About this file
This is a contract specification document prepared by Kimley-Horn and Associates for Tarrant County Community Development Department and the City of Grapevine for roadway reconstruction improvements on Eckley Street (400 block from E. Walnut Street to E. Worth Street). The project is funded through a Community Development Block Grant (CDBG) in the county's 51st year of funding, identified as Project Number B-25-UC-48-0001-30-75. The work includes asphalt and concrete paving improvements, site preparation, erosion control, traffic control, landscaping, drainage, curb and gutter installation, sidewalk construction, and utility adjustments. Bids were due by 10:00 A.M. on Wednesday, August 12, 2026, with public opening and reading of bids at the Tarrant County Community Development Division office located at 2501 Parkview Drive, Suite 420, Fort Worth, Texas 76102. The contractor must commence work within ten days of receiving the Notice to Proceed and substantially complete all work within 180 calendar days from the start date. A bid security of five percent of the bid amount is required, and the apparent low bidder will be announced approximately two working days after the bid opening.
The contract is awarded to the lowest responsive and responsible bidder based on unit prices with extensions calculated by the engineer. Base bid items include mobilization, project allowance of $40,000, erosion control, tree protection for eleven trees, general site preparation, geotechnical stabilization evaluation, unclassified excavation (50 cubic yards), embankment (50 cubic yards), asphalt paving (approximately 1,150 square yards across multiple courses), concrete sidewalks (220 square yards), concrete curb and gutter (640 linear feet), topsoil (70 cubic yards), sod (560 square yards), and miscellaneous utility and drainage adjustments with a landscape and irrigation restoration allowance of $8,000. All quantities listed are approximate and subject to change at the engineer's discretion, with changes not to exceed twenty-five percent of the original contract amount without written authorization. The contractor must furnish performance bonds, payment bonds, and two-year maintenance bonds for the full contract amount, maintain comprehensive insurance coverage listing Tarrant County and the City of Grapevine as additional insureds, and comply with all federal requirements including Davis-Bacon wage rates, Build America Buy America Act (BABA) provisions, HUD Section 3 employment requirements, and anti-boycott statutes. The project is subject to federal procurement standards, prevailing wage determinations, and requires compliance with environmental regulations and equal employment opportunity requirements.

BID BOND
1. RECEIPT AND OPENING OF BIDS
The COUNTY OF TARRANT (herein called the "Owner"), invites bids on the form attached hereto, all blanks of which must be appropriately filled in. Bids will be received by the OWNER at the office of TARRANT COUNTY COMMUNITY DEVELOPMENT DIVISION until 10:00 A.M., Wednesday, August 12, 2026 and then at said office publicly opened and read aloud. The envelopes containing the bids must be sealed, addressed to TARRANT COUNTY COMMUNITY DEVELOPMENT DIVISION at 2501 PARKVIEW DRIVE, SUITE 420, FORT WORTH, TX 76102 and designated as Bid for RECONSTRUCTION OF ECKLEY STREET (E. Wanut Street to E. Worth Street).
The OWNER may consider informal any bid not prepared and submitted in accordance with the provisions hereof and may waive any informalities or reject any and all bids. Any bid may be withdrawn prior to the above scheduled time for the opening of bids or authorized postponement thereof. Any bid received after the time and date specified shall not be considered. No bidder may withdraw a bid within 60 days after bid opening.
2. PREPARATION OF BID
Each bid must be submitted in a sealed envelope bearing on the outside the name of the bidder, his address and the name of the project for which the bid is submitted. If forwarded by mail, the sealed envelope containing the bid must be enclosed in another envelope addressed as specified in the bid form.
3. METHOD OF BIDDING
The Owner invites bids for the work described in the Contract Documents. Bidders shall submit a base bid based on the unit prices listed in the Proposal. The total bid shall be determined from the completed Proposal submitted by the bidder. In the event of a discrepancy between until prices, extensions or totals, the unit prices shall govern, and the Engineer will correct the extensions and totals accordingly during tabulation. Where alternates are included in the Proposal, bidders shall provide prices for each alternate as indicated. Alternates may be accepted or rejected by the Owner at the Owner’s discretion.
4. QUALIFICATION OF BIDDER
The Owner will make such investigations as he deems necessary to determine the ability of the bidder to perform the work, and the bidder shall furnish to the Owner all such information and data for this purpose as the Owner may request. The Owner reserves the right to reject any bid if the evidence submitted by, or investigation of, such bidder fails to satisfy the Owner that such bidder is properly qualified to carry out the obligations of the contract and therefore to complete the work contemplated herein. Conditional bids will not be accepted.
NTB-1
5. BID SECURITY
Each bid must be accompanied by a certified check of the bidder, or a bid bond, issued to Tarrant County, duly executed by the bidder as principal and having as surety thereon a surety company approved by the Owner, in the amount of 5% of the bid. Such checks or bid bonds will be returned to all except the three lowest bidders within thirty days after the opening of bids and the remaining checks or bid bonds will be returned promptly after the owner and the accepted bidder have executed the contract or, if no award has been made within sixty days after the date of the opening of bids, upon demand of the bidder at any time thereafter, so long as he has not been notified of the acceptance of his bid.
6. LIQUIDATED DAMAGES FOR FAILURE TO ENTER INTO CONTRACT
The successful bidder, upon his failure or refusal to execute and deliver the contract and/or bonds required within 10 days after he has received notice of the acceptance of his bid, shall forfeit to the Owner, as liquidated damages for such failure or refusal, the return of the bid bond and a claim shall be filed with the surety.
7. TIME OF COMPLETION AND LIQUIDATED DAMAGES
Bidder must agree to commence work on or before a date to be specified in a written "Notice to Proceed" by the Owner and to fully complete the project within the specified time as stated in the proposal.
8. CONDITIONS OF WORK
Each bidder must inform themselves fully of the conditions relating to the construction of the project and the employment of labor thereon. Failure to do so will not relieve a successful bidder of his obligation to furnish all material and labor necessary to carry out the provisions of his contract. Insofar as possible, the Contractor, in carrying out his work, must employ such methods or means as will not cause any interruption of or interference with the work of any other contractor.
9. ADDENDA AND INTERPRETATIONS
No interpretation of the meaning of plans, specifications, or other pre-bid documents will be made to any bidder orally. Every request for such interpretation shall be in writing, addressed to the engineer using the delivery system set up for the distribution of the plans and specifications, whether that be digital or hard copy distribution, and to be given consideration, must be received at least five days prior to the date fixed for the opening of bids. Any and all such interpretations and any supplemental instructions will be in the form of written addenda to the specifications which, if issued, will be distributed to all prospective bidders through the contact information provided by each individual bidder, not later than the opening of bids. Failure of any bidder to receive any such addendum or interpretation shall not relieve the bidder from any obligation under his bid as submitted. All addenda so shall become part of the contract documents.
NTB-2
10. SECURITY FOR FAITHFUL PERFORMANCE
Upon receipt of the executed contract, the Contractor shall furnish a surety bond or bonds as security for faithful performance of this contract and for the payment of all persons performing labor on the project under this contract and furnishing materials in connection with this contract, as specified in the General Conditions included herein. The surety on such bond or bonds shall be a duly authorized surety company satisfactory to the Owner.
11. POWER OF ATTORNEY
Attorneys-in-fact who sign bid bonds or contract bonds must file with each bond a certified and current copy of their power of attorney.
12. NOTICE OF SPECIAL CONDITIONS
Attention is particularly called to those parts of the contract documents and specifications which deal with the following:
a. Inspection and testing of materials
b. Insurance requirements
c. Wage rates
d. Stated allowances
e. Build America, Buy America Act (BABA)
f. All governing Federal regulations
13. LAWS AND REGULATIONS
The bidder's attention is directed to the fact that all applicable State laws, municipal ordinances and the rules and regulations of all authorities having jurisdiction over construction of the project shall apply to the contract throughout, and they will be deemed to be included in the contract the same as though herein written out in full.
14. BID EVALUATION AND CONTRACT AWARD
The evaluated bid shall consist of the base bid together with any alternates selected by the Owner. In accordance with federal procurement standards, the Owner reserves the right to determine the combination of base bid and alternates that will be used to identify the lowest responsive and responsible bidder. The Owner may accept or reject any alternates, in any order or combination, based on what best serves the interests of the Owner and the project. Conditional bids will not be accepted.
If, at the time the contract is to be awarded, the lowest evaluated bid from a responsive and responsible bidder does not exceed the amount of funds the Owner has estimated as available to finance the contract, the contract will be awarded to that bidder. If all bids exceed the available funds, the Owner may reject all bids.
-END OF NOTICE TO BIDDERS- See Additional Instructions to Bidders NTB-3
INSTRUCTIONS TO BIDDERS
1. All bids will be opened and awarded based on the applicable provisions of the Texas Local Government Code, as well as any and all other applicable laws.
2. Contractor shall submit the original of the bid proposal to the Owner prior to bid opening.
3. A copy of all opened bids will be made available for inspection by anyone desiring to see them.
4. Owner is entitled to reject any and all bids.
5. Contractor shall calculate and enter the extension for each line item (unit price × quantity). Contractor shall NOT calculate or enter a grand total of all line items on the original bid form. The Engineer will perform the overall summation of all line‑item extensions after the bids have been tabulated.
A total bid amount may be written on the As‑Read Bid Summary sheet for convenience during the public opening. This total is for read‑out purposes only and does not constitute the official bid.
6. Unit and lump sum prices must be shown in words and figures for each item listed in the proposal. In the event of a discrepancy:
a. Words control over figures.
b. Computational and/or mathematical errors will be corrected by the Engineer, and the corrected amount will control over the erroneous amount in determining the bid price.
7. A bid that has been opened may not be changed for the purpose of correcting an error in the bid price.
8. Compensation ultimately paid on this unit price contract will be based on the actual quantities of work performed and accepted. This includes, as applicable, any extra work or changes authorized in accordance with the Contract Documents and Specifications.
Miscellaneous allowances are Owner-controlled allowances. No work shall be performed under any allowance, and no payment shall be made from any allowance, without prior written authorization from the Owner. The cost of allowance work, extra work, and changes will be determined in accordance with the Contract Documents and Specifications, as provided for Extra Work and Change Orders.
Instructions to Bidders Page 1 of 2
9. Unit prices for similar items in the base bid and deductive alternate must be equal.
Miscellaneous allowance amounts are pre-filled by the Engineer and shall not be altered, modified, or replaced by the bidder. Any bid that changes an allowance amount may be deemed non-responsive.
10. At the time of the opening of bids each bidder will be presumed to have inspected the site and to be thoroughly familiar with the plans and Contract Documents and Specifications, including all addenda. The failure or omission of any bidder to examine any form, instrument, or documents shall in no way relieve the bidder of any obligation with respect to the bid. Submission of a signed proposal constitutes acknowledgement of these obligations.
11. It is understood that the quantities of work to be done at unit prices are approximate only and are intended principally to serve as a guide in evaluating bids. Any change order shall require approval by the Commissioners Court of Tarrant County.
It is further agreed that the quantities of work to be done at unit prices and the materials to be furnished may be increased or decreased as may be considered necessary, in the opinion of the Engineer, to complete the work fully as planned and contemplated, and that all quantities of work, whether increased or decreased, are to be performed at the unit prices set forth, except as otherwise provided in the specifications. The Owner reserves the right to increase or decrease the amount of work to be done by any amount not to exceed twenty-five percent (25%) of the original contract amount.
In the event an increase pertains to items not originally bid, the Contractor shall submit a written price proposal to the Engineer for review. No such extra work shall be performed unless it has been ordered in writing by the Engineer and approved in writing by the Owner prior to performance of the work, in accordance with the Contract Documents.
It is further agreed that lump sum prices may be increased to cover additional work ordered by the Engineer but not shown on the plans or required by the specifications, in accordance with the provisions of the General Conditions; similarly, they may be decreased to cover deletion of work so ordered.
The Owner reserves the right to reject the Contractor’s proposal for such extra work and to have the work performed by others.
12. This project is funded in whole or part with Community Development Block Grant (CDBG) funds regulated by HUD. All applicable federal requirements, including but not limited to those contained in the Contract Documents and Specifications (Wage Determination, HUD-4010, Section 3, Build America Buy America Act, and the Required Contract Provisions under 2 CFR 200), are hereby incorporated by reference and shall govern the work. In the event of a conflict between federal requirements and local or state requirements, the federal requirements shall control.
13. Tarrant County is the Owner and contracting authority for this project. The project City is the beneficiary of the improvements and will participate in project coordination, access, and inspections as applicable. All contractual obligations, approvals, and payments will be administered by Tarrant County.
