About this file
This is a Combined Required Bid Documents and Tariff Notice for the Trinity River Authority (TRAW) of Texas, specifically for the Huntsville Regional Water Supply System (HRWSS), which is soliciting bids for a two-year annual supply of Polyaluminum Chloride (PACL). PACL is a chemical used in the water treatment process for settling and coagulation of raw water. The bid is limited to pre-qualified and Texas Commission on Environmental Quality (TCEQ) approved products, specifically Ultrafloc7482 at this time. Quantities listed in the bid are estimates only and may vary throughout the contract year. The document establishes standard instructions to bidders and required submission documentation for all interested vendors.
The document requires bidders to submit several forms and certifications including a Conflict of Interest Questionnaire (Form CIQ), HUB (Historically Underutilized Business) status certification if applicable, Texas Resident Bidder Certification, and verification statements certifying the firm does not boycott energy companies, firearm entities, or Israel, and is not identified on Texas Comptroller lists related to federal sanctions. The TRAW has established a tariff reimbursement policy requiring contractors to submit verifiable documentation of directly-incurred tariff costs on supplied commodities; invoices lacking supporting documentation will be paid less the tariff amount. Overhead charges related to tariffs are not compensable. The General Manager may authorize payment for verifiable tariff claims and directly-affected contractor costs for legally-required performance and payment bonds and contractually-required insurance cost increases.

NOTICE TO VENDORS: PAYMENT OF TARIFF CHARGES
The imposition of a tariff by the government does not automatically result in a charge to the consumer, unless it can be proven that the tariff charge is directly incurred on the good supplied. According to our policy, tariffs must be verifiable:
“The General Manager may authorize payment to contractors for verifiable tariff claims and directly-affected contractor costs for legally-required performance and payment bonds and contractually-required insurance cost increases. However, no contractor overhead charges claimed to be affected by tariffs are compensable. For a contractor to be reimbursed for tariff costs, it must submit to the Authority documentation specifically detailing the specific tariff costs imposed.”
To demonstrate that the tariff charge was directly incurred on the commodity being supplied, please submit, along with your quote/invoice, the supporting documentation. If we do not receive the supporting document to justify the tariff charge, the invoice will be paid less the tariff amount.
