5. Reason for Authority Cited.

The follow-on effort for HIPAA program management and technical support services is underway at USAMRAA.

The new contract is not expected to be in place before 16 June 2018, which is the expiration of the current task order. The current competitive follow-on procurement is in the early stages of the procurement process and it is unlikely that the procurement process can be completed in time to make a sound contract award with sufficient start up time to provide the HIPAA program management and technical support services. The new bridge contract with Booz Allen Hamilton, Incorporated is necessary in order to provide continuity of service for the DHA Privacy Office because only one source, Booz Allen Hamilton, Incorporated, is capable of responding due to the specialized nature of the services being provided. Booz Allen Hamilton, Incorporated currently possesses the operational infrastructure, knowledge, and experience required to continue providing the requested services. Awarding to any other contractor at this stage would lead to avoidable delays and duplication of costs. At this juncture no other contractor could replace Booz Allen Hamilton, Incorporated and successfully manage the work required without significant delays and increase in administrative cost incurred by both the Government and the contractor.

Acquiring the services from another contractor will adversely impact DHA and their ability to execute operations that Booz Allen Hamilton, Incorporated is in the midst of operationalizing, for example, transitioning of DoD Military Treatment Facilities (MTFs) information systems to DHA according to the National Defense Authorization Act (NDAA) Fiscal Year 2017 among other organizational changes impacting the DHA Privacy Office. In the event this contract action had to be competed, based on the experience and in-depth knowledge required to support this effort, it would take the Government eight (8) to ten (10) months to acclimate a new contractor to the ongoing and fast paced work required to support the DHA. Booz Allen Hamilton, Incorporated has acceptable past performance in providing these services under contract W81XWH-08-D-0025, task order 0044. Furthermore, the current task order was executed on a competitive basis and this is the first bridge being requested for contract W81XWH-08-D- 0025, task order 0044. A follow-on requirement is being competed by the USAMRAA utilizing the GSA PSS.

6. Actions to overcome barriers.

At this time, no action will be taken to remove or overcome any barriers that led to the restrictive consideration. A new competitive re-compete requirement is currently in the pre-award phase of the acquisition process, and the Government intends on soliciting the re-compete under the GSA PSS schedule, with an anticipated award in October 2018.

7. Market Research.

Market Research was conducted in May 2018, which revealed that other companies can provided the same or similar services to the DHA Privacy Office that Booz Allen Hamilton, Incorporated is currently providing.

However, it would take any other company approximately eight (8) to ten (10) months to transition-in and adequately staff this requirement, which would create a loss of efficiencies and critical services. Further, the administrative costs and burden to compete this short-term bridge would far outweigh the anticipated costs of this bridge with Booz Allen Hamilton, Incorporated. Based on these facts, it is in the Government’s best interest to enter into a bridge contract with Booz Allen Hamilton, Incorporated.

8. Other Facts.

As noted in paragraph 5 above, a new competitive re-compete is currently with USAMRAA and the anticipated award date is 24 October 2018.
