Brand Name or Equal is approximately equal to price. All factors other than price shall be evaluated on an “acceptable” or “unacceptable” basis.

A technically acceptable quote is defined as either:

1. The quote clearly identified the “equal” item being offered by defining how that item meets or exceeds the salient characteristic requirements of the Government. The “equal” product does not require modification of the existing equipment in any way that may subsequently void any warranty on the existing equipment. The “equal” product is a “plug and play” solution compatible with existing Steris model VHP VICTORY biodecontamination units, as that of the Brand Name item.

2. The quote included the “brand name” item to meet the requirements of the Government.

The Government shall evaluate the vendor's quote on a pass/fail basis, assigning ratings of acceptable or unacceptable using the ratings and descriptions outlined as follows:

Rating Description Acceptable Quote meets the Brand Name or Equal requirements of the solicitation.

Unacceptable Quote does not meet the Brand Name or Equal requirements of the solicitation.

Price- The total evaluated price shall be the sum of all Contract Line Item Numbers (CLINs). Quotes will be evaluated to determine whether it is fair and reasonable as per FAR 13.106-3. The Government shall not award a contract that is not fair and reasonable.

Offeror Representations and Certifications-Commercial Items In accordance with 52.212-3 Offeror Representations and Certifications-Commercial Items (Dec 2022), the contractor shall ensure that the business has completed the online Representations and Certifications at the System and Awards Management (SAM) website which may be found at https://www.sam.gov/portal/public/SAM/. It is the contractor’s responsibility to ensure that the information provided in each certification/representation is completed truthfully and completely. Failure to complete the online certification/representations prior to the close of the Solicitation (to include listing of the applicable NAICS code, “active status”, or applicable size standards) will deem the contractor non-responsive and eliminated from consideration of the award.

52.232-18 AVAILABILITY OF FUNDS (APR 1984)

Funds are not presently available for this contract. The Government’s obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer.
