JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
REQ. NO. ZEROREQ-CF0-18-0001
1. Nature and/or description of the action being approved.
This is a justification to solicit, negotiate and award an Indefinite-Delivery, Indefinite- Quantity (IDIQ) contract to obtain CGI Momentum® software licenses and related support services for the NRC's CGI Momentum®-based core financial system (also known as the NRC'S Financial Accounting Information and Management System (FAIMIS)) on a sole source basis. This is a follow-on contract to General Services Administration (GSA) Federal Supply Schedule Contract No. GS-35F-4797H, Order No. NRC-HQ-12-F-09- 0001 under for CGI Momentum® licenses and Contract No.
NRC-HQ- 11-G-33-0059, Order No. NRC-HQ-12-T-09-0001 for services.
2. Description of the supplies or services required to meet the agency's needs
(Including the estimated value).
The NRC requires CGI Momentum® software licenses for FAIMIS, which uses a customized version of CGI Momentum® Enterprise Resource Planning (ERP) software to satisfy the NRC's core financial system requirements. The contract will be IDIQ because the Government cannot predetermine the precise quantities of supplies or services that the Government will require during the contract period; however, a recurring need is anticipated. . Task orders will then be negotiated on an as-needed basis for FAIMIS licenses and support. The contract will consist of a base period of one year (starting on or about January 25, 2018) plus four one-year options to extend the term of the contract. The maximum value of the contract will be $31,225,760.
3. An identification of the statutory authority permitting other than full and open competition.
The statutory authority for this procurement is 41 U.S.G. 3304(a)(1), as implemented in Federal Acquisition Regulation (FAR) 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.
4. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited.
CGI Federal, Inc. currently hosts and supports FAIMIS for the NRC to satisfy the NRC's core financial system, which is based requirements. FAIMIS is hosted in an external FedRAMP-compliant cloud environment. FAIMIS also interfaces with NRC legacy applications as well as Federal e-gov solutions. CGI Federal, Inc. does not authorize any other commercial sources to provide CGI Momentum® software licenses and related support services that the NRC requires to operate and maintain FAIMIS. Therefore, the only way that the NRC can satisfy its requirements for this acquisition is to procure them directly from CGI Federal, Inc.
The NRC has invested a considerable amount of resources (7 years and approximately $80 million) in FAIMIS, which has been customized to meet the NRC fee billing collection requirements that are outlined in the agency's annual Fee Policy rule. To conduct a competitive acquisition in a manner that would allow other solutions to compete and potentially result in acquiring a different brand of an ERP solution or service would require years of acquisition planning, procurement and implementation, and considering the fact that the NRC invested $2 million to upgrade FAIMIS in fiscal year 2017, the NRC has not fully recognized a reasonable return from that investment. . Hence, the NRC intends to continue to use customized CGI
Momentum® ERP software until such time that it is prepared to conduct a competitive acquisition to replace FAIMIS.
5. A description of the efforts made to ensure that offers are solicited from as many potential sources as practicable. Indicate whether a FedBizOpps notice was or will be publicized as required by FAR Subpart 5.2 and, if not, which exception under FAR 5.202 applies.
The NRC posted a Special Notice on FedBizOpps regarding its intent to solicit, negotiate and award a contract to CGI Federal, Inc. for CGI Momentum® software licenses for the NRC's core financial system, as well as hosting, operations and maintenance and help desk support services for that system was posted in Federal Business Opportunities (FBO) website (see https://www.fbo.gov/spg/NRC/OA/DCPM/CF0-18-0001/listing.html). The NRC did not receive any responses to that notice.
6. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
The contracting officer will perform price analysis for IDIQ contract line items and will only award a contract if the prices are determined to be fair and reasonable. The contracting officer will also perform price analysis on individual task orders and only award them if the price is determined to be fair and reasonable. The contracting officer will rely, in part, on the Independent Government Cost Estimate, historical data, published prices and fixed hourly rates to the extent that they are available as well as their professional judgment in making that determination.
7. A description of the market research conducted (see FAR Part 10) and the results, or a statement of the reasons market research was not conducted.
The contracting officer recently confirmed though market research that CGI Federal, Inc. does not authorize any other commercial sources to provide the CGI Momentum® software licenses and related services that the NRC requires. Therefore, the only way that the NRC can satisfy its requirements is to directly procure them from CGI Federal, Inc.
8. Any other facts supporting the use of other than full and open competition.
None
9. List sources, if any, that have expressed, in writing, an interest in the acquisition.
None
10. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services required.
The contracting officer will periodically perform market research to determine if the required software licenses and support services could be competitively procured in the commercial marketplace and, if so, will work with the program office to only exercise the options in the contract that must be exercised before the competitive action can be awarded and the services transitioned, if necessary. The NRC may also consider procuring core financial services from other agencies if and when another agency is http://www.fbo.gov/spg/NRC/OA/DCPM/CF0-18-0001/listing.html) determined to be able to satisfy the NRC's core financial system requirements and the NRC's requirements could be obtained more economically by using that acquisition method.
