The total value of this action is not estimated to exceed the Simplified Acquisition Threshold of

$250,000.00. The estimated value of this requirement is $124,429.95

Identification of statutory authority permitting the restriction of consideration to a brand name:

The procurement shall be conducted as open market under FAR Part 13 – Simplified

Acquisition Procedures. The Contracting Officer (CO) documented the basis of limiting competition for this brand name purchase in accordance with FAR 13.106-1(b). The justification will posted with the RFQ.

Supporting rationale (for the authority cited in the paragraph above) including a demonstration that the proposed brand name’s unique features or the nature of the acquisition requires the use of the authority cited:

This requirement is for a technical refresh in support of JTF-N located at Fort Bliss, TX. It is to update the aging, unsupported infrastructure and embed it in the current unique Cisco-centric configuration platform. The specified Cisco and Sound Control Technologies hardware is required to be incorporated into the current JTF-N uniquely configured virtual teleconferencing solution. Also, the specified Cisco and Sound Control Technologies hardware is required for connectivity within the Ft. Bliss Network Enterprise Center (NEC) domain. The hardware provides an approved and accredited domain access environment in order to meet mission video teleconferencing requirements for JTFN. The required use of the Cisco and Sound Control

Technologies hardware will ensure JTFN periodic incremental augmentation of hardware and software update continues to preserve the mission critical performance characteristics under increased user and data volumes. In addition, the DoD has agreements in place to specifically provide DoD units Cisco device support at no or reduced costs as part of its Joint Enterprise

License Agreement architecture.

Currently, JTFN does not have a qualified replacement that can fit into their customized environment that will not restrict, diminish nor cripple the agency’s capabilities. As such, the

Cisco and Sound Control Technologies hardware is considered to be essential to the JTFN’s requirements and no other alternative product would meet their mission needs at this time.

Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable:

The Contracting Officer will utilize any price analysis technique available that will demonstrate price fairness and reasonableness. One specific technique that will be utilized is the direct comparison of competitive quotes received in response to the solicitation. However, if only one vendor provides a quote, other techniques such as comparisons to published prices lists or a comparison of the vendor’s proposed price with the historical prices paid from previous purchase orders by Government or commercial entities will be utilized.

Any other facts supporting this justification:

All facts supporting this justification have been provided above.

A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the brand name restriction before any subsequent acquisition for the supplies or services is made:

Until another manufacturer’s product is found to be compatible within the JTFN’s existing Cisco network, the Government will continue to purchase Cisco and Sound Control Technologies hardware. The Government will continue to review products and solutions provided by other manufacturers by conducting continual market research.

The Contracting Officer’s certification that the justification is accurate and complete to the best of the Contracting Officer’s knowledge and belief:

By signing this Justification and Approval for Brand Name, the Contracting Officer is certifying that they have determined this document to be both accurate and complete to the best of their knowledge and belief.

Evidence that any supporting data that is the responsibility of technical or requirements personnel (e.g., verifying the Government’s minimum needs or requirements or other rationale for restriction to brand name) and which form a basis for the justification have been certified as complete and accurate by the technical or requirements personnel.

By signing this Justification and Approval for Brand Name, the Technical Representative is certifying that they have determined this document to be both accurate and complete to the best of their knowledge and belief.

A written determination by the approving official that the circumstances in 13.106-1(b)(1) applies to the order.

By signing this Justification and Approval for Brand Name, the approving authority determined that the circumstances identified in this document are accurate; therefore, limiting sources under

FAR 13.106-1(b)(1) is justified.

Technical Representative’s Certification:

I certify that the supporting data under my cognizance, which is included in this justification, is accurate and complete to the best of my knowledge and belief.

JTFN Support Chief

HQ Joint Task Force - North

13.106-1(b)(1). The information contained in this justification is accurate and complete to the best of my knowledge and belief.
