Contract Summary

This is Amendment No. 2 to DEP Contract No. GC678, a state and local contract indefinite delivery vehicle executed on July 24, 2007, between the Florida Department of Environmental Protection (DEP) and Miami-Dade County. The amendment, executed on August 21, 2012, and subsequently approved on August 14, 2012, modifies the original agreement for the Storage Tank System Compliance Verification Program in Miami-Dade County. The contract is authorized under Miami-Dade County Resolution No. R-796-07, which authorized the County Mayor or designee to execute the agreement with DEP. William E. Burns Jr. serves as the DEP Contract Manager responsible for contract execution and oversight.

The amendment fundamentally restructures the method of payment from fixed price to a fee schedule basis, wherein DEP compensates the contractor on a monthly invoice basis at rates specified in each executed Task Assignment. The fee schedule encompasses all costs necessary to perform work, including labor, fringe benefits, overhead, supplies, travel, and non-expendable personal property or equipment costing less than $1,000, with compensation not to exceed the amount specified in each Task Assignment. Key operational requirements include performance of routine compliance inspections and required re-inspections using the Florida Inspection Reporting for Storage Tanks (FIRST) database, attendance at mandatory inspector training courses, determination of accurate facility coordinates using DEP-approved procedures, submission of monthly Statement of Revenue, Expenses and Fund Balance reports, and utilization of the U.S. Department of Homeland Security's E-Verify system for employment verification. The contractor retains ownership of non-expendable personal property or equipment purchased under the contract; however, vehicles purchased with state funds remain under contractor use only for contract purposes, with title transferring to DEP upon contract termination or completion. The amendment also establishes conflict-of-interest provisions prohibiting the contractor from engaging in business relationships with prohibited entities, including those regulated by or responsible to DEP pursuant to Florida statutes.
