Contract Summary

This is an indefinite delivery/indefinite quantity (IDIQ) contract between the Florida Department of Environmental Protection (DEP), Bureau of Petroleum Storage Systems, and Earth Tech, Inc., a California corporation. The contract, designated GC574, was executed on April 20, 1997, with an initial task assignment authorization period of five years from the execution date. The contractor is authorized to provide petroleum contamination site cleanup services on a task assignment basis in accordance with DEP Solicitation No. 9901C and the contractor's response thereto.

The contract provides for compensation on a combination fixed price and cost reimbursement basis as specified in each Task Assignment Notification form. Services are authorized and funded on a per-task basis, with no minimum amount of work guaranteed. The contractor must comply with the Petroleum Cleanup Preapproval Program Standard Operating Procedures Manual (November 1997) and supplemental information dated January and October 1998. Labor rates and other factual unit costs are detailed in Attachment C, including hourly rates for various occupational categories, equipment rental rates, and laboratory analytical rates from subcontractors PC&B Environmental Laboratories, Inc., Southern Research Laboratories, Inc., and ENCO Laboratories. The contract specifies that the contractor must award 25% of work described in the contract to State certified small and minority businesses, and fringe benefits, overhead, general and administrative costs, and fee are calculated at 194% of direct labor. All contract adjustments for inaccurate or incomplete wage rates must be made within one year following contract completion. The Department reserves the right to terminate the contract for convenience with thirty days' written notice and may renegotiate rates annually, with either party required to initiate renegotiation sixty days prior to the anniversary date.
