Contract Summary
This is Amendment No. 1 to Contract No. LE706, executed between the Florida Department of Environmental Protection (DEP) and Cliff Berry, Inc., a hazardous waste management contractor located in Fort Lauderdale, Florida. The amendment, dated August 15, 2017, modifies the original contract that became effective June 21, 2016, for abandoned drum removal and emergency response services throughout Florida.
The amendment revises the Scope of Services (Attachment A-1), establishes a rate schedule for drop-off fees, updates the Work Authorization Form (Attachment C-1), and adds provisions for Transaction Fee payment requirements under the MyFloridaMarketPlace e-procurement system. The contractor is compensated at $200 per drop-off during business hours and $300 per drop-off outside business hours for non-mobilization activities. The contract requires the contractor to maintain 24-hour emergency response capability with six-hour on-site arrival time, 365 days per year, to handle abandoned drum incidents statewide involving one to ten drums per incident. The contractor must remain licensed as a hazardous waste transporter, possess field testing equipment (pH paper, vapor detector, field ignition test capability), maintain a Florida-registered hazardous waste storage facility, and comply with all federal, state, and local laws. Additional requirements include sample analysis per Department specifications, proper Chain-of-Custody procedures, and Site Safety Plan development. The contract remains in effect with all other original terms maintained unless inconsistencies arise, in which case the amendment provisions control.
