Amendment 002

1. A list of firms represented at the site visit on December 5, 2011 is provided in Attachment A to this amendment.

2. RFP Part I, section entitled “Overview of the Solicitation, is hereby revised to read as follows:

“Overview of the solicitation

This is a request for Proposals (RFP) issued by the Commodity Futures Trading Commission, an independent agency of the federal government. The contract that results from this RFP will include executed Standard Form 1442 (first page of the RFP) as well as the remainder of the RFP and RFP attachments, with appropriate insertions to reflect the negotiated terms of the contract. Instructions for preparing and submitting proposals are provided in RFP Part VIII, and proposal evaluation criteria are provided in RFP Part

IX.

The contract for construction will be a lump sum contract between the contractor and the CFTC. Payments to the Contractor shall be made in part by CFTC from appropriated funds and in part by the Sublandlord, Brown Brothers Harriman, from the tenant improvement allowance. Federal Acquisition Regulation (FAR) clauses implementing the Prompt Payment Act shall apply to payments made by CFTC but not to payments made by the Sublandlord. The Sublandlord will make payments after receiving authorization from CFTC.”

3. RFP Part V, Clause 1, is hereby revised to read as follows:

“1. Payments made by the Sublandlord - CFTC’s obligation under this contract is limited to the amount of funding obligated to the contract as shown in Block 23 on Standard Form 1442. The remainder of the contract amount shall be paid by the Sublandlord, Brown Brothers Harriman, from the tenant improvement allowance under terms of the sublease with CFTC. The Sublandlord will make payments after receiving authorization from CFTC. CFTC will provide such authorization to the Sublandlord no later than 30 days after receiving an Application for Payment that meets all requirements of this contract.”

4. RFP Part VIII, Clause 5 (F), Price, is hereby revised to read as shown below (Attachment

B to this amendment lists the add/alternate equipment referred to in the revised clause):

“F. Price

The Offeror shall propose a lump sum price with a breakdown of costs as described in Attachment A to the RFP.

Certain audio visual equipment that is identified in the specifications shall be broken out and priced as add/alternate in the proposal. The add/alternate equipment is listed in Attachment B to RFP Amendment 002.

If the Offeror is a HUBZone small business, it shall state whether or not it waives the price evaluation preference described in FAR 52.219-4, Notice of Price Evaluation Preference for HUBZone Small Business Concerns.”

5. The following section provides questions and answers regarding the RFP:

Q1: Can different vendors be awarded a phase?

A1: No. There will only be one award for the entire project. Also, the subcontractors must be the same for all phases.

Q2: Is the solicitation being advertised to union subcontractors?

A2: The solicitation is published on a public website and is therefore available to everyone. However, all trades performing work must be union per the requirements of RFP Attachment C.

Q3 Does CFTC have a budget for each Phase?

A3: No.

Q4: Who pays for after hour work permits?

A4: The Contractor

Q5: What are the DBE subcontracting goals?

A5: There are no pre-established goals for small disadvantaged business participation.

The offeror must propose goals that will be evaluated by the Government (see RFP Part VIII, Section 5(E).

Q6: Can New York certified MBE and WBE participation apply to these goals?

A6: The only classes of small business eligible for credit under RFP Part VIII, Section

5(E) are those designated by the US Small Business Administration (SBA) and except where self-certification is permitted, only the SBA can certify the small business status of an individual firm (see FAR Part 19 for further information regarding SBA programs).

Q7: Is testing of the existing sprinkler system required?

A7: Contractor is required to test the system as required by code

Q8: What type of fire proofing is required at the site?

A8: There is no preference but Offerors must submit specifications on what fireproofing they propose to use.

However, part of the funding may be provided by the sublandlord, Brown Brothers Harriman, through the tenant improvement allowance in which case the landlord will make those payments.

Q14: The list of equipment to be bid as “add/alternate” does not indicate phase or location. How are costs to be provided in the bid?

A14: These costs do not need to be identified by phase.

Q15: All work is to be straight time. What about the floor below and above the work?

Are they occupied? If so, will related work be performed on overtime or as straight time?

A15: Any work that must be performed after hours because it is required: 1) by building rules, 2) to work in another tenants space, or 3) is noisy, gives off fumes, etc. should be priced accordingly and is the contractor’s responsibility, Q16: Please advise if all light fixtures are to be salvaged prior to demolition?

A16: Light fixtures in the expansion areas are not to be salvaged.

Q17: Can alternative material be used for fabric panels?

A17: Yes. Refer to the substitution requirements in the specifications.

Q25: I noticed on the drawings on Phase I the following drawings were included in the download but not on the index: TE 6003 and TE 6004. On Phase III the following drawings were included in the download but not on the index: TA 1020 and TA 1519. Please advise.

A25: The drawings available for the download are correct and should be included in the set. The drawing index will be updated once the project is awarded.

Q26: In the solicitation for the above-referenced proposal, on page 35, D. Past

Performance and Experience it states: “Offerors shall provide 5 client references for projects completed within the past three years that were similar in scope, magnitude and complexity to work described in this solicitation.” Due to economic impacts on the construction industry as a whole, the frequency of contracts let for projects similar in scope, magnitude and complexity have been significantly reduced. Will you consider references for such projects that have been completed within the past five years?

A26: CFTC will not change this requirement to include projects completed within the past five years. However, Offerors should provide whatever projects they have that most closely approximate the scope, magnitude and complexity of the project described in the RFP.

Q27: Who will be responsible for warranties of the AV equipment if it is furnished by the Government?

A27: The A/V vendor shall be responsible to coordinate any work involving the manufacturer’s warranties on any new equipment furnished by CFTC. The vendor will also be required to warrant its work.
