CJ&A 20-0053

These impending procurements will include the necessary tasks to support the airworthiness certification·s and flight clearances requirements for the C-27J baseline aircraft configuration, as well as the C-27J Missionization Suite (MS) configuration, aircraft design, integration, and installation T &E engineering services to allow full integration of the HC-27J MS into the C-271 aircraft.

This CJ&A is a follow-on to J&A 16-0510, CJ&A 16-0510, Amendment 1, and CJ&A 16-0510, Amendment 2, approved on 19 October 2016, 06 February 2018, and_t 3 May 2019, respectively.

This CJ &A provides the additional ceiling required for the remaining procurements identified herein to be awarded against BOA N68335-l 8-G-OO 14, as the ceiling of CJ&A 16-0510, Amendment 2 was underestimated.

3. Description of Supplies/Services.

As discussed in Section 2 above, this CJ&A is for the engineering technical services and supplies to support airworthiness, T&E, and NRE tasking required to missionize the C-27J aircraft into the HC-27J configuration. It is anticipated that each delivery order will have a Period of Performance (PoP) of twenty-four (24) months.

The resultant delivery orders and delivery order modifications associated with the above will be awarded at an aggregate value of $37M and will be funded

4. Statutory Authority Permitting Other Than Full and Open Competition.

The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(l), Only one responsible source and no other supplies or services will satisfy agency requirements, implemented in regulation in FAR 6.302-1 (Only one responsible source and no other supplies or services will satisfy agency requirements).

5. Rationale Justifying Use of Cited Statutory Authority.

This CJ&A covers the efforts required to meet the new NAV AIR airworthiness certification process that went into effect in January 2019. Neither the USCG nor NAV AIR possess any of the analytical data with respect to the aerodynamics, structural, or aircraft operating software for the missionization of the C-27J Aircraft. LAD is the only source that has the knowledge, expertise, and data rights to implement the necessary changes and provide the necessary

Page 2 ofS documentation to the DAAA supporting the airworthiness process to provide the military type certification for the aircraft.

Currently, as the Government is required to follow the new airworthiness certification process, the T &E scope will increase as these two areas are integrally related. The T &E process must follow the airworthiness path to produce the necessary artifacts needed for the airworthiness certification. This will require a larger involvement of LAD during the test flight phase of the certification at NAS in Patuxent River, Maryland. The T &E requires LAD to use its proprietary data rights involving the Operation Flight Program (OFP) software and aircraft interfaces. Any time these systems are modified, LAD would need to ensure all systems continue to function as intended. If this effort were not awarded to LAD, the Government would be at risk of incurring an extensive reverse engineering design cost which would not expected to be recovered through competition.

The data rights were only related to limited structural data to support lifestyle fatigue analysis of the aircraft and have an approximate price- The Government is estimating that the data rights for the engineering design and software data consisting of structural data and models has an approximate price of- If the Government purchased the data rights, the cost associated with hiring, utilizing, and maintaining the data, performing design work, followed by the integration, testing, and certification work would be equivalent to standing up an entire program office. The new team of engineers, program managers, and staff would be expected to do the following:

• Document the C-27J baseline aircraft flight characteristics to define the aircraft engineering baseline;

• Sufficiently understand the engineering data to be able to certify the fidelity of their analytical models that will be used to perform the aircraft modification; and,

• Produce sufficient flight test data and/or analytical model complexity/fidelity that can be used to verify the analytical analysis of the changes/modifications.

Finally, after all aircraft modifications are installed, the aircraft will have to be airwo1thiness certified. Without the use of LAD and foreign airworthiness organizations, the aircraft would have to be domestically certified. Because the aircraft is heavily modified and foreign produced, there is no clear path to airworthiness using the Federal Aviation Administration. Based on the information provided herein, the program would incur a significant schedule delay of at least 24 months.

In summary, as discussed above, the !mown cost and schedule impacts to the Government for selecting a vendor other than LAD for the necessary supplies and services identified in this CJ&A are follows:

• Initiating the OFP software design integration, specific requirements as well as the level of design/ software coding required is estimated between In addition to the increased cost, schedule is expected to be delayed by approximately 24-30 months. These estimated impacts are based on the C-27J Missionization and the USCG C-27J Cockpit Study data.

• Purchasing structural data and models from LAD is estimated at - However, it is highly doubtful that LAD would sell this data, but the cost would be enough to replace futur,e business related to C-27 Cockpit.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

In accordance with FAR 5.20l(a), NAWCAD Lakehurst posted two (2) Requests for Information (RFls), N68335-20-RFI-0065 and N68335-20-RFI-0065A, for the additional requirements authorized by this CJ&A on betaSAM.gov on 20 November 2019 with a response date of 25 November 2019 with NAICS 336411 and PSC 1680, and NAICS 541130 and PSC R425, respectively.

-In accordance with FAR 5.204, NAWCAD posted two (2) pre-solicitation synopses N68335-20-R-0065 and N68335-20-R-0065A, on betaSAM.gov on 27 November 2019 with a response date of 12 December 2019 with same set of codes as the RFis.

7. Determination of Fair and Reasonable Cost.

In accordance with FAR 15.402, the Contracting Officer shall ensure that all supplies and services provided under this contract are procured at a fair and reasonable price. The Contractor will submit a formal price proposal with certified cost or pricing data and sufficient information to support the accuracy and reliability of the estimate. LAD's proposals will be reviewed by experienced technical analysts, cost analysts, _and contract specialists with the aid of necessary field pricing support. The Contracting Officer will utilize cost and price analysis as the basis for negotiating a fair and reasonable price for .each procmement.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Section 5; NAWCAD Lakehurst does not intend to compete future contracts for the types of supplies and services covered by this CJ&A at this time. If another potential source emerges, NA WCAD Lakehurst will assess whether competition for future requirements is feasible.
