About this file
This brand name justification memorandum seeks approval to acquire 30 Ocean Technology Systems Model EMA-NSW-1 headset assemblies for AGA masks from the sole-source manufacturer. The Naval Sea Systems Command Naval Surface Warfare Center Panama City Division requires the headsets to be used with its existing Seal Delivery Vehicle MK8 systems. As the original equipment manufacturer and only approved supplier per the engineering drawings, Ocean Technology Systems is deemed the only responsible source able to meet the agency's requirement of delivering all items within eight weeks of order receipt. The related small business set-aside solicitation for these headset-AGA masks is identified as N61331-23-T-TB21 and is being conducted by the Department of the Navy Naval Sea Systems Command.

(Redacted) SUBJ: BRAND NAME JUSTIFICATION MEMORANDUM TO ACQUIRE HEADSET-AGA MASKS FOR THE SEAL DELIVERY VEHICLE (SDV) MK 8 (Redacted)
1. Identification of the agency and the contracting activity, and specific identification of the document as a “Limited Source Justification.”
This is a brand specific justification. Contracting activity is Naval Sea Systems Command Naval Surface Warfare Center Panama City Division (NSWC PCD) 110 Vernon Avenue, Panama City, FL 32407-7001 Contracts Department Code 02
2. Nature and/or description of the action being approved.
This action will award a firm fixed price order on a brand name basis to the lowest price offer that can provide the required Ocean Technology System Head Set Assemblies for AGA Masks.
A description of the supplies or services required to meet the agency’s needs (including the estimated value).
This requirement is to purchase the following:
Part Number
Description
Qty
910274-001
EMA-NSW-1 - SDV Head Set Assembly for AGA Mask
30 EA
The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold of $250,000.00. All items will be delivered no later than 8 weeks upon receipt of order. (Redacted)
3. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. 10 U.S.C. 2304(c)(1). Application for brand name description FAR 6.302-1(c).
Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1(c). NSWC PCD currently has a need for Ocean Technology Systems 910274-001 (Model # EMA-NSW-1) - SDV Head Set Assemblies for AGA Masks as referenced in Section 2 of this document. This headset will be used with the existing SDV MK8 system. If another brand headset were to be purchased, it may not work with the existing SDV MK8 system, resulting in unacceptable risk to the project timeline and additional cost to the Government. Ocean Technology Systems is the OEM and the only approved source of supply for the items listed in Section 3 per the approved engineering drawing.
As such, the government does not expect significant savings through competition and it is more advantageous to the Government to award on a sole source basis to Ocean Technology Systems for the items listed in Section 2.
4. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.
5. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
For the reasons specified in paragraph 4 above, Ocean Technology Systems is the only brand that can meet the Government’s needs. (Redacted)
6. Any other facts supporting the justification. None
7. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 above, Ocean Technology Systems is the only product that can meet this requirement.
