About this file

This document contains combined required bid documents and a tariff notice for the Trinity River Authority (TRAD) of Texas, which is soliciting bids for an annual supply of powdered activated carbon for the Livingston Regional Water Supply System (LRWSS). The powdered activated carbon serves as a taste and odor absorbent in the water treatment process. The document is a template dated November 21, 2023, and includes standard instructions to bidders, conflict of interest questionnaires, HUB status certification forms, resident bidder certification requirements, and verification statements required under Texas Government Code. The file does not specify item quantities, response dates, due dates, site visits, bidders' conferences, award dates, or contract terms within the provided content.

The document establishes specific requirements for bidders regarding tariff charges, requiring vendors to submit supporting documentation demonstrating that tariff charges are directly incurred on supplied commodities. According to the Authority's policy, the General Manager may authorize payment for verifiable tariff claims and directly affected contractor costs for legally required performance and payment bonds and contractually required insurance cost increases, but overhead charges claimed to be affected by tariffs are not compensable. Bidders must certify their HUB status, resident or nonresident bidder status under Texas Government Code Chapter 2252, and compliance with prohibitions on boycotting energy companies, Israel, and firearm entities or trade associations. All contractors entering into agreements with the Authority must complete the required verification and conflict of interest questionnaire forms by the seventh business day after becoming aware of facts requiring disclosure.

NOTICE TO VENDORS: PAYMENT OF TARIFF CHARGES

The imposition of a tariff by the government does not automatically result in a charge to the consumer, unless it can be proven that the tariff charge is directly incurred on the good supplied. According to our policy, tariffs must be verifiable:

“The General Manager may authorize payment to contractors for verifiable tariff claims and directly-affected contractor costs for legally-required performance and payment bonds and contractually-required insurance cost increases. However, no contractor overhead charges claimed to be affected by tariffs are compensable. For a contractor to be reimbursed for tariff costs, it must submit to the Authority documentation specifically detailing the specific tariff costs imposed.”

To demonstrate that the tariff charge was directly incurred on the commodity being supplied, please submit, along with your quote/invoice, the supporting documentation. If we do not receive the supporting document to justify the tariff charge, the invoice will be paid less the tariff amount.
