Contract Summary

This is a Florida Department of Environmental Protection (DEP) Agreement for Storage Tank System Compliance Verification Program, Contract No. GC708, between the DEP and the Florida Department of Health, St. Johns County Health Department (Contractor), effective July 1, 2007 through June 30, 2017. The contract establishes a local government program to conduct compliance inspections and enforcement activities for storage tank systems regulated under Florida Chapters 62-761 and 62-762, F.A.C., within St. Johns and Flagler Counties. The Contractor is responsible for performing inspections, issuing noncompliance letters, conducting Level 1 enforcement actions, and administering the compliance verification program using the FIRST (Florida Inspection Reporting for Storage Tanks) database system. All inspection and enforcement work must comply with DEP guidance documents and applicable Florida statutes.

The contract specifies that compensation is determined by individual Task Assignment Notification Forms issued on a fixed-price, lump-sum basis for each twelve-month performance period. Monthly invoices are submitted by the 15th of the following month and processed within established timeframes. The Contractor must maintain qualified staff at Environmental Specialist I or higher levels, provide health and safety training within eight months of employment, and achieve 100 percent completion rates for assigned activities as outlined in each Task Assignment. Performance is assessed monthly with specific completion benchmarks (33 percent by month four, 66 percent by month eight, 100 percent by month twelve). Cost recovery penalties of up to 8.3 percent may be assessed for non-compliance with performance levels or financial reporting requirements. Equipment purchases exceeding $1,000 are not authorized without prior DEP approval, and the Contractor must maintain separate accounting records and provide annual financial statements within 45 days of invoice submission.
