TASK ASSIGNMENT

CAT POINT LIVING SHORELINE

The Florida Department of Environmental Protection (“DEP”) has selected Taylor Engineering, Inc.

(“Consultant”) to provide professional services for the Deepwater Horizon Natural Resources Damage Assessment (“NRDA”) Phase III Early Restoration Project, Cat Point Living Shoreline (“Project”) located off the water ward end of Millender Street, Franklin County, Florida within Apalachicola Bay in an area commonly known as Cat Point. Specifically, the project area is centered offshore of the Apalachicola National Estuarine Research Reserve (“ANERR”) Environmental Education and Training Center. This Task Assignment (“Task Assignment”) is issued pursuant to DEP Bureau of Design and Construction (“BDC”) Contract No. CN026 (“Contract”).

Background

As part of the Deepwater Horizon NRDA Early Restoration Program, DEP selected the Consultant to provide professional services for the Project, which is located within Apalachicola Bay just offshore of Cat Point in the vicinity of the ANERR facility. The Project is to construct two (2) segmented breakwater systems that will expand existing structures near the ANERR facility and create salt marsh habit between the breakwater system and the shoreline. The area of the Project was impacted by the Deepwater Horizon oil spill and its related cleanup efforts. This Task Assignment describes the tasks to be completed by the Consultant, including surveying, design, permitting, and limited construction administration services to develop construction documents for the Project. Since the Project is a NRDA Phase III Early Restoration project, it has been previously assessed and determined to be in compliance with the requirements of the National Environmental Policy Act.

Reporting Requirements

The Consultant shall submit monthly progress reports which indicate the work performed during the reporting period, work scheduled for the next reporting period, problems encountered and resolutions of the problems, and any schedule updates. This monthly report shall be provided to the DEP Project Manager within five (5) business days of the close of each proceeding month at no additional cost to DEP.

Additional Services

The Consultant may be requested to provide other professional services related to the Project, as deemed necessary by DEP, based on the availability of funding. Based on DEP’s ability to negotiate a satisfactory price, DEP reserves the right to amend this Task Assignment to include additional services related to the Project’s planning and design, bidding assistance, and construction administration as may become necessary.

Project Construction Documents

The Consultant shall prepare preliminary and final design plans, specifications, and cost estimates illustrating all technical components and requirements for the construction of the Project. An original copy of all final design documents, drawings, and other articles to meet all requirements of DEP, including the DEP BDC’s Contract with the Consultant, this Task Assignment, and any subsequent amendments, DEP Agreement No. CN026, Task Assignment #1, Page 2 of 12 shall be provided to the DEP Project Manager upon completion of the work. These original articles shall contain all original signatures and professional seals as necessary. At a minimum, the Consultant shall provide three (3) complete sets of all documents and drawings and one (1) complete set of documents, drawings and other articles that are reproducible to the DEP Project Manager. Reproducible narrative documents and other articles shall be clear and legible, on eight-and-one-half by eleven-inch (8-1/2” x 11”) paper, and shall not be bound or stapled. Reproducible drawings shall be of a paper from which Xerox type copies can be made. The Project documents and drawings shall also be provided on CD-ROM for bidding purposes.

Project Description The Project consists as follows:

A northern breakwater segment extending approximately 670 feet (offshore of the undeveloped shoreline) between the Bayshore Trailer Park and the existing breakwater that partially fronts the DEP-owned property on Millender Street. A southern breakwater segment shall extend approximately 800 feet south from the southern end of the existing breakwater offshore of the ANERR facility and an approximate 170-foot central breakwater segment, offshore of Millender Street, between the two existing breakwater structures. A saltmarsh habitat shall be created, in the lee of the structures (i.e., the area of reduced wave energy). The proposed breakwater structures would be constructed with rip-rap and/or bagged oyster shell, and the structure crest elevation shall be between the Mean Low Water Line (MLWL) and the Mean High Water Line (MHWL) with a crest width of approximately five (5) feet.

Assumptions

The Consultant has made several assumptions in developing this scope of services and associated fees for the Project. The assumptions affect the proposed level of effort and associated costs. If any of the assumptions should prove incorrect, the Consultant will submit a proposal to modify its scope of services and fees accordingly.

Tasks and Deliverables

Task 1 – Initial Site Visit and Kick-Off Meeting

Description: The Consultant will perform background investigations, perform an initial site visit and conduct a Project kick-off meeting to be held in the ANERR facility located on 108 Island Drive, East Point, Florida. The Consultant, DEP Project Manager and select ANERR staff will participate in the site visit and will also be in attendance during the kick-off meeting. The purpose of the site visit and kick-off meeting is to assess the current conditions at the Project site; review the initial plan for development of the Project;

Task 4 – Natural Resource Investigations

Description: If required by the regulatory agencies and authorized by the DEP Project Manager, the Consultant will perform natural resource investigations to complete the preliminary design documents and environmental permitting phases of the project as follows:

Sub-Task 4.1 Natural Resource Investigations Survey (NRS): If required by the regulatory agencies and authorized by the DEP Project Manager, the Consultant shall perform a NRS to characterize and map existing vegetation communities and habitat conditions along and immediately adjacent to the Project area shoreline. The habitat characterization work will be limited to the shoreline and immediately adjacent areas that may be impacted during construction of the Project.

Sub-Task 4.2 Submerged Aquatic Vegetation Survey (SAV): If required by the regulatory agencies and authorized by the DEP Project Manager, the Consultant will perform a SAV survey in accordance with DEP requirements to characterize and map SAV and other submerged resources (e.g., oysters) within the Project area. The Consultant will use the results of the SAV survey to develop a preliminary breakwater design that avoids impacts to SAV or other submerged resources.

The SAV survey area shall be of the nearshore area extending from the MHWL to approximately 100 feet seaward of the existing shoreline (or until the landward edge of vegetation) along the 0.3-miles of shoreline where structures are proposed. This proposed SAV survey area will extend approximately 50 feet beyond the boundaries of the proposed shoreline stabilization activities (in both the alongshore and offshore directions), based on the proposed structure locations described in the project Fish and Wildlife Service ESA consultation report. The SAV survey area may encompass additional distance from the shoreline should structures be placed further seaward at the northern end of the project area to connect with the existing shoreline and structures within this area. Since construction is proposed to be from land-based equipment, surveys of additional offshore areas for barge/equipment corridors will not be proposed.

The SAV survey will employ qualitative and quantitative methods accepted by the state and federal regulatory and resource agencies. No additional environmental data collection or analyses other than those stated herein shall be provided. Should additional environmental data collection or analyses be required from the reviewing agencies (e.g., water or sediment quality investigations), it will be addressed as an additional service to this Task Assignment.

Deliverables Sub-Tasks 4.1 – 4.2: If required by the regulatory agencies and authorized by the DEP Project Manager, the Consultant shall provide to the DEP Project Manager a NRS report, which will incorporate

DEP Agreement No. CN026, Task Assignment #1, Page 7 of 12 the SAV survey, to document the survey findings and verify that all required elements are included and to ensure satisfactory completion of the services rendered. The report will include photographs and graphics as necessary to describe existing natural resource habitat conditions within the proposed project area as described above. The NRS report will aid in the development of the preliminary design (Task 5) and provide required data for future regulatory permitting (Task 7).

Performance Measures Sub-Tasks 4.1 – 4.2: The DEP Project Manager shall review the NRS report, which will incorporate the SAV report, to verify that all required elements are included and to ensure satisfactory completion of the services rendered. The DEP Project Manager shall notify the Consultant of any deficiencies in the deliverable(s) and shall give the Consultant reasonable opportunity to correct noted deficiencies and provide a revised deliverable(s).

Schedule Sub-Tasks 4.1 – 4.2: If required by the regulatory agencies and authorized by the DEP Project Manager, the Consultant shall perform the NRS (4.1) and SAV (4.2) within four (4) weeks, pending weather, following the pre-application meeting (Task 2). The Consultant will notify DEP Project Manager of any reasonable delays and when actual date of mobilization to the site occurs. The actual date of the NRS will depend on guidance from regulatory staff and weather conditions. SAV surveys are typically required to occur between June and September. NRS report(s) shall be submitted to DEP Project Manager for review within three (3) weeks following the field surveys.

Fixed Price Cost Sub-Tasks 4.1 – 4.2: $13,328.88 (includes Labor $12,078.88 and Direct Expenses for Travel $1,250.00) Direct Expenses: Direct expenses subject to reimbursement shall not exceed $1,250.00. (Note:

Reimbursement of direct expenses shall be supported by copies of invoices or paid receipts. No mark-ups shall be allowed on direct expenses. Travel expenses and per diem must be documented by a State

Task 5 – Preliminary Engineering Design

Description: The Consultant will prepare a preliminary segmented breakwater design for Project permitting. Major components of the preliminary engineering design shall include analysis of coastal conditions and definition of design parameters, structural design of the breakwater components, and the plan-view layout of the breakwater(s). During the kick-off meeting (Task 1) and prior to the preliminary design, the Consultant will seek direction from DEP and ANERR staff regarding the Project design criteria.

Sub-Task 5.1 Coastal Conditions Analysis: The Consultant will conduct a coastal conditions analysis to define key design parameters such as wave characteristics and storm surge elevations at the Project site utilizing background data collected in Task 1, as well as existing site-specific information such as tidal datums, historic storm surge elevations and wind records, critical fetch lengths, and existing bathymetric data. Utilizing historic wind records and Apalachicola Bay bathymetry, we will perform empirical wave modeling to determine probable wave characteristics (e.g., wave heights and periods) during varying-level storm events. These data collection efforts and analyses provide the information necessary to perform preliminary engineering design of the shoreline stabilization structures (e.g., crest height, slopes, DEP Agreement No. CN026, Task Assignment #1, Page 8 of 12 orientation, etc.) and allow ANERR staff to accurately assess the risks associated with varying design conditions and alternatives.

Sub-Task 5.2 Preliminary Engineering Design: Based upon the results of the coastal conditions analysis, the Consultant will perform preliminary engineering design analyses for the proposed segmented breakwaters. The FWS ESA consultation documents state that the proposed breakwater structures should be emergent (crest elevation between the MLWL and the MHWL), with approximate dimensions as follows: crest width of 5 feet, length of 70 feet, gap length up to 25 feet, and distance to shoreline 30 feet.

The consultation result documents the northern segmented breakwater shall be constructed of rock or rip-rap and have a total length of approximately 690 feet and the southern structure shall be constructed of bagged oyster shell with a total length of approximately 750 feet. During the preliminary design, the Consultant will adhere to the general constraints of the design provided in the consultation results;

however, the optimal design may require alteration of the previously proposed design. The Consultant will aim to minimize the structure footprint and the total volume of rock required, therefore, decreasing construction costs and maximizing the total length of protected shoreline. The analysis will focus on readily available materials (e.g., limestone rock rip-rap, bagged oyster shell, and/or recycled concrete) as opposed to larger granite armor stones to further reduce the potential construction costs.

The Consultant will perform an iterative coastal engineering analysis to assess variable structural cross-sections and plan-view layouts against a range of probable design conditions. The structural analysis will provide the general structure details (crest width, footprint, structure slope, and rock size) for these varying conditions. The layout of the structures in plan-view will provide details such as distance from the shoreline, crest length, and gap length between structures. The plan-view design, based on general empirical guidance and wave transmission through and over the segmented breakwater system, will be critical for the success of the salt marsh in lee of the structures.

Sub-Task 5.3 Opinion of Probable Construction Costs (OPCC): The Consultant will prepare an OPCC for the preliminary design(s). The OPCC will comprise a list of major items with associated quantities and unit costs. The Consultant will apply internal and external data to develop a cost opinion for each major Project element. This OPCC will provide the DEP Project Manager and ANERR staff with an initial budget estimate, which will be used to determine the amount of work that can be completed utilizing the funds available for the Project.

Deliverables Sub-Tasks 5.1 – 5.3: Once the preliminary engineering design has been completed, the Consultant will coordinate with the DEP Project Manager and schedule a meeting with the DEP Project Manager and ANERR staff to review the preliminary design(s) and receive comment. The Consultant will make one revision to the preliminary design to incorporate those comments received from the DEP Project Manager and ANERR staff, where feasible, and further develop the preferred concept. The Consultant will prepare a revised preliminary design based upon the comments received during the review and submit to the DEP Project Manager. This revised version of the preliminary design will serve as the basis for Project permitting

Performance Measures Sub-Tasks 5.1 – 5.3: The DEP Project Manager shall review the final preliminary design and OPCC to verify that all required elements are included and to ensure satisfactory completion of the services rendered. The DEP Project Manager shall notify the Consultant of any deficiencies in the deliverable(s) and shall give the Consultant reasonable opportunity to correct noted deficiencies and provide a revised deliverable(s).

DEP Agreement No. CN026, Task Assignment #1, Page 9 of 12

Schedule Sub-Tasks 5.1 – 5.3: The Consultant shall commence Task 5 services upon completion of Tasks 1 - 4. The Consultant shall prepare the recommended preliminary design within eight (8) weeks of commencement of Task 5, and the final preliminary design within two (2) weeks of conducting the review meeting with the DEP Project Manager and ANERR staff.

Fixed Price Cost Sub-Tasks 5.1 – 5.3: $14,537.98

Task 6 – Tidal Exchange Analysis

Description Task 6: If required by the regulatory agencies and authorized by the DEP Project Manager following the completion of Task 2, the Consultant shall perform a hydrographic assessment to demonstrate that the proposed structure(s) do not adversely affect tidal exchange within the project area.

Given the relatively shallow water, close proximity of the structures to the shoreline, and the restorative nature of the Project, the Consultant will prepare a simplified tidal exchange analysis to satisfy the regulatory agency’s tidal exchange/hydrodynamic requirements. The tidal exchange/hydrodynamic study will include running an empirical tidal exchange analysis of the proposed structure(s) to determine the tidal exchange within the lee of the structures for mean tide conditions. The Consultant will also review the hydrodynamic or similar tidal assessment(s) employed for the existing breakwater structures and utilize this information for further Project support. The Consultant makes no assurances the Project as proposed will meet regulatory requirements. Should the proposed structures not meet the state agency flushing requirements, the Consultant will advise the DEP Project Manager and ANERR staff on possible remedies. Should subsequent flushing analyses be required to address other designs then an amendment to this Task Assignment may be necessary.

Deliverables Task 6: If required by the regulatory agencies and authorized by the DEP Project Manager, the Consultant shall provide to the DEP Project Manager a report summarizing the methods and results of the tidal exchange analysis. The deliverable will include all necessary detail typically required for regulatory permitting. The Consultant does not guarantee regulatory agency staff will deem the study complete. Should additional work be required, the Consultant will submit a proposal to modify the scope of services and fees accordingly.

Performance Measures Task 6: The DEP Project Manager shall review the summary report to verify that all required elements are included and to ensure satisfactory completion of the services rendered. The DEP Project Manager shall notify the Consultant of any deficiencies in the deliverable(s) and shall give the Consultant reasonable opportunity to correct noted deficiencies and provide a revised deliverable(s).

Schedule Task 6: If required by the regulatory agencies and authorized by the DEP Project Manager, the Consultant shall commence Task 6 services upon completion of Task 5. The Consultant shall submit the analysis and summary report within four (4) weeks of commencement of Task 6.

Fixed Price Cost Task 6: $4,578.32

DEP Agreement No. CN026, Task Assignment #1, Page 10 of 12

Task 7 – Regulatory Permitting

Description: The Consultant shall prepare complete permit applications for all state and federal permits required to construct the Project and submit to the appropriate regulatory agencies (e.g. DEP, USACOE or the Northwest Florida Water Management District (NWFWMD)). The work under this task shall include

1) the development of permit drawings in the format required by the regulatory agencies for review and

2) completion of the required forms accompanied with sufficient narrative to support the application.

Any fees associated with the applications will be the responsibility of the DEP.

Sub-Task 7.1 Permit Drawings: Once the preliminary designs (Task 5) have been developed and approved by the DEP Project Manager, the Consultant will prepare permit drawings depicting:

Existing conditions, including property boundaries, existing bathymetry and topography, MHWL, structures, and natural resources (identified during previous investigations);

Preliminary structural design sections and details for the offshore breakwaters/oyster habitat;

Shoreline restoration layouts including preliminary design sections and planting/stabilization details; and Proposed environmental protection measures (turbidity curtains, erosion control measures, etc.).

The Consultant will complete the preliminary permit drawings and provide them to the DEP Project Manager and ANERR staff for review and comment. The preliminary permit drawing submittal will provide two sets of eight-and-one-half by eleven-inch (8-1/2” x 11”) paper plots and corresponding digital format drawing files in PDF format. The Consultant will incorporate the comments from the DEP Project Manager and ANERR staff on the preliminary drawings and make any necessary changes to produce final permit drawings.

Sub-Task 7.2 Regulatory Permit Applications: The Project will require an Environmental Resources Permit (“ERP”) issued by DEP or NWFWMD and a U.S. Department of the Army Dredge and Fill Permit from the USACOE. Since DEP and ANERR are the upland property owners, the DEP Project Manager will provide direction to the Consultant as to whether the NWFWMD or DEP will lead the state permitting effort. The Consultant will then develop a joint ERP application that includes the information necessary for state and federal agencies to perform their technical review and public processes. The application, in addition to the permit drawings, will also include narratives describing the project design, purpose and need; project best management practices (BMPs); avoidance and minimization measures; natural resource analyses; tidal flushing analyses (if required); and construction methodology and schedule. The application will include as attachments, the findings from previous tasks such as the natural resource survey report and tidal exchange analysis.

The Consultant will provide copies of the completed application(s) to both the DEP Project Manager and ANERR staff for review and approval prior to submitting to the lead state and federal regulatory agencies.

It will be the responsibility of the lead agencies to distribute the application packages to all other appropriate commenting agencies (e.g. USFWS, National Oceanic and Atmospheric Administration (NOAA), Florida Fish and Wildlife Conservation Commission (FWC)).

Deliverables Sub-Tasks 7.1 – 7.2: The Consultant shall provide to the DEP Project Manager the permit application package (including the joint ERP application, permit drawings, and supporting documents as described in sub-tasks 7.1 and 7.2).
