About this file

This sole source justification document proposes a six-month bridge contract with the incumbent contractor to provide fully-automated coagulation analyzer systems, reagents, supplies, and materials in support of coagulation testing at Brooke Army Medical Center. The bridge contract would extend the current contract from 1 October 2022 through 1 April 2023 at an expected total value of $180,943.78, utilizing the same pricing terms as the final option year. The justification cites 41 U.S.C. 1901 and FAR 13.501 for authority, citing the need for continuity of supplies and services to maintain the hospital's Level 1 trauma status during the upcoming contract award and transition period. The follow-on procurement will be full and open competition.

Bridge Action for W81K00-18-D-0009, Coagulation

JUL2021

Sole Source Justification and Approval Under FAR 13.501

1. Contracting Activity: Joint Base San Antonio Health Contracting Branch (JBSA HCB), Regional Health Contracting Office – Central (RHCO-C), US Army Health Contracting Activity, 3551 Roger Brooke Drive, JBSA Fort Sam Houston, Texas.

2. Description of Action: The purpose of this action is to bridge current supplies and services for six months to ensure coagulation continuity of testing for coagulation/special coagulation for Brooke Army Medical Center beneficiaries. The Government projects award before 30 September 2022, with performance to start 1 October 2022; award will be subject to the availability of Defense Health Program (DHP) FY23 Funds. An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).

Name of Proposed Contractor(s) and Address:

DIAGNOSTICA STAGO INC.

5 CENTURY DR STE 1

PARSIPPANY NJ 07054-4607

3. Description of Supplies/Services: This is a bridge action to contract W81K00-18-D- 0009. The current contract expires on 30 September 2022 and sufficient time is not available for new award and continuity of services. Continuity of supplies and ancillary services is necessary to maintain Level 1 trauma status at Brooke Army Medical Center.

The Contractor shall be responsible for furnishing fully automated coagulation analyzer systems (inclusive of instruments, ancillary equipment, maintenance, services, repairs, support, parts as required in order to maintain the systems in optimal operating condition.

The contract provides equipment and reagents at a cost per reportable rate for high volume testing and a cost per kit rate based on estimated volumes for the lower volume testing. The instrument provides patients the results needed for diagnosis and treatment. Cost per test is as follows for W81K00-18-D-0009.

NOTE: As a supply contract, FAR 52.217-8 is not available for use.

Period of Performance: 1 October 2022 to 1 April 2023 Total Value: $180,943.78

4. Authority Cited: 41 United States Code 1901 as implemented in Federal Acquisition Regulation 13.501(a)(1)(ii), sole source (including brand name) under the authority of the simplified procedures for certain commercial items".

5. Reason for Authority Cited: A bridge will allow time and resource conditions to ensure sufficient time is available and to perform the necessary validation, verification, and crossover experiments while avoiding any lapse in the laboratories capability to provide required testing during the award of the follow-on requirement. Additionally, the unique requirements of establishing a completely new instrument platform that is capable of accurately reporting patient testing into MHS-GENESIS (a brand new Hospital Information System/Electronic Health Record) will take approximately 6 months.

6. Efforts to Obtain Competition: This bridge contract will serve to ensure no lapse in testing services critical for the hospital’s patient care objectives. The follow-on procurement for W81K00-18-D-0009 will be available for competition.

There are not any alternatives to the re-awarding a short term contract to the incumbent that would not result in mission failure. Brooke Army Medical Center provides healthcare services to Active Duty and Retired military members as well as their dependents, as mandated by statute. Part of those healthcare services involves performing laboratory tests in order for physicians to make a diagnosis and develop a treatment plan.

13. Fair and Reasonable Cost Determination: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. It is anticipated that pricing for the bridge effort will remain the same as the final option year of the awarded contract, which was deemed fair and reasonable at contract award.

Certified cost or pricing data is not required per FAR 15.403-1(b)(3).
