FWC CONTRACT No. 25328
MEMORANDUM OF
AGREEMENT BETWEEN
FLORIDA FISH AND WILDLIFE CONSERVATION COMMISSION
AND
DISTRICT BOARD OF TRUSTEES OF
TALLAHASSEE STATE COLLEGE
THIS MEMORANDUM OF AGREEMENT is entered into by and between THE FLORIDA FISH AND WILDLIFE CONSERVATION COMMISSION, whose address is 620 South Meridian St, Tallahassee, Florida 32399-1600, hereinafter referred to as the "COMMISSION,' and THE DISTRICT BOARD OF TRUSTEES OF TALLAHASSEE STATE COLLEGE, whose address is 444 Appleyard Drive, Tallahassee, FL 32304, hereinafter referred to as the "TSC or College."
The purpose of this Memorandum of Agreement is to establish an agreement between the parties to provide mutually beneficial support in their respective efforts to provide law enforcement training services to employees of the COMMISSION as provided by the TSC, Florida Public Safety Institute, hereinafter referred to as "FPSI".
Responsibilities of the Parties
The parties hereby agree to accept and undertake the following responsibilities assigned to them under this Agreement:
Both parties agree that cancellation of any reservation at least 48 hours prior to the check in date by email to the College, will cancel the COMMISSION's liability for payment of a reserved room. If cancellation email is not received from the COMMISSION, charges will be incurred for those dates. It is also the responsibility of the COMMISSION to send an early departure email when recruits, officers, and support personnel check out before the scheduled departure date on file. If the early departure email is not received 24 hours prior to the departures, the COMMISSION will be invoiced for the room charges.
Both parties understand and agree that the COMMISSION's recruits, officers, or support personnel who damage the property of TSC will be assessed a fee for said damage and/or property replacement. Notification will be made by the TSC to the COMMISSION of any reported damage or missing property upon discovery, but not later than 48 hours following the vacating of a room by COMMISSION personnel.
Both parties agree that the room card key issued to COMMISSION recruits, officers, and support personnel will also be used in the Dining Facility at FPSI to authorize meals for the bearer of the card that are paid for by the COMMISSION. FPSI will assume the responsibility for reissuing a card and programming the card for use in the Dining Facility, should a card become lost or stolen. However, FPSI reserves the right to assess a lost key card fee to each
COMMISSION recruit, officer, or support personnel of $15.00 on the third incident for a given card holder.
A. Responsibilities of TSC
1. TSC shall provide training services, materials, equipment, records, and facilities for the Florida Law Enforcement Academy and other in-service training services as requested and authorized in writing by the COMMISSION.
2. TSC shall provide the COMMISSION with documentation of the training services provided to each COMMISSION employee.
3. TSC agrees to prioritize housing reservations received from all agencies in the following order: (1) reservation request for basic recruits that will be enrolled through TSC as students; (2) reservation requests for officers attending continuing education training of any type at FPSI; (3) reservation requests for officers and support personnel attending any other training event, meeting, or official activity of any agency.
4. TSC agrees to provide itemized bills, detailing any and all services provided under this agreement to the COMMISSION. All itemized bills shall be submitted to the COMMISSION on a monthly basis (but no later than the 15th of each month) and in detail sufficient for a proper pre-audit and post-audit thereof. The COMMISSION agrees to reimburse TSC for all such bills on a timely basis in accordance with statutory requirements.
B. Responsibilities of the COMMISSION
1. The COMMISSION shall provide a Task Assignment Notification Form, Attachment A, to FPSI for each period services are needed, specifying the training services required by the COMMISSION, including the dates of the training; type of training; and the tuition, lodging, meals, and other services to be provided by FPSI. The Task Assignment Notification Form must be submitted at minimum one week prior to the requested start date of the training. The Task Assignment Notification Form will include the total cost for the training specified for each Task Assignment based on the costs stipulated in Attachment B, Rate and Fee Schedule.
The Task Assignment will specify the start and end date of the training. The Task Assignment Notification Form will be signed by the project manager, contract manager, and budget officer for the COMMISSION and contract manager for the FPSI and approved by the COMMISSION's designee. No Task Assignment is to begin without completion of the Task Assignment Notification Form. Change Orders to increase cost or add time for completion of the Task will be processed in the same manner using Attachment A1, Task Assignment Modification Form.
2. Rate and Fees schedules established herein as specified in Attachment B are based on tuition rates and student fees established pursuant to 6A-l4.054, Florida Administrative Code and are subject to change. Negotiated lodging rates and meals shall clearly demonstrate a cost savings from the rate as established in s.112.061, Florida Statutes.
Costs for Other Training Services , including instructor fees for any specialized training services requested by the COMMISSION, shall be mutually agreed upon by both parties.
3. The COMMISSION shall provide, as needed for planning and preparation purposes, electronic communication specifying the training services required by the COMMISSION which include but are not limited to tuition, lodging, meals, facilities to be used and other training services, to include a list of employees to receive training and the type of training to be provided by FPSI.

If such funds are not appropriated or available for the Contract purpose, such event will not constitute a default on behalf of the COMMISSION or the State, unless FPSI services have been provided.
