DEP Contract No. SW 232, Task Assignment 14 Attachment A, Scope of Services

ATTACHMENT A

INDUSTRIAL DIVERS CORP. INC.

TASK ASSIGNMENT SW 232-14

SCOPE OF SERVICES

OSBORNE REEF WASTE TIRE ABATEMENT

The present scope of services is to implement abatement of 6,000 tires from the Osborne Reef and offload the abated waste tires into transport containers ready for pick up by the waste tire processor. The goal of the abatement is to protect the Osborne Reef, ultimately by removing those tires that are currently endangering the Reef, and also to prevent further endangerment to the living Reef and its surrounding habitat.

ABATEMENT AND SITE WORK

A. Support Vessel, Tow Vessel, and Crew

1) The Contractor shall provide a support vessel with current certificates of inspection capable of handling wind, weather, and sea conditions that are typical for southeast Florida during the late spring through fall for all work offshore. The support vessel shall be equipped with a real-time Differential Global Positioning System (DGPS) able to navigate to a specific site. The support vessel shall be capable of anchoring for work in 70 ft depth. However, anchoring on hard bottom is prohibited. The support vessel and the crew shall be licensed and approved by the U.S. Coast Guard for the scope of work required.

2) The Contractor shall provide all of the supervision, labor, and equipment necessary for raising tires from the sea floor and to load onto the vessel. Tires will remain on tire slings or cargo nets until they are offloaded into storage containers at the designated container offload location.

3) The support vessel will be anchored or spudded in the sand between the middle and outer reef tracts offshore Broward County in the vicinity of the tire field. Buoys will be used to mark the eastern edge of the middle reef (minimum of three) and the western edge of the outer reef (minimum of three). Anchoring method will be such that any vessel movement would not cause the support vessel to drift over the reef tracts to the east or west of the operations.

4) The support vessel will have a crane to lift tire bundles from the water.

5) At the designated tire removal area, divers will thread tires by hand onto slings made of polypro or polydac or into cargo nets. Once a sufficient number of tires are threaded, determined by the length of the slings or nets and capacity of the crane/hoist, both ends of the rope will be brought together and shackled to an appropriate size lift bag. Once secured, the lift bag will be inflated by a diver and sent to the surface. A tow vessel will then attach a line and tow the lift bag/tire bundle to the anchored support vessel, if needed.

6) To reduce any turbidity plume and sedimentation onto hard bottom, the tow vessel will secure the lift bag and bundle in as short a time as possible. Bundles should not be allowed to drift east or west past the reef edge marker buoys.

7) When the tow vessel and bundle reach the support vessel, the crane/hoist will be attached to the tire bundle, the tow rope released and the bundle lifted onboard. The slings or nets will be removed from the tires and all salvage equipment removed from the container.

8) The primary landing site for offloading of tires into containers will be Port Everglades.

9) If necessary the Contractor will coordinate with Port Everglades (Port) Harbor Master’s office for port transit, required dockage, access to Ro-Ro docks for offloading tires into containers and all other required activities. In order to maintain a satisfactory relationship with the Port, the Contractor must comply with all provisions of the Port Harbor Master and any special or unforeseen requests by the Port that may arise as a result of the salvage activities.

10) Contractor will coordinate as needed with the transportation/processing contractor for the coordination of the availablility of the containers.

11) Contractor will secure the work area so that intrusion into the entire work area by anyone other than the contractor approved personnel is not possible.

B. Navigation and Obstruction of Channels

1) The Contractor shall operate in full compliance with pertinent U.S. Coast Guard regulations and conduct the work in such a manner as to minimize any obstruction to navigation.

C. Commercial Diving and Underwater Operations

1) The Contractor shall operate in full compliance with pertinent U.S Coast Guard and Occupational Safety and Health Administration regulations regarding commercial diving operations

1) Should the Contractor, during the progress of the work, lose, dump, throw overboard, sink, or misplace any material or machinery, which in the opinion of the Department Contract Manager should be removed, the Contractor shall recover and remove the same with utmost dispatch. The Contractor shall give immediate notice, with description and location of such obstruction(s), to the Department Contract Manager. Should the Department Contract Manager discover such obstruction(s), the Department Contract Manager shall mark or buoy the obstruction(s) and notify the Contractor of its location. Removal of the obstruction(s) shall be the responsibility of the Contractor and the cost of the removal shall be the responsibility of the Contractor. Should the Contractor refuse, neglect, or delay compliance with the above requirements, such obstruction(s) may be removed by the Department and the cost of such removal shall be deducted from any money due or to become due to the Contractor.

F. Final Clean-Up

1) Final clean-up shall include the removal of the Contractor’s equipment and any material brought in to the salvage area.

G. Statutes, Laws and Regulations

1) The Contractor hereby agrees and shall be solely responsible for ensuring that the Contractor and any subcontractors make themselves fully aware of the requirements of any applicable ordinances, statutes, laws or Federal regulations, including but not limited to safety regulations, minimum wage regulations, and others. The Contractor further agrees the Department shall not be held responsible for ensuring compliance or notification on any changes or modifications to any such applicable ordinances, laws, statutes, rules, or regulations.
