About this file
The document details the termination of Agency Term Contract GC803 between the Florida Department of Environmental Protection (FDEP) and Enviro-Pro-Tech, Inc. (EPT), specifically within the Petroleum Restoration Program. The termination notice, dated December 19, 2017, was issued by F. Joseph Ullo, Jr., Director of the Division of Waste Management, and was sent to Bernie Weimer, Contract Manager at Enviro-Pro-Tech. The contract termination was effective as of close of business on March 30, 2018, following previous notices from the department in July and September 2017.
The contract termination notice outlines specific requirements for final invoicing and project completion. EPT was allowed to complete only current tasks with active purchase orders, with all deliverables to be submitted by March 2, 2018. The department mandated that only one final invoice would be accepted per open purchase order, which must be accompanied by a Subcontractor Utilization Form and a notarized Affidavit/Release of Claims Form. Additionally, the company was required to provide supporting documentation of payments to all subcontractors and vendors, including copies of cleared checks or electronic bank verification. The termination was conducted under the "convenience" clause of the contract, with the contractor entitled to recover only amounts earned for authorized completed deliverables.

Mr. Bernie Weimer Contract Manager Enviro-Pro-Tech, Inc.
Dear Mr. Weimer:
The Division of Waste Management has not received additional information regarding items identified in Report A-1617DEP-031 from the DEP Office of Inspector General as required in the September 26, 2017 letter from DEP to Enviro-Pro-Tech, Inc (EPT). This correspondence serves as the required 30 calendar days written notice, pursuant to Paragraph 23.B. of the Agency Term Contract, that GC803 with EPT will be terminated, effective close of business Friday, March 30, 2018.
All work assignments to EPT will be reassigned via the ATC Selection Process. EPT may complete the current task in progress only for assignments with an active purchase order or work order and submit the specified deliverable for that task and any previously completed tasks to the Department by Friday, March 2, 2018 to allow time for review, approval and invoicing.
The suspension of any new project assignments, new purchase orders and new work by change order on existing purchase orders, as set forth in the July 28, 2017 and September 26, 2017 notices from the Department, in accordance with Section 22 of the contract will remain in effect. Exceptions for necessary changes to facilitate transition for sites with leased equipment will be considered on a case by case basis.
Sincerely, F. Joseph Ullo, Jr. P.E., Director Division of Waste Management

Rebecca <Rebecca.Robinette@dep.state.fl.us> Subject: Notice of Final Invoicing Requirements for Termination of Contract GC803
Mr. Weimer, In follow up to the Department’s December 19, 2017 contract termination notice to Enviro- Pro-Tech, Inc. (EPT), effective close of business Friday, March 30, 2018, the following final invoicing requirements shall apply to all open purchase orders (POs) under contract GC803.
Contract GC803 is being terminated for convenience as defined in paragraph 23.B. of the Amended and Restated Agency Term Contract. In accordance with paragraph 23. B. the Contractor is entitled only to recover amounts earned for authorized deliverables completed.
Contrary to references in paragraphs 7.A. and 7.D., interim invoices will no longer be accepted for work under GC803.
The Department will accept only one additional invoice for each open PO. This invoice shall be the final invoice for the PO accompanied by the Subcontractor Utilization Form for Commodities/Services and an executed and notarized Affidavit/Release of Claims Form certifying that all subcontractors and suppliers have been paid in full. In addition, supporting documentation of payment to all subcontractors and vendors whose costs have been included in the final and any prior invoices for the PO must be provided with this final invoice and include copies of cleared checks or other electronic bank verification. Cleared check documents should include both the front and back copies of the check, which clearly specifies the payee name, date, amount, and the date the check cleared the bank. If other electronic transfer payments were made, these should be supported by bank statements indicating the same information as that for cleared checks. Confidential account numbers and other sensitive information must be redacted prior to sending. Invoices that are not in conformance with the requirements outlined above shall not be approved or paid.
Pursuant to paragraph 7. D. of the Agency Term Contract, the Contractor shall submit invoices to Department within thirty (30) days after the date of Department’s written approval and failure to submit the invoice within this timeframe may result in Contractor’s forfeiture of any unpaid balance for such deliverables. Although interim invoices are no longer accepted under GC803, final invoices still must adhere to this timeframe. Failure to submit final invoices within this timeframe may result in forfeiture of any unpaid balance.
