About this file

This document is a Request to Waive Bidding Requirements issued by the Wisconsin Department of Administration's State Bureau of Procurement for the Wisconsin Department of Corrections. The waiver was requested on April 6, 2021, approved and issued on April 14, 2021, for a sole source contract extension with Trident, Inc., a Maryland-based company located in Sparks.

The contract covers mobile medical diagnostic radiographic (x-ray) and ultrasound imaging services with radiology equipment maintenance for DOC Prison Industry and Offender Care (PIOC) facilities. The one-year extension runs from May 1, 2021, to April 30, 2022, with a maximum value of $1,000,000 and no renewal options. Services include conducting approximately 10,000 medical imaging exams annually across thirty-five DOC Health Services Units statewide, providing digitized exam images, licensed radiologist interpretations, digitized storage, transmission to DOC electronic medical records, and equipment maintenance. The waiver was justified due to delays in developing a new competitive bid caused by technical complexities and COVID-19 pandemic restrictions that prevented DOC from engaging outside clinical experts. Funding is provided through General Purpose Revenue (GPR), and the agency determined Trident's rates are well below Federal Medicare provider reimbursement rates.

Waiver For: Medical imaging and administrative services for DOC PIOC radiographic and ultrasound

Contractor: Trident, Inc.

930 Ridgebrook Road Sparks, MD 21152 Contract Period: 1 Year Renewal Option: No

Description:Wisconsin Department of Corrections (DOC) requests a sole source waiver from the competitive bidding process for a second extension to a contract with Trident, Inc. (Trident) and acquire mobile medical diagnostic radiographic (x-ray) and ultrasound imaging services with radiology equipment maintenance. This request is for a one-year period from May 1, 2021 to April 30, 2022 and will not exceed $1,000,000. Previous approval for this waiver was granted under Governor’s Case No. TE0447 (attached).

Rationale: In 1976 the US Supreme Court ruled in the Estelle vs. Gamble case that inmates have a constitutional right to access health care. Under Wis. Stat. s. 302.385, medical care shall be “based on the standards of any professional organization that establishes standards for health services in prisons and that is recognized by the department”. Delivery of imaging services are performed on a weekly basis with nearly 10,000 exams conducted at thirty-five DOC Health Services Units statewide. Service deliverables include an image exam, digitized exam image, licensed radiologist documented exam interpretation, digitized exam storage, exam transmission to DOC electronic medical records, and radiology equipment maintenance. A new bid is in development, but delays occurred because of the bid’s technical complexities and DOC has been unable to involve outside clinical subject matter experts due to the COVID-19 pandemic. The bid has not been completed in time to award and transition to a new supplier before the current agreement expires on April 30, 2021. DOC conducted a review of Trident contract charges and determined their rates are well below the Federal Medicare provider reimbursement rates which is a pricing standard used for negotiating contracts. If this waiver is not approved, DOC will be unable to meet their statutory obligations and pay significantly higher imaging service costs.

Funding: GPR - General Purpose Revenue CBA: Exempt - Agency lacks the required infrastructure.

Wisconsin Firm Impact: Vendor is not located in Wisconsin.

Certification: The undersigned certify that this request meets all applicable state and federal statutes, rules, regulations and guidelines. This certification is based on a complete analysis of the request.
