This is an Agreement for Storage Tank System Compliance Verification Program between the Florida Department of Environmental Protection (DEP) and the Florida Department of Health, Okeechobee County Health Department, operating as the contractor under DMS Class/Group 091-320 with Procurement Method Single/Sole Source. The contract was effective July 1, 2007, through June 30, 2017, with potential renewal for an additional term not exceeding three years. The contractor is based in Okeechobee, Florida (FEID No. 59-3502843), with Harry Moldenhauer as primary contact. The DEP Contract Manager is Marshall Mott-Smith, located at the Bureau of Petroleum Storage Systems in Tallahassee. This is a state-funded indefinite delivery contract with no federal funds supporting the services, and no equipment purchases or land acquisitions are authorized.
The contractor is responsible for administering a storage tank compliance verification and inspection program for Okeechobee and Highlands Counties under Chapters 62-761 and 62-762, F.A.C., and Section 376, F.S. Services include performing compliance inspections at regulated facilities, discharge inspections, closure inspections, installation inspections, and Level 1 enforcement actions through noncompliance letters and re-inspections. The contractor must enter all inspection data into the FIRST database and maintain facility files until closure plus five years. Performance requirements include completing 33 percent of inspections by month four, 66 percent by month eight, and 100 percent by month twelve of each task assignment period. Monthly invoices are submitted on a fixed-price basis as outlined in executed Task Assignment Notifications, with compensation not to exceed amounts negotiated in each task assignment. Payments are processed through the Southeast District Office in West Palm Beach, with the DEP reserving the right to withhold payment if performance standards are not met or if corrective action plans are not implemented. The contractor must maintain separate accounting for program funds, comply with all federal, state, and local regulations, and provide annual year-end financial statements within forty-five days of invoice payment.
