About this file

This is Amendment #002 to Agency Term Contract ATC-23-010 between the State of Florida, Department of Corrections (Department) and EP Consultants, Inc.-EPCI (Contractor). The amendment modifies the existing Building Code Plans Review and Inspection Services contract and incorporates four new attachments: Foreign Country of Concern Attestation (PUR1355), Vendor Certification Form (PUR7801), Use of Coercion for Labor and Services (PUR2024), and Business Associate Agreement for HIPAA. The amendment revises key contract sections including performance measures, subcontract requirements, and other conditions applicable to the indefinite delivery vehicle.

The contract requires EP Consultants, Inc. to provide Building Code Administrator (BCA) services including plan evaluations, permitting, inspections, and Certificate of Occupancy issuance for construction projects within the Department's facilities. The BCA must possess current Florida Department of Business and Professional Regulation certification and evaluate plans within ten business days of purchase order issuance, with inspections completed within two business days of request. Performance measures establish financial consequences for non-compliance, including daily penalties ranging from $25 to $100 per day for late proposal submissions, plan reviews, and inspections. The contractor must submit detailed monthly invoices by the tenth day following the service month and provide Certificates of Occupancy within five days of request. All subcontractors require prior written Department consent and must comply with security requirements and contract terms. The amendment also mandates compliance with HIPAA requirements, E-Verify regulations, public records laws, and various state procurement requirements including MFMP registration and Substitute W-9 forms.
