Agency Term Contract Summary

This is an Agency Term Contract (ATC-24-012) between the State of Florida, Department of Corrections (FDC) and Bob Barker Company, Inc., for the provision of feminine hygiene products. The contract was executed on October 23, 2023, by the contractor and November 7, 2023, by the state. The FDC, as Florida's largest state agency with approximately 24,000 full-time employees and responsibility for incarcerating approximately 80,000 inmates across 143 facilities statewide, established this indefinite delivery vehicle to supply sanitary products to correctional institutions. The procurement originated from an Invitation to Bid (FDC ITB-23-055) advertised on July 11, 2023, with bids due August 15, 2023. The contract includes specified delivery locations across regions in central and south Florida, including Lowell CI, Florida Women's Reception Center, Orlando Work Release Camp, Hollywood Community Release Center, Homestead CI, South Florida Reception Center, and Hernando CI.

The contract provides for the supply of four feminine hygiene products: individually wrapped sanitary napkins with wings (2,844,000 units annually at $0.0616 per item), Always® daily liners (1,000,000 units annually at $0.0195 per item), Tampax® super absorbency tampons (750,000 units annually at $0.149 per item), and Tampax® regular absorbency tampons (750,000 units annually at $0.139 per item). The initial contract term is three years with potential renewal for up to three additional years at pricing specified in the contractor's submission. Pricing is firm throughout the contract term and includes all packaging, handling, and shipping. Products must be delivered Free on Board Destination within 30 days of purchase order issuance. The contract includes performance measures with financial consequences for late delivery ($50 per day) and failure to propose substitutions within 10 days of PO issuance ($50 per day beginning the 11th day). The contractor must provide quarterly reports detailing total orders, dollar values, and items sold. The contract requires compliance with security requirements for correctional institutions, e-verification of employees, background checks, insurance coverage, and adherence to the Prison Rape Elimination Act standards. Bob Barker Company, Inc., designated Betsy Copeland as the Contract Representative, with primary contract management through the FDC's Bureau of Procurement and Bureau of Security Operations.
