DEP Contract No. LE619 Amendment No. 5 Summary
This is the fifth amendment to an indefinite delivery contract between the Florida Department of Environmental Protection (FDEP) and EQ Florida, Inc. The original contract was executed on June 26, 2006, with previous amendments dated August 21, 2008, July 20, 2008, May 2, 2011, and June 30, 2015. The amendment modifies the existing contract between FDEP's Office of Emergency Response and EQ Florida, Inc., headquartered in Tampa, Florida, with Gene Cieply serving as the contractor's primary contact manager. The Department's contract managers are Melissa Woehle and Jonathan Lara at the FDEP Office of Emergency Response in Tallahassee.
Amendment No. 5 extends the contract completion date from June 28, 2016, to December 26, 2016, and revises key contract provisions including termination procedures, notice and communication protocols, public records management requirements, and audit and inspection authority. The amendment clarifies that the Department may terminate the contract for failure to fulfill obligations with 30 calendar days' written notice, or for convenience with 30 calendar days' notice. It establishes compliance requirements under Florida Public Records law (Chapter 119, F.S.), requiring the contractor to maintain records accessible to the Department and its authorized representatives, and imposes standards for record retention, protection of exempt and confidential materials, and electronic storage in formats compatible with the Department's information technology systems.
