About this file

This is a Competition Impracticable Procurement Authorization (SPO Form 101) from the Arizona Department of Administration's State Procurement Office, involving the Arizona Department of Child Safety (ADCS) and Arrow Development. The document is a request to extend a contract for kitchen operations and food preparation services at the ADCS Maricopa Welcome Center, with Lex Sargento, Chief Procurement Officer, as the primary requestor.

The contract covers kitchen operations and food preparation services, providing three meals daily for youth temporarily housed at the Welcome Center. The current contract was initially awarded to Healthy Chef in November 2022 for a one-year term, with a total estimated cost of $394,800 per year. The procurement seeks a six-month extension from 1/23/26 to 6/23/26 due to concerns about the contractor's performance, including issues with staff payment, fingerprint clearance cards, and operational challenges. The extension will allow ADCS to maintain service continuity and execute a new competitive solicitation, with the Office of Procurement and Contracts planning to approach Arrow Development to outline the current scope of work with time-based deliverables.

Text11: The service was solicited in November 2022, with only one offer received, and awarded to Healthy Chef, contract number (CTR063951). The initial one-year contract was effective 1/22/2023, renewable for one-year terms with a maximum end date of 1/21/2028.

The Department took action by issuing a formal Demand for Assurance (DFA) to address concerns regarding allegations of non-payment of staff and the validity of fingerprint clearance cards on file. The contractor’s response was satisfactory and the DFA was closed on 7/2/24, with one of the fingerprint card applications pending appeal. The application pending appeal is for the owner of the contracted vendor, and it is the Department’s understanding that is likely the appeal will be denied.

Section 5.1.4 of the Scope of Work via (CTR063951) requires the Contractor to ensure that all employees, independent contractors, subcontractors, volunteers and other agents comply with all applicable (current and future) legal requirements per State and Federal guidelines. This includes requirements impacting contract performance as it relates to the Central Registry Background Check, fingerprint clearance cards, certifications regarding pending of past criminal matters, and criminal records checks. ADCS requirement for successful fingerprinting to provide service to children is jeopardized.

Subsequent Vendor Performance Reports were submitted on 7/31/24 and 8/6/24 detailing unsatisfactory operational performance from the staff at the Welcome center as well as the documentation of mounting legal issues and concerns including another arrest of the owner Mr. Jonathan Allen. There are uncertainties of the contractor conducting it’s daily business activities at the Welcome Center and meeting their contractual obligations.

It is in the best interest of the State and the children we serve to allow an extension for an additional six months, ensuring uninterrupted service for the youth at the Welcome Center. This continuity will provide much-needed stability for both the children and staff, as Arrow Development can maintain kitchen operations with minimal disruption.

The six-month extension will also allow the Department sufficient time to execute a competitive solicitation process.

Additional time is necessary to ensure the evaluation committee has adequate opportunity to thoroughly review submitted proposals. This timeline is further impacted by limited staff availability during the holiday season, making it prudent to extend the current arrangement to maintain operational continuity.

Text12: It is in the best interest of the State and the children we serve, to allow the extension for an additional six months on, so the children can continue receiving service. The extension will also allow the Department to execute a solicitation within the period of the executed Competition Impractical.

Granting an additional six month extension will also allow the Department the time necessary to for a fluent competitive procurement process. With additional time, the Department can broaden outreach to potential vendors, refine the scope of work, and ensure that all interested parties have adequate time to prepare comprehensive proposals. This will help attract a wider pool of qualified bidders, increase competition, and ultimately result in better value and service outcomes for the State.

The Office of Procurement and Contracts will approach Arrow Development to outline the current scope of work with time-based deliverables to continue the kitchen operations.

Text15: This is a 6 month extension from a CI signed on 1/14/2025 (see below)
