This is an Agency Term Contract (ATC) executed between the State of Florida, Department of Corrections (FDC), and Waste Management Inc. of Florida for the provision of non-regulated trash collection services to correctional institutions located in Regions 3 and 4 of Florida. The contract was executed on July 17, 2025, by the contractor and August 1, 2025, by the state. The contract was approved as to form and legality by Deputy General Counsel Kristen Clemons on August 1, 2025. The procurement was conducted through a competitive sealed bid process (ITB FDC-24-102) with a bid deadline of February 11, 2025. Service delivery locations include 17 correctional facilities and related work camps across central and south Florida, including Avon Park, Central Florida Reception Center, Hernando, Lake, Lowell, Marion, Polk, Sumter, Zephyrhills, Dade, Everglades, Homestead, and South Florida Reception Centers, as well as Miami North Community Release Center.
The contract provides for rental of various containers (ranging from 2-cubic yard to 96-gallon containers) with service frequencies between one and three times per week, depending on facility needs and container type. The initial contract term is three years from the date of execution, with renewal options for up to three additional years at renewal pricing. The awarded vendor, Waste Management Inc. of Florida, submitted a grand total price of $1,991.56 for Hernando Correctional Institution services as detailed in Exhibit B (Contractor's Pricing). Pricing is firm and includes all delivery, setup, fuel, maintenance, and disposal charges. The contractor must provide quarterly reports detailing total orders, dollar values, and items sold during each reporting period. Performance measures include timely completion of services and container delivery within agreed timeframes, with financial consequences of $100 per day assessed for each day services are delayed. The contract is subject to all mandatory certifications, including scrutinized companies requirements, drug-free workplace certification, forced labor attestation, foreign country of concern attestation, and vendor certification forms, along with compliance with security requirements, E-Verify registration, and public records retention obligations.
