About this file

This document is a Traffic Signal Maintenance and Compensation Agreement between the Florida Department of Transportation (FDOT) and Glades County, specifically involving the maintenance and operation of traffic signals, interconnected and monitored traffic systems, and related devices on the State Highway System. The agreement is part of a standard process for local agencies to receive compensation for maintaining traffic infrastructure, with FDOT providing funding and oversight for traffic signal maintenance across various intersections and corridors.

The contract establishes compensation rates for fiscal years 2014-2019, with unit rates varying by device type such as traffic signals, pedestrian beacons, emergency signals, and warning displays. Compensation is calculated on a per-intersection basis and will be adjusted annually based on the Consumer Price Index (CPI). The agreement covers maintenance responsibilities including preventative maintenance, periodic inspections, repairs, and replacements of traffic signal components. The total compensation is structured as a lump sum payment, with provisions for potential reductions if maintenance performance benchmarks are not met. The contract has a 20-year term, with the ability to cancel with proper notice, and includes specific requirements for invoicing, performance monitoring, and compliance with state employment verification systems.

Please let us know how many of your traffic signal maintaining agencies have not signed the new Traffic Signal Maintenance and Compensation (TSM&C) agreement yet.

You can break it out by those that have not but indicate they will be and those that have simply said they are not signing it.

We will be approaching Management to get a hard date which, if agreements are not signed and received back to the Department by then, then we will not execute those until next fiscal year and they will not receive the additional compensation amounts for this fiscal year.

Please see if you can turn this around for me in say one week (1-5-16) as we want to have the info from you, get the date from Management, then give you time to inform the unsigned agencies of the approaching date cutoff for this fiscal year.

Hi Fred:

I recommend that we set a deadline for maintaining agencies to sign the new agreement.

At the district level, we still have to encumber the funds either for the old agreement or the new agreement (whatever it ends up to be) in order to compensate the agencies at close of this fiscal year. We are already late in the encumbrance process and the execution process takes time; in particular if the agencies have to go to the County board for approval.

Please advise. Thank you.

DTOE’s:

RE: Traffic Signal Maintenance and Compensation Agreements

Management has approved February 29, 2016 as the last day for signed agreements to be received from the maintaining agencies for us to execute the new agreements with the additional compensation under this year’s funds. Any signed agreements not received by then will be paid under their existing compensation rates and we can invite them to enter into the new contract after

July 1, 2016. We would not execute any further agreements received signed after February 29th until after July 1, 2016.

Please send letter to each maintaining agency that has not entered into the new agreement yet and let them know of the cutoff date and the funding amounts that they can expect to receive under their existing contract (no surprises). You could also include the amount they would receive for this FY if they submit the signed new agreement by the 29th.

After the 29th February, you are free to lock down your funding under whatever contract compensation rates are in effect for the respective agencies on or before that day.

This should help you and the agencies to make their choices accordingly.

Ok with February 29. Can the districts send a note to those who have not signed, so there are no surprises in funding amounts received?

Brian:

We have hundreds of maintaining agencies that have signed the latest agreement. However, we still have a few that have not (attached).

Due to funding and lockdown issues, we need a hard date that if the new agreement is not received by, then they will have to continue under the existing agreement for the remainder of this fiscal year http://www.dot.state.fl.us/agencyresources/anniversary/ http://www.dot.state.fl.us/agencyresources/anniversary/ and at the lower compensation levels. We could then offer that after July 1, they could enter into the new contract.

Thus, I propose February 29, 2016 as the date that if new agreement is not received signed from the maintaining agency, then we lockdown the funding at the old rate and not execute any further agreements received signed until after July 1, 2016.

Let me know if you are ok with this as our Districts are running out of time to lock down funds.
