About this file

This document contains a class justification and approval for other than full and open competition and a related federal contract opportunity notice. The class J&A was approved on July 29, 2019 by the Senior Procurement Executive to acquire the Switchblade Weapon System from AeroVironment, Inc. on a sole-source basis under authority of FAR 6.302-1 for only one responsible source. The J&A allows for award of two contracts from FY2019 to FY2022 for Switchblade hardware production and contract logistics support. The hardware contract is estimated at $187.2 million for a one-year base and two option years beginning 1QFY20 with a mix of fixed price and cost reimbursement terms. The logistics contract is for a one-year base and two options beginning 3QFY20 using cost reimbursement. Funding will come from various military appropriations and other DOD sources. The related opportunity is for the Switchblade hardware production contract W31P4Q-20-C-0024 awarded on April 30, 2020 to an unknown vendor for an unknown amount to provide the current solution for lethal miniature aerial missile systems to the warfighter.

Department of Army FAR PART 6 Class Justification and Approval (J&A) for Other than

Full and Open Competition for Switchblade Weapon System (SWS) Requirements Fiscal Year (FY) 2019-2022

1. Contracting Activity: Department of the Army, Army Contracting Command Redstone (ACC-R), CCAM-TM-J, Redstone Arsenal, AL 35898.

2. Description of Action: The Close Combat Weapon System (CCWS) Project Office requests approval to award two new contract actions, using this Class J&A, to allow the United States Government (USG) to procure and maintain the SWS

The contractor for all awards will be AeroVironment (AV), 900 Innovators Way, Monrovia, CA 93065, Commercial and Government Entity (CAGE) Code 60107.

AV is a self-certified small business with a primary North American Industry Classification System (NAICS) Code of 336411 (Aircraft Manufacturing), size standard of 1500 employees. The contract may also provide for foreign military sales (FMS) requirements, not source directed for SWS. The anticipated type of funds are discussed below to include FMS.

The FY2019-2021 contract to be awarded is for SWS hardware production. The hardware contracts will be a hybrid mix of 98% Firm Fixed Price (FFP) with the remainder of the requirements being Cost Plus Fixed Fee (CPFF) and Cost Reimbursable (ODC/Travel). The Government anticipates award of the hardware production contract to occur in 1st Quarter 2020.

The second contract to be awarded is for SWS Contract Logistics Support (CLS). The CLS contract will be CPFF and Cost Reimbursable (ODC/Travel) as the work will be· performed under a Performance Work Statement. There are several variables in the repairs and service actions that would put undue burden and increased risk on the Goyernment if they were to be awarded as FFP contracts; therefore, it has been determined that a CPFF contract type is the most suitable for the CLS requirement. The Government anticipates the award of the CLS FY2020-2022 contract to occur in 3rd

Quarter 2020·.

Funding for the FY2019 through FY2022 SWS actions will be provided by the applicable U.S. customer. The contracts may contain various types of funding to include appropriated funds and reprogrammed funds: RDT&E (Army, Navy, Air Force, Office of the OSD); Procurement, Missiles (Army, Navy, Marine Corps, Air Force); Procurement, Other (Army, Navy, Air Force, and OSD); Operations and Maintenance (Army, Navy, Marine Corps, Air Force, and OSD); FMS, DOD Working Capital funds and other potential.DOD funding.

Contractor: AeroVironment Inc.

Program/Equipment: Switchblade Weapon System

Approval

Based on the foregoing class justification, I hereby approve the procurement of the Switchblade Weapons System contract actions during FY2019 through FY2022 with AeroVironment, Inc., CAGE Code 60107, on an Other than Full and Open Competition basis pursuant to the authority of Title 10, U.S.C. 2304(c)(1 ), as implemented by FAR Part 6.302-1 (a)(2)(ii)(A)&(B) and (iii)(A)&(B), "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements." The total estimated value for this class J&A is $187,227,484. The period of performance for the hardware production contract will be for one base year and two option years estimated to begin 1 QFY20. The Contractor Logistics Support contract will have a period of performance of one base year and two option years estimated to begin 3QFY20. The approval is subject to availability of funds, and provided that the services and supplies herein described have otherwise been authorized for acquisition.
