About this file

This is Amendment No. 3 to DEP Contract No. GC697, a contract between the Florida Department of Environmental Protection (DEP) and the Florida Department of Health, Pinellas County Health Division. The contract was originally executed on June 4, 2007, with previous amendments dated December 19, 2008, and February 17, 2012. The amendment was executed on April 11, 2013, with DEP Contract Manager William E. Burns, Jr. authorized to execute the modification. The contract manager is identified as responsible for oversight and administration of the contract on behalf of the Department.

Amendment No. 3 modifies the payment structure and operational requirements for storage tank inspection services. The contract shifts from a fixed-price model to a fee-schedule basis, with compensation determined on a per-task assignment basis in accordance with rates specified in each executed Task Assignment. The amendment establishes that all inspection activities must utilize the Florida Inspection Reporting for Storage Tanks (FIRST) database and equipment, and requires field inspectors and enforcement personnel to complete scheduled storage tank inspector training courses and pass examinations. The contractor is responsible for determining accurate latitude and longitude coordinates for inspected facilities and entering data into the DEP inspection database. Monthly invoicing is required using the Contractual Services Invoice form, with submission due no later than the 15th of the following month, and a final invoice must be submitted prior to task completion. The contractor must provide year-end financial statements by October 1, 2012, for the period July 1, 2011 to June 30, 2012. The amendment includes restrictions on prohibited entities and activities, requiring disclosure of any conflicts of interest within five days of discovery, and grants the DEP the right to terminate the contract or reassign contractor employees based on conflict-of-interest determinations.
