AZGFD veterinarian to handle and use chemical immobilization drugs. He has experience keeping detailed trapping logs, collecting samples, and completing the necessary data sheets for this and other Department projects. He has a current AZ hunting and trapping license and owns his own trapping equipment and lure which he has used previously to successfully trap bobcats in AZ. Mr. Lawing has a flexible schedule which allows him the time necessary to perform the services required. Lastly, Mr. Lawing is in good standing with the Department. Additionally, the pricing is fair and reasonable, as it is comparable to similar projects. Previously, we paid a different contractor $1,000 for each bobcat captured and collared. As such, we would like to pursue a competition impracticable agreement with Mercer Lawing as a contractor to capture and collar bobcats in areas identified by AZGFD.

Text11: The Department utilizes tracking collars to monitor bobcat locations in order to manage wildlife population, address human-wildlife conflicts, and ensure sustainable hunting practices. Monitoring is a critical component of the Department’s mission. This service was bid in 2021 on Solicitation #BPM002859. 2 offers were received and awarded for different hunt units. The other offeror notified the Department in Year 4 that he did not want to extend his contract so Mercer Lawing fulfilled that hunt unit as well, when needed. Mr. Lawing has had a contract with AZGFD for bobcat capture, collar and release since 2021 and has over 40 years of experience in recreational and commercial capture in Arizona, California, Nevada and Colorado. He has a current AZ hunting and trapping license and is in good standing with the Department. He is highly knowledgeable on the protocols and rules surrounding Arizona's wildlife laws and also about the Department's data collection and reporting processes. Mr. Lawing is capable of reaching rugged terrain and the physical demands of this type of field work. In order to fulfill this aspect of the Department’s mission, it is in the best interest of the State to continue utilizing Mr. Lawing for this service.
Dropdown21: [- Compliance with A.R.S. §§ 41-2533, 41-2534, 41-2538, or 41-2578 is impracticable]
Text12: As stated above, this service was previously bid and received 2 offers from qualified bidders. In the past, contracts had to be canceled with other bidders because they received hunting violations. It has been determined that a competition impracticable is the best solution for the continuance of this service with Mr. Lawing. Pricing is determined to be reasonable because it has remained constant since 2021 with no increases being requested.
